There are potential risks and monetary liabilities to the homeowner for using an unregistered contractor. Further information can be obtained at X 800-647-0982. The person signing this condition is either the homeowner, agent for the owner or a registered contractor according to WA state law. 2) All approved plans are required to be on-site for inspection purposes. If an inspection is called for and plans are not available on site, then approval will not be granted. In addition, a re-inspection fee(refer to current fee schedule, minimum 1 hour) will be charged and must be collected by the Building Department prior to any furtherfu inspections being performed or approvals granted. Occupancy is limited to the approved and permitted cla:nification. Any non-approved change of use or occupancy would result in permit revocation. X 1W 8) All changes to "approved" building plans that effect compliance with the international codes as amended and adopted, or any other Mason County X rdinance or regulation, must be reviewed and approved by Mason County prior to construction. 04 9) CONSTRUCTION PROCESS TO BE FIELD CORRECTED AS REQUIRED PER MASON COUNTY BUILDING DEPARTMENT AND THE ADOPTED BUILDING CODE. The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance with the international codes as amended and adopted by Mason County. Any corrections, changes or alterations required by a Mason County Building Inspector shall�e ade prior to requesting additional inspections. X 10) All property lines shall be clearly identified at the time of foundation inspection. X_J214 11) All building permits shall have a final inspection performed and approved by the Mason County Building Department prior to permit expiration. The failure to request a final inspection or to obtain approval will be documented in the legal property records on file with Mason County as being non-compliant with Mason County o in nces and building regulations. X 12) All permits expire 180 days after permit issuance, or 180 days after the last inspection activity is performed. The Building Official may extend the time for action for a period not exceeding 180 days, upon the receipt of a written extension request indicating that circumstances beyond the control of the permit (older have prevented action from being taken. No more than one extension may be granted. 13) Per engineer of record the backfill for the ret W wall requires compaction to 80-90%. All applicable recommendations and specifications shall be applied to the development on this site. Any deviation requires stamped written approval from the registered design professional responsible for the report/assessment, and may require special inspection by same. Structures and/or land modifications (grading, cuts, fills, etc.) required in the geotechnical report/assessment, may require a separate permit. The geotechnical report/assessment shall rem ai��ttached to the approved building plans. Since , Pam B nnet -Cumming Land Use Planner Mason County Planning Department 12/2/2008 Page 1 of 3 BLD2008-01310 REQUEST FOR ADDITIONAL INFORMATION 12/2/2008 Case No.: BLD2008-01310 Comments: In Notification of Incomplete Application letter dated November 21, 2008 - planning staff indicated that they would conduct a site review in order to provide you with additional information regarding next steps for this project review. Staff conducted that review on November 26th 2008, and provides the information below and enclosures, so you have the necessary information to continue the permit process for this project. Please be aware that the current fee ordinance has been enclosed. Submittals after the end of 2008 are subject to Ordinance 123-08 which provides for new fees beginning January 1, 2009. 1. Shoreline Substantial Development Permit. Your proposed retaining walls are within 200 feet of the Ordinary High Water Mark of Hood Canal, and valued at over$5,718.00. Therefore the project will require application for and approval of a Shoreline Substantial Development Permit. An application packet is enclosed, together with the fee schedule (Shoreline permit fee, Hearings Examiner fees and MEP fees highlighted) . 2. Mason County Resource Ordinance Fish and Wildlife Habitat Management Area Chapter 17.01.110 (F & W Chapter): This chapter specifies that buffers on this saltwater shoreline is 100 feet as measured from the Ordinary High Water Mark of Hood Canal. At this site the Ordinary High Water Mark is directly adjacent to the north boundary of State Route 106. At its closest location the cut face that will receive the rock wall is less than 90 feet from the Ordinary High Water Mark of Hood Canal. Therefore that portion of the road-related support wall within the 100 foot buffer will require application, review and approval of a Resource Ordinance Mason Environmental Permit per section 17.01.110.G.i. As you will see from the chapter, other forms of activity within the buffer require a Variance, but there is a provision for road/street expansion and construction with a Mason Environmental Permit and Habitat Management Plan. For the purposes of Resource Ordinance review we are considering the retaining walls a necessary part of the road, due to site conditions. Forms are enclosed, together with a list of HMP professionals; Section J of the F & W chapter provides the requirements for the HMP. Once the applications and HMP are received, the HMP will be distributed for comment, during the MEP review process. 3. Project-specific Geotechnical Report: This site has slopes greater than 40% at and within 300 feet of the proposed road retaining walls. You have submitted two original geotechnical reports, however they specifically address proposed residential development at the site and do not address the walls associated with the roads. Please have your geotech revise this report to include the proposed approximately 240 linear feet of rock retaining walls on the upland side of the existing 1212/2008 Page 2 of 3 BLD2008-01310 REQUEST FOR ADDITIONAL INFORMATION 12/2/2008 Case No.: BLD2008-013'10 roads. Your engineer provided design for the rock retaining wall, but: it is not addressed specifically in the geotech report. We have also enclosed Geotech report submittal checklists with the copy of this letter being sent to your engineer; these wet-stamped originals need to accompany the two revised geotech reports. In addition, per staffs site visit, the road(s) appeared to be quite narrow. If they need to be widened to accommodate the walls, then that activity also needs to be addressed within the geotech report, including amount (cubic yards) of material to be graded. According to the site plan there is an existing dirt road, however based on a site review by staff several years ago that road is not well developed. The rock walls will be on the upland side of portions of the road, at times protecting 12ft road cuts, some other areas may be 9 ft max. road cut. Based on the proposed road cuts a grading permit may also be necessary. No information is currently provided for the road grading necessary to install the walls. A Planning Pre-inspection was applied for and conducted in August 2008, for a proposed future dock. It did not request review for the current rock wall project. Mason County Shoreline Master Program: Site is within 200 feet of the ORdinary High Water Mark (OHWM) of Hood Canal, therefore is within Shoreline jurisdiction. As a structure proposed within the shoreline jurisdiction, the project will require application, review and approval of a Shoreline Substantial Development Permit. Application materials are enclosed. The process requires application, public notice and notification, a public comment period, and a public hearing before the Mason County Hearings Examiner. The process can take several months, so you would want to , apply soon, with that in mind. SEPA: Depending on the amount of material that will be graded, SEPA review may be required. This entails a 2-week comment period which would be run during the review of the shoreline permit. Mason County Resource Ordinance: If the proposed rock wall and road grading is within 1 CIO feet of the ORdinary High Water Mark of Hood Canal, a Resource Ordinance Variance will be required. This process requires application, public notice and notification, public comment period and a public hearing before the Mason County Hearings Examiner. A Habitat Management Plan is also required, which will be reviewed by jurisdictional agencies during the comment period. Staff will conduct a project-specific site visit to make that setback determination, then notify you. Project-specific geotechnical report: Landslide Hazard Area Chapter 17.01.090 provides that a special report is required for projects on steep slopes such as this parcel. If there are slopes greater than 40% within 300 feet of the project, a geotechnical report will be required. Your geotechnical professional will make that determination based on field review, and provide the necessary report. Two wet-stamped originals are required, with original wet-stamped submittal checklists. The documents must be consistent with the current version of the chapter.
