( ) Section 10 of the Rivers and Harbors Act (Section 404 of the Clean Water Act A Section 10 permit is required for construction work in or over any navigable waters of the United States. A Section 404 permit is required for the placement of dredged or fill material in waters of the United States, including wetlands. The term wetlands means those areas that are inundated or saturated by surface or ground water at a frequency and duration sufficient to support, and that under normal circumstances do support, a prevalence of vegetation typically adapted for life in saturated soil conditions. I thought I had more that was relevant, but most of the file was only pertinent to Neyhart Farm. Mason County is essentially looking to provide guidance and maybe some direction in these two separate but related projects. Mr. Reid' s bank armoring project will likely require a shoreline substantial development permit. That process takes 2 1/2 - 3 months to complete. Mr. Neyhart' s work may possibly consist of only "normal maintenance and repair" , or it too may become involved enough to require a shoreline permit. We are in agreement with you that having one engineer evaluate both projects would be a good idea. Regardless of whether you become involved with both or only Mr. Reid' s, please keep us informed as to what decisions are arrived at. Burden, PE Re : Paul Reid - Alpine Evergreen Tahuya River project The purpose of this project is to prevent the river from further erosion and perhaps a significant change in the main course . Either of these activities would cause damage which would adversely affect the fish runs and value of existing waterfront properties . Attached is a copy of the aerial that was flown with the plan of action described on it. We plan to accomplish this with the following sequence of construction: 1 . Enter the area through the Neyhart farm. 2 . Carefully walk the equipment through the trees along the cleared road approximately 500 feet back from the river. When the contractor and I reviewed where we could get through, it was evident that he could get the equipment across to the other cleared road without having much impact on the existing overflow channel or the existing trees and vegetation. 3 . Carefully place 3 or 4 logs lengthwise in the narrow part of the river near the other cleared road. ( near #1 on the map ) . 4 . Carry the logs and boulders needed on the gravel across the logs . If done properly, no equipment would actually be in the river. 5 . Do task # 4 . 6 . Do task # 3 . 7 . Do task # 2 . S. Go back across the river. Remove the logs used to cross the river and place them along the bank and cable together. 9 . Add the remaining logs along the bank from the location near # 1 . 10. Return through the woods to the first cleared road. Pull the tree stump back into place as mentioned in #6 . Place the riprap in the hole if the logs do not adequately bridge the gap. 11 . Construct the rock berm at the end of the road as mentioned in # 7 . 12 . On the way out, locate the fallen tree as mentioned # 7 . 13 . When the project is complete , plant willows where they could grow to stabilize the bank and prevent erosion. Place large logs along the bank and cable together. 2 . Remove gravel down to a level approximately 1 foot above the existing water level . 3 . Place four 2 man boulders as shown . Place large logs along boulders and cable together. Place the gravel from # 2 above around the 3 boulders and logs shown on the existing gravel bar. In the area of the river, carefully place the boulder in the middle and locate the logs such that they are above the existing water level . 4 . Create an overflow channel with a bottom elevation approximately 1 foot above the existing water level . 5 . Locate the excess gravel along the bank in this location. 6 . Pull the large tree stump back into the hole and up against the bank where it used to stand. It may be necessary to place one load of riprap in the hole created by last winter' s erosion. 7 . Place a rock berm across the cleared road approximately 20 feet back from the edge of the bank. SEE IMPORTANT GENERAL PROVISIONS ON REVERSE SIDE OF APPROVAL. NOTE: The ro]]ect plans as submitted with the application were modified during a meeting on site on September 21 1992, with Paul Reid, Otto Burden (agent) , Art Hougardy (contractor) , Don Brush Mason County) , Marty Ereth (Skokomish Tribe) and Doris Small (WDF) . Specifically the gravel bar scalping was eliminated due to problems with disposal of the material with the exception of a minor amount of grading associated with expansion of an existing overflow channel. The large boulders that were to be placed in the overflow channel were also eliminated. The following activities are approved according to the provisions listed below: a. Large logs may be placed along the bankline. Logs with limbs, tops, and/or rootballs work better than trimmed logs. b. An overflow channel may be expanded and deepened at the site of the existing overflow channel. C. The large maple stump may be pulled back toward the bank. d. The road access to the site ma be protected from erosion byy overflow by a rock berm 20 Teet back from the eroded bank. TFie fallen tree may be located on the road as indicated in the plans. This portion of the project does not require a Hydraulic Project Approval (HPA) . Large logs shall be laid in the river at the access point to allow crossing of the equipment to the gravel bar as indicated in the original plans. 2 . Accumulated gravel may be removed to a depth of one foot above the existing streambed level in the overflow channel area. The overflow channel shall be staked by the Regional Habitat Manager prior to beginning the excavation. The channel shall be approximately 15 feet wide and follow the path indicated in the drawing as No. 4 . The initial 20 feet of the upstream end shall be left undisturbed. No depressions shall be left (to avoid trapping fish) . 3 . The excavated material shall be deposited outside of the floodway (near No. 5 on the drawing) in such a manner that it shall not re-enter the river. 4 . The to s in the river channel for access of equipment shall be removed or repositioned against the bank following completion of the project. 5. Large logs and/or stumps may be placed along the bankline from Location No. 1 (in the plans)) to location #b. These logs/stumps shall be secured in place. buring playement of the logs/stumps, the equipment shall remain out of the flowing river. 6. The large maple tree may be repositioned closer to the bankline. 7 . The eroding bankline may be sloped back to a 1: 1 angle to facilitate planting of willows this winter/sprin . Willow lanting is highly sug ested for additional bank stabili y and may ake place outside of time limits of this approval.
