The 10 Examiner approves the application as conditioned. 11 ORAL TESTIMONY 12 Kell McAboy introduced the staff report. Ms. McAboy and the applicants answered 13 questions from the Examiner. 14 EXHIBITS 15 See "Exhibits" attached to the staff report by Kell McAboy for Ruth and David 16 Harrison application for shoreline substantial development permit No. DDR 2007- 00016. 17 18 FINDINGS OF FACT 19 Procedural: 20 1. Applicant. The applicants are Ruth and David Harrison. 21 2. Hearing. The Hearing Examiner conducted a hearing on the application 22 on June 12, 2007, at 1:00 p.m., in,the Mason County Board of Commissioners Meeting Chambers. 23 24 Substantive: 25 3. Site/Proposal Description. The subject lot is an 1.5 acre site located on the southern shore of Spencer Lake and is accessed off of Spencer Lake Road. There is an existing 900-square foot dwelling unit that will become the ADU. A larger primary residence will be constructed on the same parcel. The south end of Spencer Lake Community is 2 surrounded by low density single-family residences on relatively larger lots compared to the more heavily developed north side. 3 5. Adverse Impacts of Proposed Use. The staff concludes in its report that 4 there does not appear to be impact on surrounding properties for services, parking, or public utilities. Furthermore, the increase in density on transforming the current 5 structure into an ADU and permitting a larger residential structure on the same parcel 6 does not appear to create significant adverse impacts on the residential use of adjoining lots due to the large lot sizes in the area and the fact that the increase in 7 density is buffered by heavy, site-obscuring vegetation. No significant adverse impacts are apparent from the record. 8 9 CONCLUSIONS OF LAW 10 Procedural: I 1. Authority of Hearing Examiner. MCC 15.03.050(J) provides the 12 Examiner with the authority to review and act upon shoreline substantial development permit applications. 13 Substantive: 14 2. Zoning Desi nation.ation. The area is zoned as Rural Residential 5 or RR-5. 15 The Shoreline Master Program environmental designation is Urban. The Mason 16 County Comprehensive Plan designation for the site is Rural. 17 3. Review Criteria and Application. MCC 1.03.029 governs ADUs in rural lands. Under MCC 1.03.029, accessory dwelling units in rural lands shall be subject 18 to a special use permit, unless they are located in the shoreline jurisdiction, in which 19 case they are subject to a shoreline permit. The proposed ADU is within 200 feet of the shoreline of Spencer Lake and therefore shall be reviewed per the Shoreline 20 Master Program policies and use regulations. As noted above, the Examiner reviews and acts upon Shoreline Substantial Development Permit applications pursuant to 21 MCC 15.03.050(J). The review criteria for a Shoreline Substantial Development Permit application is governed by Mason County Comprehensive Plan, Chapter IX; 22 Accessory living quarters and under Mason County Code 17.50.060 Section entitled 23 Accessory Living Quarters. These criteria are quoted and addressed below. 24 MASON COUNTY COMPREHENSIVE PLAN, Chapter IX: Accessory LivinE Quarters. Accessory living quarters for the use of the guests, employees, or 25 immediate family members should be allowed as a substantial development when minimal impact would occur to surrounding areas. The cumulative impact of like structures on neighboring properties must be considered. Harrison SSDP p. 2 Findings, Conclusions and Decision {PA0666032.DOC;1/13009.090000/9000001 4. The above criteria are met. The proposal is in an area surrounded by 1 relative large lots that could easily accommodate ADUs without detriment to the 2 greater community of Spencer Lake. 3 MCC 17.50.060. Use regulations for accessory living quarters. Accessory living quarters are defined in this chapter as separate living quarters attached or detached 4 from the primary residence which contains less habitable area than the primary residence. They are subject to the following criteria: (1) Only one accessory living 5 quarter per lot. In an urban environment a lot must be 1-112 the size required for a 6 single-family residence which totals 18,750 square feet. (2) Strict compliance with current sewage setback and design standards as per WAC 248-76-090. (3) Minimal 7 impact on surrounding properties from view blockage, trajjgc,parking and drainage. (4) Compliance with setback criteria. (5) Accessory living quarters shall require a 8 substantial development permit and shall not exceed 1,000 square feet. 9 5. The above criteria are met. The proposal meets the lot size provisions. 10 Furthermore, subject to building permit review, Mason County Environmental Health will review for consistency with WAC 248-76-090 and set requirements accordingly. 11 The proposal will have minimal to no impact on views, traffic, parking and drainage. The proposal exceeds a setback criteria as set forth in the residential development 12 table of Mason County Code 17.50.060. The total square footage of the ADU is 900 13 square feet. 14 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW 15 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review proposed development according to the following criteria: 16 1. The development does not conflict with the Comprehensive Plan and meets 1 the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 18 2. Development does not impact the public health, safety and welfare and is 19 in the public interest. 20 3. Development does not lower the level of service of transportation and/or 21 neighborhood park facilities below the minimum standards established within the Comprehensive Plan. 8. As indicated in the staff report, the project is consistent with the Mason 23 County comprehensive plan and will not lower the level of service for transportation or park facilities. In addition to requirements already addressed in the above 24 Conclusions of Law, the project appears to be consistent with other applicable 25 requirements of the Mason County Code. It meets the requirements and the intent of Title 6, 8 and 16. This report evaluates an application for a Shoreline Substantial Development permit under the Mason County Shoreline Master Program for the use of an existing 900 square foot residence as an accessory living quarters in order to allow a larger primary residence to be constructed on the same parcel. Staff is recommending approval of this project as currently proposed. II. Applicant: Ruth and David Harrison, owners. III. Authorized Representative: Same. IV. Date of Complete Application: March 8, 2007. V. Site address and Project Location: Spencer Lake 1610 E Spencer Lake Rd, Shelton, WA. Parcel #22132-33-90090. VI. Evaluations. A. Characteristics of the area. The south end of Spencer Lake community is surrounded by low density single-family residences on relatively larger lots (compared to the more heavily developed north side). B. Characteristic of the site. The 1.5-acre site is located on the southern shore of Spencer Lake and is accessed off of the Spencer Lake road. There is an existing 900 square foot dwelling unit that will become the ADU presuming approval of the Substantial Development permit. C. Comprehensive Plan Designation. The Mason County Comprehensive Plan designation for the site is Rural. SHR2007-00016 -2- D. Shoreline Master Program Designation.tion. The Shoreline Master Program environmental designation is Urban. E. Zoning. Rural Residential 5 (RR5). VII. SEPA Compliance and other public notice requirements. The proposal is SEPA exempt under WAC 197-11-800, as a single-family residential dwelling. VIII. Other Permits. The proposal requires a Mason County Building Permit. IX. Analysis. A. Comprehensive Plan Review Type III Review for permit applications require that the Hearing Examiner evaluate the proposal for consistency with Mason County's Development Code, adopted plans and regulations. The Hearing Examiner shall review the proposal according to the following criteria: 1. The development does not conflict with the Comprehensive Plan and meets the requirements and the intent of the Mason County Code, especially Title 6, 8, and 16. 2. The development does not impact the public health, safety and welfare and is in the public interest. 3. The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The development meets the applicable criteria and does not conflict with the Comprehensive Plan, and meets the requirements and intent of the Mason County Code. B. Mason County Development Regulations 1.03.029 Accessory Dwelling Unit Requirement A. The ADU shall be subject to a special use permit,unless in the shoreline jurisdiction it is subject to a shoreline permit. The proposed ADU is within 200'of the shoreline of Spencer Lake and therefore shall be reviewed per the Shoreline Master Program policies and use regulations. C. Mason County Comprehensive Plan Chapter IX:Accessory Living Quarters Policy Accessory living quarters for the use of guests, employees or immediate family members should be allowed as a Substantial Development,when minimal impact would occur to the surrounding area. The cumulative impact of like structures on neighboring properties must be considered. The proposal is in an area surrounded by relatively large lots that could easily accommodate ADUs without detriment to the greater community of Spencer Lake. D. Mason County Code, Title 17.50 Zoning—Shoreline Master Program Use Regulations Accessory Living Quarters SHR2007-00016 -3 - Accessory living quarters are defined in this chapter as "Separate living quarters, attached or detached from the primary residence which contain less habitable area than the primary residence." They are subject to the following criteria: 1) Only one accessory living quarter per lot. In an urban environment, a lot must be 1-1/2 the size required for a single family residence which totals 18,750 square feet. The proposal exceeds the lot size provisions. 2) Strict compliance with current sewage setback and design standards as per WAC 248-76-090. Subject to building permit review, Mason County Environmental Health will review for consistency with WAC 248-76-090 and set requirements accordingly. 3) Minimal impact on surrounding properties from view blockage, traffic, parking and drainage. The proposal will have minimal to no impact on views, traffic,parking and drainage. 4) Compliance with setback criteria. The proposal exceeds the setback criteria as set forth in the RESIDENTIAL DEVELOPMENT table of Mason County Code 17.50.060. 5) Accessory living quarters shall require a Substantial Development Permit and shall not exceed 1,000 square feet. The total square footage is 900 square feet. X. Conclusions. The project is consistent with the Comprehensive Plan, the Development Regulations, and the Shoreline Master Program Policies and Use Regulations. As proposed staff recommends approval of the Shoreline Substantial Development Permit application #SHR2007-00016 to allow the existing 900 square foot residence to become an ADU, which will allow for the future construction of a larger primary single-family residence. XI Choices of Action. 1. Approve. 2. Approve with conditions. 3. Deny(reapplication or resubmittal is permitted). 4. Deny with prejudice (reapplication or resubmittal is not allowed for one year). 5. Remand for further proceedings and/or evidentiary hearing in accordance with Section 15.09.090 of Title 15. Originally, it was a bunkhouse built more than 50 years ago. In 1992 the owners began a project to construct a garage that could later be converted into a home. The owners have recently retired and are now ready to proceed with completing the building project.
