Dear Mr. Hicks,
This letter is a follow up to our telephone conversation yesterday regarding your project
in Mason County. I am glad to hear that you have been working diligently to come into
compliance with my letter of October 27a'.
On January 20a'I received a letter from your geo-technical engineer expressing his
frustration with my finding that his first attempt at providing a geo-technical report for
your project was incomplete. Mr. Boughan is correct when he asserts that I am not
qualified to judge to the conclusions of his report. We have an engineer on staff who is
responsible for that. My job is merely to ensure that incoming reports are consistent with
what was originally asked for. In the case of Mr. Boughan's initial report,he focused
entirely on the proposed home site and made no mention of the illegal road cut at the
bottom of the slope or the subsequent landslide.
In your next conversation with Mr. Boughan, please convince him to beef up his report
with a discussion of the road cut at the bottom of the slope, the October landslide, and
any additional timber cutting and road building that you wish to pursue(aside from the
home site which he has already covered). It would also be most helpful if he would
include the photos that he referenced in the text of his report and clarifies my questions
(see December 5t' letter)regarding his site plan. Finally you might mention to Mr.
Boughan that angry and threatening phone calls, such as the one I received on January
16th are no substitute for getting the job done.
I would also like to follow up yesterday's conversation about the encroachment into the
fish and wildlife habitat buffer for the Tahya River. You mentioned that you had a
biologist out to the site that measured the closest point between your bulldozer work and
the river at 250 feet. If that is accurate, then you would not need a Mason Environmental
Permit (MEP) for that work. At this point, the best way to proceed would be for you to
simply provide us with the biologist's report without an MEP application. Rick Mraz and
I will look at the report and probably follow up with a site visit to measure for ourselves.
If it has not been done already, it would be helpful if you could flag the points that your
biologist measured between. If we agree with your biologist than a MEP will not be
required.

Reference is made to your letter of December 5th, 2003 in regard to the
subject land parcel. I have reviewed our Geo-technical Report dated November 17,
2003 and find it Complete and Understandable to a Qualified Geo-technical
Engineer.
I noted NO "Erosion Problem" either from my site inspection or my review
of our file of photos.
A review of our field photos taken from our inspection revealed a bit of
raveling of the soil on the downhill side of the access road. This property
is readily accessable to vehicles with a Four-Wheel-Drive Capability like both
Mr. Hicks' vehicle and my Chevy V-6, Four-Wheel-Drive pick-up. Therefor, the
soil stability is a "so what" condition.
IN MY PROFESSIONAL OPINION THE HOME SITE IS "RUSTIC" BUT STABLE. The
cemented composite soil of sand and gravel as described in the Geo-technical
Report makes the slope at the access road STABLE to the degree necessary for
access to the wooded home site chosen by the owner, Mr. Hicks, for his residence.
Perhaps the residence will require the design and construction of special
foundations; but I am sure that I have designed adequate foundations for similar
sites and will do so here if required by the conditions found in the excavation.
Mr. MacSems: Your qualifications to comment on my Geo-technical Report
are questionable to say the least.
How can Mason County Personnel, who have not a single qualified Geo-technical
Engineer on the pay-roll, try to tell me how to write my Geo-technical Report?

Dear Mr. Hicks,
Please find enclosed the Geo-Technical Report and postal money order that you recently
sent me. I am sorry to have to return these items but they fall short of the material that I
requested in my letter of October 27th(copy enclosed).
My role in reviewing geo-tech documents is limited to determining that the required
content is addressed. Once I am able to make that determination, the document is then
forwarded to the Department of Public Works where an engineer reviews it for quality.
The main reason I have to return this report is because it is only concerned with the house
site and does not address the road cut that was recently done at the base of the slope and
the subsequent landslide that occurred during the October rainstorm. I did ask for this
information in my October 27ffi letter. An additional preliminary comment on the geo-
technical report is that I appreciate that Consolidated Engineering has made the effort to
specifically address the geo-technical report criteria found in section 7.01.100. However
the maps were a little puzzling, as I tried to correlate the information on them with my
memory of the site. If I am reading the maps right, it seems that the test holes were dug at
the base of the slope,which makes it odd that the landslide and road cut was not
mentioned. I also saw a reference to photos, though no photos accompanied the report. I
hope that you can clarify this for me.
As for the$300 check, I can not accept it until the Mason Environmental Permit (MEP)
application that it pays for is also submitted. I have no problem if you want to submit
your MEP and Habitat Management Plan(HMP) at a different time then the geo-tech
report; I just can't accept payment for these documents until they have been submitted.

RE: GEO-TECHNICAL RECONNAISSANCE OF LAND PARCEL DESCRIBED HEREIN.
Dear Martin;
The undersigned Geo-technical Engineer, along with Michael Pursell,
Geo-technician, visited the subject site for a preliminary walk-over soils
reconnaissance on November 13th in your presence. The site was investigated
to determine the stability requirements for the proper siting of a house.
The selected homesite is surrounded by evergreen and deciduous trees,
all of which exhibited vertical trunks; thereby indicating no soil instability
here in the recent past. Douglas Firs of 48 inches in diameter were noted
near the Top-of-Slope and were truly vertical.
The soil near the proposed site of the dwelling was investigated and
found to be a glacial till; primarily a cemented composite of sand and gravel.
This material will provide excellent support for the footings of the proposed
dwelling. Photographs of the site and soils were taken for our file and
record.
A review of the literature for a background in geology and slope
stability revealed no URS (Unstable Recent Slides) shown within 2 miles of
the parcel.
The slope down of the bank to the North-West of the proposed dwelling
was measured with a SMART LEVEL at 35' down.
The site selected for the proposed house is about 50 feet from the Top-
of-Slope (T. 0. S.) . Another steep slope down (the access road embankment)
is located about 80 feet beyorij the T. 0. S.

Due to the steepness of the nearby slope, this parcel requires a
GEO-TECHNICAL REPORT:
(1) The homesite area (9.3 acres; category d.) is covered with timber
which shows no distress from any slope instability.
(2) The height of slope is 50 feet, approximately.
(3) A site plan contains the location of the soil inspection boring
with logs of soil found therein.
(4) The soil type is a sandy-gravel composite covered with a shallow
layer of loam at the surface. This homesite is inherently stable
due to the sandy-gravel.

(5) Ground water was not observed on the upper slope at the homesite.
(6) There is about a 6 inch layer of loam at the surface; otherwise
sand.
(7) The homesite is partially cleared. A foundation planting of low
shrubs is recommended at the completion of construction. Drainage
will be natural but impeded by a seeded lawn. The construction
calls for shallow excavations and is well away from the slope so
it does not need a temporary erosion control plan.
(8) Potential off-site impacts are small or nill due to the minimal
changes to the landscape.
In my professional opinion, the siting as described above should provide
a stable site for the proposed dwelling. 'r

CONTENT OF THIS GEO-TECHNICAL REPORT
1. The basic soil here is a cemented-composite of sand and gravel which is
noted for its stability at grades nearly vertical.
2. See the enclosed print of Tract 9.
3. Exploratory holes are shown on the above print.
4. See the sketch enclosed showing grade changes.
5. The cemented-composite soil is inherently stable; therefor, the slope
stability of the site is excellent.
6. Septic drain fields should be located downhill from the house location
with septic tile lines parallel with the slope.
7. Only the homesite and the driveway need to be cleared. Areas cleared
of vegetation should be re-planted by seeding or equal.
8. A temporary erosion control plan consists of silt fences installed
during the construction of the house.
9. An analysis of the impact of this project to on-site and off-site locations
is NIL!
10. The establishment of a lawn at the home-site is planned.
