Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Allan Borden Land Use Planner Mason County Planning Department 5/24/2006 1 of 4 SP12005-00232 Site Inspection 5/24/2006 Case No.: SP12005-00232 Comments: Site inspection of Aug. 10, 2005 for Randy Jones: The purpose of this inspection was to determine applicability of planning regulations to residential development. The subject parcel is located along the Tahuya River and an unnamed creek, a type 4 stream in an area of small bends in the creek alignment. A type 4 stream is a perennial water of moderate volume and fish bearing capability. The property slopes slightly downward from the roadway, to native tree and shrub cover along the river and the creek cuts a channel through the center and south portions of the parcel. Mason County Resource Ordinance - Floodplain: This property is within the floodplain of the Tahuya River as shown on the Flood Insurance Rate Map Community Panel No. 530115 0120C (May 1988) as Zone Al with a Base Flood Elevation (BFE) near 62 feet. Residential floors of proposed structures would need to be at least one foot above this BFE and need a BFE certificate noting this elevation at the time of construction. The edge of the floodway of the river is likely upland and within 50 feet of the current bank of the river, especially since high water levels were attained in the 1997 rain season. Streams: A designated Type 1 stream and a Type 4 stream falls under the jurisdiction of the Fish and Wildlife Habitat Conservation Areas Chapter (17.01.110) of the Mason County Resource Ordinance. These provisions establish buffers and building setback requirements for development along streams: A) for a type 1 stream there is a 150-foot vegetation buffer and a 15 foot building setback, for a total of 165 feet from the channel migration zone (CMZ). B) for a type 4 stream there is a 100-foot vegetation buffer and a 15 foot building setback, for a total of 115 feet from the channel migration zone (CMZ). In accordance with the Resource Ordinance, buffers are to be retained in their natural condition. New residential development is not permitted within Fish and Wildlife Habitat Conservation areas or its buffers, except as approved through a variance or reasonable use exception public review process. Staff made two measurements: along the north property line of lot (on the left as you face the river), the 150-foot distance from the bank of river towards the road is in an area of the parcel where the width of the property from the north property line to the 5/24/2006 2 of 4 SP12005-00232 Site Inspection 5/24/2006 Case No.: SP12005-00232 type 4 stream is 55 feet; the 100-foot distance from the bank of river towards the road is in an area of the parcel where the width of the property from the north property line to the type 4 stream is 67 to 79 feet. Within these distances the area is undisturbed native alder, cedar, and maple vegetation buffer along a lower terrace adjacent to the river and creek. A drainfield area would have to be located on an adjacent lot in order to meet proper Health and Planning setbacks. There is no existing structure located on the subject parcel or immediately adjacent parcel.. Based on this field review, few areas exist that would not be unencumbered by the river critical area 150-foot buffer and 15-foot building setback, or type 4 stream 100-foot buffer plus 15-foot building setback. The limitations of a septic system on this property would need to be addressed and/or resolved. Then the review of a variance from the Fish and Wildlife Habitat Conservation Areas chapter would be necessary to pursue residential development on this property. A Habitat Management Plan (HMP), prepared by a qualified biologist, would be required as part of the variance review by the Hearing Examiner to support the proposed development. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or to mitigate impacts of the development proposal. A copy of the Fish and Wildlife Habitat Conservation Areas chapter is enclosed, including details on the contents of an HMP and the variance public review procedure. Application for a variance to these standards does not guarantee approval of the proposed development. Mason County Development Regulations: The site is zoned Rural Residential 5 (one dwelling unit per 5 acres). Development regulations for this zone set forth a front yard and Road right of way setbacks of 25 feet from the edge of easement; the required sideyard setback on the subject parcel is equal to 10 percent of the lot width, or approximately 8 ft. 6 in. An administrative variance may be requested to reduce these setback distances from property lines, to as low as 10 feet (front yard) or 5 feet (side yard), if the size, shape, or features of the property constrain development from the proper setbacks. This process requires application and review at the time of the building permit submittal. General process: Future site development must include a site plan reflecting the setbacks from property lines, setbacks from site improvements, and stream; the site plan will be needed for variance request and building permit application submittal. 5/24/2006 3 of 4 SP12005-00232 Site Inspection 5/24/2006 Case No.: SP12005-00232 No other critical areas such as steep slopes were identified on site that would have an impact on future development.
