The purpose of the site inspection was to evaluate development activity that was recently undertaken on the parcel. While on-site, I observed that significant grading activity has left a near vertical cut extending up a portion of the hillside. Associated fill material has been pushed to create a flat area that extends out from the hillside cut. The development activity is subject to the requirements of Mason County Resource Ordinance section 17.01.100. I understand that you were originally working with Michael MacSems (Forest Practices planner) and that Michael had determined the applicable permit requirements associated with a Forest Practice application. In speaking with Michael and with you, I understand that no Forest Practice application will be submitted or reviewed to address the development activity that has occurred. Rather, the activity will be reviewed pursuant to section 17.01.100. I have enclosed a copy of this section for your review. To achieve compliance with section 17.01.100, you will need to submit the following: • SEPA Checklist—Michael indicated that you previously submitted a SEPA Checklist and paid the associated review fee. He advised that the existing SEPA Checklist can be modified to accurately reflect the current site conditions. The fee that was paid can be applied to the revised Checklist, so an additional SEPA fee will not be required. • Mason Environmental Permit—A Mason Environmental Permit application is enclosed for your use. The application must be completed and must accurately reflect the current site conditions, as well as any additional development activity that is proposed within 300' of the steep slope. The application fee for the Mason Environmental Permit is $1,530. • Geotechnical Report—In discussing this issue with Michael, I understand that an acceptable Geotechnical Report has not been received by Mason County. You will need to submit a Geotechnical Report that meets the specific criteria listed in Mason County Resource Ordinance section 17.01.100(E)(5). The individual who prepares the Report must meet the qualifications listed in section 17.01.100(E)(3). A copy of this section is enclosed for your reference. Please provide a copy of the Report requirements to your consultant,to ensure that an acceptable document is prepared. Separately, I encourage you to consult with the Mason Conservation District to develop a quality plan for your farm. Although Mason County regulations do not specifically prohibit clearing in the area upland of the 150' buffer associated with the Tahuya River, it is clear that waters flow in this area during periods of high flow. I encourage you to plan your development activity so that this area remains stable during periods of high flow. You can contact the Conservation District at(360) 427-9436. As we discussed, I understand that you are working with limited funds in addressing this issue. I also understand that geotechnical reports can be fairly expensive. I am willing to accommodate a time schedule that you propose,provided that compliance is achieved by the end of the summer. This matter does need to be resolved prior to the rainy season. By May 14, 2004,please submit a proposed timeline and provide information regarding the individual/company who will prepare the Geotechnical Report.
