Applicants: Neal and Laurie Cox.
Notice is hereby given that Neal and Laurie Cox, applicants for the above referenced
Special Use Permit,have been granted conditional approval for the project. The Decision
was dated 1/25/12 and conditionally approves the permit by the Hearing Examiner. The
conditions are listed within the staff report.
The request for the Special Use Permit was approved pursuant to the Mason County
Development Regulations specifically for a new accessory dwelling unit.

20 FINDINGS OF FACT
21 Procedural:
22 1. Applicant. The Applicants are Neal and Laurie Cox.
23 2. Hearing. The Hearing Examiner conducted a hearing on the application
24 on January 10, 2012, at 1:00 p.m., in the Mason County Board of Commissioners
Meeting Chambers.

3. Site/Proposal Description. The application is for a SUP for a 1000 square
1 foot ADU. The applicants propose to construct the ADU as a second dwelling unit
2 for an elderly parent. The subject site already contains a residence that is 1,800
square feet in area. The subject lot is 1.25 acres in size and is located southeast of
3 Shelton. The lot accommodates septic system and two-party well. There is a
proposed septic system for the proposed ADU. The ADU will be located 150 feet
4 from the existing residence and garage. The owner will reside on the property.
5 4. Characteristics of the Area. The surrounding area contains single family
6 residences on similar sized parcels.
7 5. Adverse Impacts of Proposed Use. There are no adverse impacts
discernable from the record. As shown in the aerial photograph (Ex. 3), the subject
8 and adjoining lots are heavily treed and fairly large. The addition of a small ADU
should not create any negative aesthetic or compatibility impacts, as confirmed by the
9 fact that no one spoke in opposition to the project. Staff have conducted an on-site
10 inspection and determined that there are no impacts to surrounding properties for
traffic, parking or drainage and there is no evidence to the contrary.

12 CONCLUSIONS OF LAW
13 Procedural:

1. Authority of Hearing Examiner. MCC 15.03.050(10) and 17.05.42
15 provide the Examiner with the authority to review and act upon Special Use Permits.
16 Substantive:

2. Zoning. The area is zoned as Rural Residential 5.
18
19 3. Review Criteria and Application. MCC 17.03.029 governs ADUs in rural
lands. Under MCC 17.03.029, ADUs in rural lands shall be subject to a SUP, unless
20 they are located in the shoreline jurisdiction, in which case they are subject to a
shoreline permit. The proposed ADU is not within 200 feet of the shoreline and,
21 therefore, shall not be reviewed per the Shoreline Master Program policies and use
regulations. The review criteria for the Special Use Permit application are governed
22 by MCC 17.05.044. These criteria, in addition to miscellaneous criteria for all
23 Hearing Examiner decisions, are quoted and addressed below.
24 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA:
25 (1) That the proposed use will not be detrimental to the public health, safety and
welfare.

4. As discussed in the findings of fact, there are no adverse impacts
1 associated with the project. The project also serves to provide affordable housing as
2 encouraged by the Washington State Growth Management Act (Chapter 36.70A
RCW). The criterion is satisfied.

(2) That the proposed use is consistent and compatible with the intent of the
4 Comprehensive Plan.
5 5. The ADU is consistent and compatible with the intent of the
6 Comprehensive Plan. Chapter 9 of the Mason County Comprehensive plan provides
that ADUs should be permitted "when minimal impact would occur to surrounding
7 areas. The cumulative impact of like structures on neighboring properties must be
considered." As noted in the Findings of Fact, the size of the proposed ADU is
8 relatively small, but it will be in an area characterized by relatively large lots
compared to the size of the ADU being proposed. Due to the large lot sizes, no
9 adverse cumulative impacts are anticipated. As further found, the ADU will not
10 create any adverse impacts and hence will have minimal impacts on surrounding
areas. Given these factors,the approval of other ADUs in the area also will not create
11 any cumulative adverse impacts.
12 (3) That the proposed use will not introduce hazardous conditions at the site that
cannot be mitigated through appropriate measures to protect adjacent properties and
13 the community at large.

6. No hazardous conditions are expected, nor have any been identified as a
15 result of the proposed ADU. No adjacent properties, nor the community at large, will
be impacted by the introduction of hazardous conditions from the ADU.

(4) That the proposed use is served by adequate public facilities which are in place,
17 or planned as a condition of approval or as an identified item in the County's Capital
18 Facilities Plan.
19 7. The proposal will be served by a well and on-site septic. According to the
staff report, the addition of an ADU should not lower the level of service of
20 transportation or neighborhood park facilities below applicable minimum standards
21 and there is no evidence to the contrary.
22 (S) That the proposed use will not have a significant impact upon existing uses on
adjacent lands.

8. As noted in the Findings of Fact and previously, no significant impacts are
24 expected to result from this proposal, including impacts on adjoining properties.
25 (6) If located outside an Urban Growth Area, that the proposed use will not result in
the need to extend urban services.

9. The addition of an ADU and its use by a single family should not result in
1 a need to extend urban services. The site is accessed from existing roads and is or
2 will be served by septic and a two-parry well.
3 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW:
4 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review
proposed development according to the following criteria:

6 1. The development does not conflict with the Comprehensive Plan and meets
the requirements and intent of the Mason County Code, especially Title 6, 8, and 16.

2. Development does not impact the public health, safety and welfare and is
8 in the public interest.
9 3. Development does not lower the level of service of transportation andlor
10 neighborhood park facilities below the minimum standards established within the
Comprehensive Plan.

10. According to the staff report, the proposed development complies with the
12 Mason County Code, including Title 6 and 8, including setback requirements. The
project is not subject to Title 16 which only governs subdivisions. As confirmed by
13 staff in the staff report, the proposed ADU with one additional family should not
14 lower the level of service of transportation and/or neighborhood park facilities below
the minimum standards established within the Comprehensive Plan. The project will
15 also have no adverse impact upon health, safety and welfare.
16 The ADU meets the specific requirements for ADUs in rural lands as laid out in MCC
17.03.029 because the owner of the proposed ADU will occupy the primary
17 residence; the size of the ADU is less than 1000 square feet and less than 80% of the
18 area of the primary residence; only one ADU will result from the project; as
conditioned adequate parking is provided for the ADU; the ADU is located within
19 150 feet of the primary residence; according to staff all setback requirements are
satisfied; and the ADU will be served by County approved water and septic. The
20 proposed project does not impact the public health, safety and welfare and it is in the
21 public interest as it permits full beneficial use of real property.
22 DECISION
23 The proposed ADU is approved subject to the conditions recommended in the staff
report.

STAFF REPORT
I. APPLICANT.The applicants are Neal and Laurie Cox.
II. PROPERTY LOCATION.The property is located at 21 SE Shady Lane,Shelton.
in. LEGAL DESCRIPTION.Tract B 1 of S 1/186,NE'/.TR A of SP#310.Sec 27,Twn20N,R3 W.
IV. PARCEL NUMBER.32027-75-90020.
V. EVALUATION.
PROPOSAL: The application is for a Special Use Permit for an accessory dwelling unit.The
applicants are proposing to add a second dwelling to the parcel to be used by their mother.
Characteristics of the site and area: The lot is 1.25 acres in size and is located southeast of Shelton.
There is an existing 1800 square foot residence and garage with a septic system and two-party
well.There is a proposed septic system for the new dwelling.The surrounding area contains single
family residences on similar size parcels.
A. Zoning: The zoning is Rural Residential 5.
B. SEPA Compliance:The project is SEPA exempt under WAC 197-11-800(b)(i).
C. Other Permits:The project needs an approved Building Permit to include a septic system
approval.The Mason County Public Health Department approved the two-party well for this
use in 2009.
VI. ANALYSIS:
The Mason County Development Regulations guide in the review of this proposal.Accessory
Dwelling Unit Requirements are listed in Section 1.03.029 of the regulations. Staff has reviewed
the proposal under the criteria and found it to meet all of them.
The owner will reside on the property.They wish to add a dwelling to be able to have their elderly
parent live nearby.The new structure is to be located approximately 150'from the residence and
garage. There is an approved two-party well and proposed septic system to be used by the ADU.

The ADU is 1000 SF in size. This is the only ADU proposed for the lot.Through a site
inspection,staff has determined that there are no impacts to surrounding properties for traffic,
parking or drainage. The ADU meets all of the property line setbacks.
VII. CONCLUSION.
The Hearing Examiner shall review proposed development according to the following criteria:
(1) The development does not conflict with the Comprehensive Plan and meets the requirements and intent
of the Mason County Code,especially Title 6,8 and 16.
(2) Development does not impact the public health, safety and welfare and is in the public interest.
(3) Development does not lower the level of service of transportation and/or neighborhood park facilities
below the minimum standards established within the Comprehensive Plan.
Staff has verified that the proposed development does in fact comply with the Mason County Code,
including Title 6,8 and 16.The project is not subject to Title 16 which only governs subdivisions.The
project will not lower the level of service of transportation and/or neighborhood park facilities below the
minimum standards established within the Comprehensive Plan.The project will have no adverse impact
upon health,safety and welfare.
Public Notice procedures were followed in accordance with Section 1.05.052 of the Development
Regulations and Section 15.07.010 of Mason County Title 15.No public comments were received.
Based upon the policies and regulations,the project is consistent with the Mason County Development
Regulations Section 1.03.029,Accessory Dwelling Unit Requirements. Staff recommends approval of the
ADU as proposed with the following conditions:
CONDITIONS:
1) The applicants shall provide an additional off-site parking space for the ADU beyond that
required for the primary residence.
2) The septic system shall be approved by the Mason County Public Health Dept..
VIII. CHOICE OF ACTION:
1. Approval of the Special Use Permit#DDR201 1-00111.
2. Approve with conditions.
3. Deny(reapplication or resubmittal is permitted).
4. Remand for further information as authorized by MCC 15.09.090.
