The complainant expressed concerns regarding dumping of concrete slabs and other material on the bank of the Tahuya River. I have enclosed copies of photographs that document the work in question. The photographs were provided to me by Department of Fish and Wildlife (WDFW) staff. I personally attempted to conduct a site inspection several days ago. At that time the entrance to the access road was gated. I am writing to request that you contact me at(360) 427-9670 ext. 593 by December 9, 2002 to arrange for a site inspection date. If you reach my voice-mail,please leave me a message with several available dates and times and a return phone number. I will call you to confirm a date and time. I look forward to meeting with you to discuss this matter. From discussions with Danette Guy, WDFW staff, I understand that there is a history to the work in question. You evidently have worked with Doris Small, WDFW staff, and Jeff Davis, WDFW staff, while proposing armoring of the bank through the use of large woody debris. Danette has informed me that she is currently researching the case file and will determine the appropriate course of action with respect to WDFW requirements. Regardless of Danette's determination and subsequent course of action, certain County- level issues must be immediately resolved. Through legal file research, I have determined that the only County-level review that has occurred dates back to 1996. In 1996, SEPA review was completed for armoring of the bank through placement of existing root wads, fallen trees, trunks and limbs along 200' of the bank. However, the associated Shoreline Exemption was never issued. From that date forward, no approval has been issued for the bank armoring that is currently occurring. The current armoring effort was reportedly initiated in late July, 2002. I have discussed this matter with Mason County Shoreline Planner Rick Mraz. The armoring, as it currently exists, cannot be permitted by Mason County because it is non- compliant with the provisions of the Mason County Shoreline Master Program. Rather, you will need to work to develop an acceptable proposal and receive permit approval for the proposal before July 15, 2003. The permitted, acceptable proposal shall be constructed following removal of the non-permitted armoring during the "fish window" for the Tahuya River. The fish window for the upcoming year is projected to extend from July 15, 2003 to August 31, 2003. I am enclosing the following permit applications: • Shoreline Substantial Development Permit(SDP) application or Shoreline Exemption application Please submit the application and application fee by December 31, 2002. A SDP will be required if the valuation of the project exceeds $5 000(including materials and contractor costs for removal and replacement of material). The current application fee is $1,350 ($450 standard fee tripled due to "after the fact"status). Alternatively, a Shoreline Exemption will be required if the valuation of the project is less than $5 000. If you apply for a Shoreline Exemption, you will need to provide a reasonable formal estimate for the cost of the work and materials. Reasonable cost of labor must be factored in even if you to perform the work yourself. The current application fee is $375 ($125 standard fee tripled due to "after the fact" status). Application fees are being updated and will increase substantially as of January 1, 2003. The application shall address both the removal of the existing material and the placement of the proposed material. The application must be accompanied by a Habitat Management Plan(HMP) that meets the requirements of Mason County Resource Ordinance section 17.01.110(J). A copy of this section is clipped to the SDP application form. The HMP must include all of the required information to be accepted. • SEPA Checklist Please submit the application and application fee by December 31, 2002. The current application fee is $600 ($200 standard fee tripled due to "after the fact" status). Application fees are being updated and will increase substantially as of January 1, 2003. The SEPA Checklist shall address both the removal of the existing material and the placement of the proposed material. • JARPA Form Please submit the form by December 31, 2002. No application fee is associated with this form. You will need to mail copies of this form to the applicable agencies listed in the appendix, and provide one copy to Mason County. This form serves at the application for Hydraulic Permit Approval through the Department of Fish and Wildlife. This form shall address both the removal of the existing material and the placement of the proposed material. In addition to the permit applications listed above, you will need to submit a restoration bond based on a reasonable, formal estimate for the costs associated with the removal of the non-permitted armoring. The bond form is enclosed in this mailing. If you plan to remove the material without contractor assistance, the bond amount will still need to be based on a reasonable contractor bid. Details regarding the bond process are enclosed for your review. Please submit the bond by December 31, 2002. All of the items noted above must be submitted by December 31, 2002. If all items are not received by December 31, 2002, a hearing date will be set. If this matter proceeds to a hearing, you may be found responsible for costs incurred by the County in addition to fines assessed. Finally, please note that all permit application fees will increase substantially as of January 1, 2003. 1 understand that you may have questions or concerns regarding this letter.
