Box 1191 Shelton, WA 98584 September 30, 2005 Dear Mr. Hungerford, On September 20th I had an opportunity to inspect the site of your proposed forest practices application(FPA). Your proposal for these south shore properties is complicated due to both the topography and proximity to Hood Canal and other critical resources. Below I have identified five issues that will need to be addressed in more detail before a SEPA determination for this project can be issued. Logging in Vegetative Buffer: The portion of this application that is described as the removal of"danger trees" from, and adjacent to, the SR 106 right of way and lays within the 100' vegetative buffer of Hood Canal (see Mason County Resource Ord., sec 17.01.110, Table 3). These trees do not meet the definition of a"danger tree"as defined by the Resource Ord. (sec. 17.01.240). I have checked with the Dept.Natural Resources and these trees do not meet their more liberal danger tree definition either. To be clear,maintenance with in the disturbed portion of the SR 106 right of way is exempt from the Resource Ord. (sec. 17.01.130.F)but anything out side of the maintained roadway is not exempt. Any tree removal within the 100' vegetative buffer will require a Mason Environmental Permit (MEP) and Habitat Management Plan (HMP) (17.0 1.11 O.G). Type 4 Stream: Related to the above topic is a previously typed Type 4 stream lying near the western boundary of this proposed cut. Per 17.01.110, Table 3, a 100-foot buffer needs to be maintained on this stream or the MEP/HMP process will be required. Location of Southern Boundary of Cut Unit: I noted that the south line of the cut on parcels 32234-44-00000 and 32234-44-00010 has not been flagged and does not appear(based on comparisons of sketches proved) to necessarily follow the old cat road as shown on the Bluhm and Associates survey map. Where the boundary of the cut unit and the location of the cat road differ, I need to see some flagging. Pileated Woodpecker Habitat: When in the field I observed some Pileated Woodpecker forage snags near the property line between parcels 32234-44-00010 and 32235-32-00130. Under section 17.01.110.B.9 of the Resource Ord., Pileated Woodpeckers are considered a"species of importance" and their habitat is afforded some protection. When evidence of a possible critical habitat for a species of importance is found on a site, it is the responsibility of the applicant to hire a qualified biologist to determine if the habitat is "critical"or not. If the habitat is deemed critical than a HMP will be required. The HMP will be reviewed by the County for compliance with section 17.01.01 U of the Resource Ord. The HMP should be accompanied by a signed release from the Washington State Department of Labors and Industries (L&I) confirming that the HMP satisfies their occupational safety concerns. Land Modification Permit: According to your SEPA checklist, your proposed roadwork will involve more than 250 cubic yards of cut and fill material. This volume of material will require a Mason County Land Modification permit, SEPA review (which can be included in your current case) and a MEP/HMP if the new road construction occurs within 100 feet of ordinary high water(OHW). I did receive the geo-technical reports from Hall Parks and George Bennett. Currently they are being reviewed by Public Works. Please call me at ext. 571 if you have any additional questions.
