Re: Building Permit for Parcel No. 32212-34-00010
Dear Mr. Barry:
Our department is placing a "Stop Work" order on the above referenced project
until either: a)the existing system can be shown to meet current state and
local regulations, or b)a permit application and design are approved for a
replacement System that meets current regulations.
This action is based on the following findings and conclusions:
• On December 28, 1992, Guy Grayson, Environmental Health Specialist
wrote you a letter stating that since your property is located within
a designated shoreline and your developmental proposal will increase
the square footage of your residence, your sewage disposal System
must be in full compliance with WAC 246-272.
• On December 31, 1992, Norman Olson, P.E., wrote Guy a letter disput-
ing the WAC that was cited, stating that the sewage disposal system
had been determined to be satisfactory, stating that no increase in
the number of bedrooms is being proposed, and stating that the demon-
stration of reserve area should be waived because your property is
7.5 acres.
• Based in part on the information provided by Mr. Olson, Guy signed
off the environmental health review portion of the building permit,
and the permit was issued.
• On February 16, 1993, our department received a citizen complaint
that your Septic system is "inadequate" and "too close to the river."'
• On March 1, 1993, Carolyn Jensen, Environmental Health Specialist,
inspected your property, observing and photographing your drainfield. -
She noted that the drainfield was approximately 75 feet from the Ta-
huya River and 50 feet from a marsh.

Current code (WAC 248-96 was recodified as WAC 246-272 in 1990 after the
formation of Washington Department of Health) requires drainfields to be 100
feet from any surface water, and the existing system does not appear to meet
this standard.
Carolyn's observations indicate that the information provided by Mr. Nelson
was inaccurate. Therefore, the building permit issuance was based on false
information. Rather than rescind the permit, however, our department will be
happy to work with you and/or Mr. Nelson to resolve the situation through one
of the options delineated at the beginning of this letter.
