Port Orchard, Wa. 98366 To Whom It May Concern; It has come to the attention of Mason County Planning staff that a road has been opened up leading from Mr. Doug Neyhart 's farm into your property in the N. E. of the S. W. of Section 13, Township 22N, Range 3W near the Tahuya River. We would like to comment on some factors relating to this road construction. A side channel to the Tahuya River exists in this area. It carries water on a perennial basis and supports anadromous fish species ( per Washington Department of Fisheries inspections) . This channel has been determined to be an "associated" water body to the Tahuya River ( Department of Ecology inspection) . The Tahuya is a designated "shoreline of the state", and as such, falls under Shoreline Management. Pertinent regulations include: -Construction of a bridge or installation of a culvert requires the obtainment of a Conditional Use Shoreline permit. Dept. of Fisheries approval is also necessary. -Landfills shall not disrupt normal surface water drainage. The Dept. of Fisheries has regulations regarding vehicular crossing of stream channels. It should be noted that there is currently major restoration work being required on Mr. Neyhart's property as a result of illegally filling this channel. We encourage you to contact us if you have any questions or plan any future work in this area. Lastly, a Forest Practice Act must be obtained for any timber harvesting taking place within the state of Washington. This F. P. A. will also be evaluated in terms of that logging 's effect on the Tahuya River and its associated channels. Thank you very much for your concern in this matter. It remains dry in summer months. Alpine Evergreen Co. , Inc. has been thinning their own timber land now for over 20 years. We plan to apply for a crossing (bridge) next summer. This crossing is the only feasible access to our timber in that area - SE NW Sec. 13-22-3W. This stand of large 2nd growth fir lies at the base of a rather steep hill. Port Orchard, Wa. 98366 Dear Mr. Reid: Planning staff had the opportunity to site inspect portions of your road constructed within the SE NW of Section 13, Township 22N, Range 3W adjacent to the Tahuya River last week. We have the following comments : - A Forest Practice Application will be required from the Department of Natural Resources (DNR) for the removal of timber. -DNR will evaluate your proposal and may require that any roads leading in to the timber harvesting area maintain specific distances from the river in the form of a riparian management zone. -Your road has eliminated the vegetation adjacent to the river which previously aided its stabilization. Should the bank of the river begin sloughing off to any great degree in this area, this department will consider your actions tantamount to landfilling. The placement of fill into a shoreline of the state is prohibited without the obtainment of a Conditional Use shoreline permit. To obtain such a permit it would be necessary for you to prove that : 1 ) Extraordinary or unique circumstances relating to the property exist which require the proposed shoreline location. 2) No viable alternative using a different method or, structural solution exists. -Landfills are not permitted in floodplains unless it can be clearly demonstrated that the geohydraulic and floodplain storage capacity will not be altered to increase flood hazard or other damage to life or property. Please contact this office when you decide to perform more work in this area. Keep in mind that bridge crossings may require shoreline permits and that any work within 200 feet of a designated shoreline may require a permit and, if no permit is required, will minimally require a statement of exemption. 4 Thanks for your cooperation. Dear Mr. Reid: Enclosed please find a Statement of Exemption for the placement of an earthen berm along the Tahuya River. I have spoken with Mr. Otto Burden of David Evans and Associates . He seems satisfied that the project will have minimal impact on floodplain dynamics . I would ask that you set the berm back as per the distance he recommends, i .e. , 1. 5 times the distance from the top of bank to bottom of river. This would seem to be at least 10 feet back from the top of the bank. Also, as suggested, I would like to meet with you on the site prior to construction of the berm. Our main concern is that the material be pushed in not from immediately in front of the location of the berm, but rather from some distance away. We want to avoid further weakening of the bank in the immediate vicinity of the river. I will be unavailable until September 23 . I can meet with you any time during that week. Dear Mr. Brush: Thank you for meeting with me on Monday, September 9, 1991. As we discussed, I am writing this letter to address your concerns in a letter dated August 20 to Paul Reid. On Thursday, September 5, 1 visited the site with Paul to observe the area he wanted to do work in. It is my understanding that he would like to place a berm along the bank of the Tahuya River. The berm would measure 8 - 10 feet wide, 80 - 100 feet long and 3 - 4 feet deep. The intent of the berm is to prevent the river from jumping its banks at that one location. If it were to do so, it could cause severe erosion of the cleared area to the south. The berm is not intended to prevent any area from flooding, but only to keep the rive: from doing more damage than necessm},when it does flood. This shouldn't have any significant impact on the floodplain or floodway due to the small berm and large floodplain width. To assure a properly constructed berm and minimal impact to the area, it is my recommendation that: 1. The berm be set back a distance equal to 1.5 times the distance from the top of bank to bottom of river. 2. Prior to construction, an onsite pre-con meeting be held with you, Paul Reid and the individual constructing the berm. Dear Mr. Reid: After consideration of your proposal, I must inform you that the above referenced work would be in violation of the Mason County Flood Damage Prevention Ordinance #59-91. This recently enacted regulatory act states the following regarding floodway development: -Encroachments are prohibited including fill, new construction, substantial improvements, and other development unless certification by a registered professional engineer or architect is provided demonstrating that encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge. If the engineering stipulation is met, Mason County could issue a Statement of Exemption for the berm work. Otherwise, your options include obtaining a Shoreline Substantial Development permit for the placement of rip-rap (large rock) along the bank for stabilization purposes. This permitting process takes about three months to complete and requires approval from the County Commissioners. Please contact this office if I can be of assistance in this matter.
