Project Description Project Overview This Habitat Management Plan has been submitted on behalf of Gary and Vicki Reed in order to comply with Mason County's Critical Areas Ordinance and facilitate approval of streambank protection to their property on Lilliwaup Creek. The proposed project site, which is located off SR Hwy 101 at Lilliwaup Falls, includes a residence, a hydro power plant,and a hatchery facility that is operated by Long Live the Kings. Six salmonid ESU's have been documented to spawn in Lower Lilliwaup Creek. In addition,the hatchery raises ESA listed Hood Canal summer-run chum and Puget Sound Steelhead. A December 2007 storm event resulted in flooding that damaged existing structures and deposited a significant amount of alluvial sediments into the streambed. Emergency repairs were permitted and completed in the summer and fall of 2008. Long Live the Kings are in the process of obtaining a U.S. Army Corp of Engineer's permit to dredge the entire lower length of Lilliwaup Creek,which will address the stream's aggradation problem. Residual damage from the mass wasting of steep terrain on Lilliwaup Creek, immediately adjacent to its main tributary,Beardslee Creek,was addressed in the fall of 2009. As per the Washington State Department of Fish and Wildlife's(WDFW) recommendation,a fix that involved minimal disturbance to Lilliwaup Creek was implemented. Subsequently,steep terrain directly adjacent to approximately 80 to 100 feet of streambank was resloped to a 3 to 1 grade,which required the removal of alluvial sediments from an approximately 2000 square foot area. Large angular rock was installed, in-stream,around the footing of an existing flume(for the hydro power plant). In addition,the hillside landward of the regraded slope was planted with native trees, while the slope above an existing concrete bulkhead was planted with native shrubs and other non-invasive vegetation. The project was reevaluated in the spring of 2010. Despite a relatively mild winter,the site suffered significant toe erosion, leaving a large willow tree that was previously on the bank now in the active channel(i.e. emerged in water). After a site visit on 7-7-10,the Lilliwaup Creek HMP 4 WDFW's biologist and an environmental expert from the Skokomish Tribe agreed that the streambank immediately north of Beardslee Creek and the existing flume requires more adequate protection in order to prevent future mass wasting events that will further aggrade Lilliwaup Creek and/or eventually damage existing structures. Project Description In order to protect the site from erosion and potential mass wasting,bank protection consisting of large woody debris(LWD)with root wads and large angular rock is being proposed along approximately 80 to 100 feet of streambank,landward of the active channel(Attachment 2). Large angular granite rock(4-man,2000 to 4000 lbs.) shall be countersunk below the scour depth, landward of the active channel(Attachment 3). It shall be placed slightly irregularly to create interstitial refuge habitat for salmonids. The LWD(at least 8 pieces that are approximately 20 inch diameter and 15 feet in length and at least 6 smaller pieces that are approximately 10 inch in diameter and 15 feet in length) shall be installed on top of the base rock with the root wads in the active channel. The non-root wad end shall be sharpened and embedded in the bank and anchored with four- man rock ballast(1/2 to 2/3 of the length of the LWD). In addition,the LWD shall be anchored to the upper bank with cable and a manta ray anchor, using a pre-drilled hole to run the cable through the large woody debris. To minimize disturbance,rubber wheeled equipment shall be utilized wherever possible. Work is tentatively scheduled to begin after the receipt of all required permits and approvals, during the permitted work window for the protection of juvenile salmonids and prior to the mid-August arrival of spawning Hood Canal summer-run chum. Work will be completed in a timely fashion during daylight working hours normal to a rural neighborhood. In order to maintain the present water quality of Lilliwaup Creek,the following Best Management Practices will be implemented during construction: 1)All existing vegetation shall be preserved except where required to be removed for construction purposes. 2)Erosion control methods shall be utilized to minimize construction related sedimentation and turbidity,including filter fences,temporary settling ponds,burlap bag and pea gravel check dams, immediate mulching of exposed soils,and cessation of work during high flow conditions. 3)Equipment shall be cleaned and checked for leaks,offsite and daily, before commencing work. 4)Equipment shall cross the stream only as necessary on make-shift bridges using old culvert sections and mats. 5) Large angular rock shall be clean and dry before being placed in stream. The following Spill Prevention Control measures shall also be followed: 1)The contractor will supply the site with a portable bathroom so that liquid or solid waste will not become a source of stormwater pollution,or the applicants shall allow workers access to an on site bathroom. 2)The contractor shall be responsible for alerting the appropriate authorities in the event of a hazardous spill. 3) The contractor shall be able to perform Lilliwaup Creek HMP 5 basic control,containment,and/or confinement operations within the capabilities of the resources and personnel protective equipment available. In other words, small spills, such as paint or oil, shall be promptly and fully collected and disposed of at a suitable disposal site. In the event of a significant spill,a fish kill,and/or if fish are observed in distress the Washington State Department of Ecology(800.258.5990)and the Washington State Department of Fish and Wildlife's Area Habitat Biologist, Gloria Rogers(360.249.1293), shall be notified immediately. D. Action Area The action area is located on lower Lilliwaup Creek in the vicinity of Lilliwaup Falls and the mouth of Beardslee Creek approximately one mile north of the Hood Canal. Besides the project location,the action area includes the area within a one-mile radius of the site in order to account for construction related noise that may affect species listed under the Endangered Species Act by the U.S. Fish and Wildlife Service as either endangered or threatened; specifically,nesting or foraging marbled murrelets or Northern spotted owls. The action area also includes Lilliwaup Creek, approximately 1 mile downstream of the site until it discharges into the Hood Canal and the marine environment within a one-mile radius, in order to account for littoral drift. Site-specific conditions, including coarse sediments(sand, gravel,and cobble), low stream flows,and a northwest drift pattern are expected to confine drift to Lilliwaup Bay,as indicated from drift cell MA-4-2(WSDOE 2002). Lilliwaup Bay originally extended farther inland,but construction of the bridge (SR Hwy 101)has isolated the portion west of the highway and it is not now affected by shore-drift(WSDOE 2002). II. Species and Habitat Information A. Species Information In the proposed project area,there are six species listed under the Endangered Species Act by the U.S. Fish and Wildlife Service as either Endangered or Threatened: the Puget Sound Chinook salmon(Oncorhynchus tshawytscha),the Hood Canal summer-run chum salmon(Oncorhynchus keta),the Puget Sound steelhead(Oncorhynchus mykiss),the northern spotted owl(Strix occidentalis),the marbled murrelet(Brachyramphus marmoratus marmoratus),and the bull trout(Salvelinus confluentus). In addition, WDFW data revealed that two other species of anadromous salmonids on the state's SOC (species of concern) list are also ESA listed Species of Concern: the Puget Sound coho salmon(Oncorhynchus kisutch)and the Puget Sound/Coastal cutthroat(Oncorhynchus clarki clarki). Lilliwaup Creek HMP 6 Washington State Department of Ecology(WSDOE 2007)and Washington Department of Fish and Wildlife(WDFW 2003)GIS maps reveal the documented spawning presence of fall Chinook, fall chum,summer-run chum,coho,and cutthroat, and the documented presence of winter steelhead. The hatchery at the site rears ESA listed Hamma Hamma and Lilliwaup summer-run chum and Duckabush and Dewatto winter steelhead. Critical habitat for Chinook,Hood Canal summer-run chum,and bull trout includes all nearshore marine areas of Hood Canal and the Strait of Juan del Fuca from the line of extreme high tide out to a depth of 30 meters(70 FR 52739). Lilliwaup Creek,which is Critical Habitat for the summer-run chum,includes spawning,migration,and foraging habitat, while Critical Habitat along the nearshore supports foraging,rearing, and migration habitat for Chinook, summer-run chum,and bull trout. D. Survey Results A field investigation was conducted on July 71`2010,at eleven in the morning. The weather was sunny and the temperature around eighty degrees Fahrenheit. As previously noted, despite a relatively mild winter,the site suffered significant toe erosion,leaving a large willow tree that was previously on the bank now in the active channel(i.e. emerged in water). The newly planted vegetation at the site appeared to be extremely healthy. E. Existing Environmental Conditions The environmental baseline represents the existing set of conditions,to which the effects of the proposed action are then added. The emergency proposed project site is located in the Water Resource Inventory Area(WRIA) 16,on Lilliwaup Creek in Mason County. Neighboring properties to the west,east,and north are heavily forested and undeveloped. To the south,there are several single-family residences on the east side of the stream. Farther south,adjacent SR Hwy 101,on the west side of the stream,there are a half- dozen SFRs located along the estuary at Lilliwaup. Lilliwaup Bay originally extended farther inland,but construction of the bridge(SR Hwy 101)has isolated the portion west of the highway and the river delta above the bridge appears to be filling in with sediment at a rapid rate(WSDOE 2002). Presently,the main channel is severely aggraded downstream from the proposed project site. The Hood Canal is on the WSDOE's 2008 Water Quality 303(d) List as an impaired waterbody for the following parameters: dissolved oxygen and fecal coliform.(WSDOE 2008). It can be assumed that the existing environmental conditions in the area have also been degraded by development, shoreline hard-armoring,organic and inorganic pollutants,deforestation, fishing, and other anthropogenic changes. i Lilliwaup Creek HMP 7 III. Effects of the Action A. Direct Effects Direct effects are the immediate effects of the project on the listed species and their habitats(FWS &NMFS 1998). The direct effects to the project site will be: 1)the placement of large angular rock and large root wads along the streambank. 1) The placement of large rock and at least 14 pieces of LWD with root wads along the streambank will result in the direct creation of streambank habitat for juvenile salmonids. The root wads will create roughness(interrupting high-velocity flow along the rocks)and habitat complexity, while the large rock will create interstitial spaces that will provide refuge habitat from flooding and/or predation. 2) The LWD and rocks will minimize or cut-off altogether the supply of sediments to the stream wherever they are placed. Since both the risks and consequences of streambank failure are high, i.e. the area is likely to be subjected to future heavy flooding that could potentially damage or destroy the power plant's flume,hard armoring appears to be required. Streambed scouring is not expected to be an issue considering the depositional nature of lower Lilliwaup Creek. Temporary direct effects caused by the construction process include: 1) sedimentation and turbidity in Lilliwaup Creek due to the placement of the large rock and LWD. 2) noise. 3)water pollution from incidental release of fuel,oil,or other contaminants. 1)Increased turbidity and sedimentation may impact juvenile salmonids that are in the stream. Juvenile salmon are mobile, so it is possible that they will avoid the area of disturbance and not be impacted. Salmonids have been observed to move laterally and downstream to avoid turbidity plumes(Sigler et al. 1984,Lloyd 1987, Scannell 1988). Gregory and Northcote(1993) suggested that turbidity could be used by juvenile salmon as a protective cover. Considering the short duration of the proposed project (approximately 7 days),the substrate composition(primarily cobble,rock,and gravel), and the stringent construction provisions(see Project Description),it is expected that turbidity and sedimentation will be minimal. 2)The main source of construction noise will be the operation of large equipment. The project site is located in a rural area, in close proximity to SR Hwy 101, so it is expected that the noise from large equipment will not be more excessive than noise normal to the neighborhood. Salmonid eggs are potentially vulnerable to detrimental impacts from noise; however, work shall be completed before the return of spawning ESA listed species. Juveniles in the stream may also be vulnerable to noise impacts,although it is expected that they will avoid the area until the noise ceases. 3) Potential water pollution from accidental release of fuel,oil,or other contaminants is another possible temporary direct effect. As previously discussed,BMPs shall be implemented during the project to maintain the existing water quality of Lilliwaup Creek and prevent turbitidy or pollution. Lilliwaup Creek HMP g B. Indirect Effects Indirect effects are those effects that are caused by or will result from the proposed action and are later in time,but are still reasonably certain to occur(50 CFR 402.02). Indirect effects from this proposed project include: 1)The creation of a deepened thalweg in the form of a high-velocity pool along the streambank rock protection. The potential creation of a deepened, high-velocity thalweg shall be mitigated by the addition of the large root wads, which will add roughness and interrupt flow. Since the track record for attaching single pieces of large woody debris to riprap streambank revetments has been poor(WDFW 2002), '/z to 2/3 of the length of the root wads shall be embedded into the bank and anchored with large rock ballast. The LWD shall also be held in place by manta ray anchors that will be attached to the LWD through a pre-drilled hole, then anchored into the bank, landward of the LWD and large rock. 2)The native conifers planted(in the fall of 2009),landward of the streambank protection,eventually grow large enough to provide the stream with shade to moderate summer water temperatures,woody and organic debris, insect prey,and bank protection. D. Cumulative Effects Cumulative effects are defined as"those effects of future state or private activities,not involving Federal activities,that are reasonably certain to occur within the action area of the action subject to consultation"(50 CFR 402.02). Cumulative impacts are difficult to access. Continued growth and urbanization is likely to detrimentally impact fish and wildlife resources. Global warming could raise the water level of Puget Sound, leaving many waterfront properties underwater. Over-fishing may deplete stocks of salmon, even as restoration of habitat in the watershed furthers their likelihood of survival. E. Take Analysis Section 9 of the ESA prohibits take of endangered or threatened species,"take"being defined in Section 3 as to harass,harm,pursue,hunt, shoot,wound,trap,capture,or collect listed species,or attempt to engage in any such conduct. "Harm"is further defined as a significant habitat modification or degradation that actually kills or injures listed species by"significantly impairing behavioral patterns such as breeding, spawning, rearing,migrating, feeding,and sheltering"(50 CFR 222.102). "Harass"is further defined as an intentional or negligent act which creates the likelihood of injury to wildlife by annoying it to such an extent as to significantly disrupt normal behavior patterns which include,but are not limited to, breeding, feeding,or sheltering(50 CFR 17.3). In regards to the proposed project and the existing development activities,it is extremely I Lilliwaup Creek HMP 9 unlikely that any "take"will occur. The following conservation measures(some previously discussed)will further insure the likelihood that no"take"will occur. F. Conservation Measures 1. Previously discussed BMPs to be strictly adhered to. 2. The slope above the proposed project site to be planted with native conifers and vine maple,and the slope above an existing concrete bulkhead to be planted with native trees, shrubs, and additional non-invasive vegetation (implemented in fall of 2009). 3. At least 14 Western red cedar or Douglas fir root wads to be incorporated into the streambank protection structure(see Attachments 2 & 3). 4. Project construction shall be completed before August 15t',the approximate return date of spawning Hood Canal summer-run chum. G. Determination of Effect A determination of May affect, not likely to adversely affect is the appropriate conclusion when effects on the species are expected to be beneficial,discountable,or insignificant After reviewing the appropriate data and survey information, I have concluded that the proposed project will have an insignificant impact on the previously discussed Endangered or Threatened species if the previously discussed conservation measures are implemented. In my most honest and professional opinion,while the proposed project may impact individual Endangered or Threatened species in the project area, it is not likely to adversely affect or jeopardize the continued existence of those species. The determination of effect for each of the listed species is: 1. Puget Sound Chinook—May affect, not likely to adversely affect. 2. Puget Sound Steelhead--May affect, not likely to adversely affect. 3. Bull Trout--May affect, not likely to adversely affect. 4. Hood Canal Summer-Run Chum--May affect, not likely to adversely affect. 5. Northern Spotted Owl--May affect, not likely to adversely affect. 6.
