Subject: Bulkhead and fill on John ?irk]e's Property
Mr. ?i rkl e whose property is located one lot north of E -7001 Mason Lake
Dr. E., Lot 8bB constructed a bulkhead on his property about (3) three
years ago. This bulkhead construction was constructed without a county
permit, The bulkhead •,ryas constructed ( 15) fifteen feet beyond the
connecting shoreline. At the time that the bulkhead was constructed we
were new neighbors and new to Mason County. As the years have past the
level of water in Mason Lake as changed it has created unforeseen
problems that I feel Mason County should review.
This bulkhead stops the natural flow of silt and mud down the north
channel of Mason Lake, which leads to a larq_e build up of silt and mud in
front of my bulkhead and property. The silt on hot days has an odor and
attracts bugs.
I have discussed this problem with John ?irkle and he feels even though
the bulkhead is built without a permit, it's location is OK. I order to
resolve this matter I would like someone from the Mason County Planning_
and Shoreline Departments to qo out and review Mr. ?i rkl e's bulkhead.
Upon completion of this review I would like county to explain to all
parties involved what options are available to rectify this situation.

Dear Mr . Yando and Ms . Miller :
This letter comes as a follow up to our meeting this afternoon .
Thank you for coming out to discuss this situation with us .
Enclosed are copies of receipts from two contractors for bringing
in material so I could backfill and level our bulkhead . This
does establish when the bulkhead was started.
our intention for our Mason Lake property is to build a home on
the property in September of this year , after completing the
permit process . This will be our permenant residence.
When we put the bulkhead in, we were new to the lake. We did not
know of a master plan and was not informed by our real estate
agent . We did not willfully put this in without a permit . We now
realize that we were in violation when we put the bulkhead in and
would like to make it right without having to take it out.
Since we put it in , we have had a lot of positive comments about
it from residents on the lake. It wasn ' t until June 14 , 1992
that our neighbors Ron Burris and Larry Wiley expressed any
concern . Mr . Wiley and Mr . Burris were our neighbors when we put
the bulkhead in and commented on how nice it was . This lead us
to believe that they didn' t have a problem with it . From the
time we put it in until June 14 , 1992 , we did not hear any
negative comments about our bulkhead from anyone. It wasn ' t
until we mentioned that we were going to build a home that Mr .
Burris and Mr . Wiley came to us with concerns about our bulkhead.
As far as the silt build up is concerned , there has always been a
build up in front of Mr . Burris ' property , before we ever cleared
our property . There has also been a lot more building
construction on our side of the lake over the last year and a
half and a lot more boat action with the closure of two other
boat launches . This leave one county boat launch at our end of
the channel to serve the whole lake . if you could take the time
to walk to other properties on our end of the lake you will see
there is silt build up there also . This channel is only six to
seven feet deep and has a very muddy botton. This is the end of
the lake where the water flows out . There will always be some mud
or silt build up on someones property because of the shoreline
uneveness .

Dear Mr. & Mrs. Zirkle:
After consideration of a recruest for review of the existing
bulkhead and landfill on your property, the Mason County Planning
Department has determined that the bulkhead and landfill are in
violation of the Mason County Shoreline Master Program. Both the
bulkhead and landfill must be removed and the area restored to a
condition comparable to it' s original state. A Mason County
building permit must be obtained to replace the bulkhead along the
length of the shoreline and within one foot W ) of the ordinary
high water mark. The building permit application should address the
removal of the bulkhead and landfill and include a plan for
restoration of the lake.
A building permit and environmental review would have been required
for the proposal prior to it' s construction. Therefore, the
development is also in violation of the Uniform Building Code and
subject to Building Code Enforcement procedures .
A Hydraulic Project Approval from the Washington State Department
of Wildlife is also required to remove the fill and restore the
site . I have enclosed both applications for your convenience . A
water quality modification permit may also be required from the
Washington State Department of Ecology.
The Mason County Shoreline Master Program Bulkhead Chapter
7 . 16 . 110, Use Regulation #2 states that "Bulkheads may be allowed
to re-establish a shoreline boundary that has eroded away within
the past two years . The burden of proof shall be on the applicant .
Re-establishment of all other historical shoreline boundaries is
prohibited when it does not meet the criteria of this chapter. "
Use Regulation #3 states that "Bulkheads on lake shores subject to
erosion shall be located within one foot of the toe of the bank or
the line of ordinary high water whichever is furthest landward and
shall generally parallel the natural shoreline. "

The Landfill Chapter 7 . 16 . 130 Policy #3 states that "In evaluating
fill projects and in designating areas appropriate for fill , such
factors as total water surface reduction, navigation restriction,,
impediment of water flow and circulation, reduction of water
quality and destruction of habitat should be considered. "
Policy #1 of the Landfill Chapter states that "any permitted fills
or shoreline cuts should be desia_ned so that no significant
alteration of local currents will occur, creating a hazard to
adjacent life, property, ecological values, or natural resources . "
Use Regulation #1 of the Landfill Chapter states that "Landfills
are prohibited waterward of the ordinary high water mark or on
biological wetlands, except that they may be permitted as a
Conditional Use for aquacultural practices and water dependent uses
where no upland or structural alternative is possible. Fill
necessary for erosion control bulkheads shall not be considered
under landfill . "
The Policies and Use Regulations of both the Bulkhead Chapter
7 . 16 . 110 and the Landfill Chapter 7. 16 . 130 prohibit development
such as the existing bulkhead and landfill on your property.
Therefore, these developments are in violation of the Mason County
Shoreline Master Program. We are unable to process the development
as an after-the-fact permit because it is strictly prohibited by
the Shoreline regulations and you would not have the option of
applying for a Variance. Therefore, the Planning Department
respectfully requests your cooperation in the removal of the
bulkhead and fill and subsequent restoration of the site.
At this time the violation is being reviewed and processed under
the Inspection, Enforcement and Penalties Chapter 7.32 of the Mason
County Shoreline Master Program, pg. 95 . Please submit the above
requested information within ten (10) days of the date of receipt
of this letter. If you have any questions, please contact either
myself or the Director of Community development, Gary Yando. We
would appreciate your cooperation in this matter. Thank you.
