Notice is hereby given that Norman &Trista Walsh,who are the applicants for the above referenced
permit, has been granted approval for a 2-Acre Forest Practices Moratorium Waiver to waive a 6-year
development moratorium,which was incurred as a normal condition of a Class III Forest Practices
Application (#2423733) issued by the WA DNR, on Mason County tax parcel 32315-75-00080.The
waived area is 2 acres.
The applicant intends to develop the lot with a single-family residence and septic system in the future.
A SEPA Determination of Non-Significance (DNS)was issued on 01/02/2025. The formal 14-day
comment period though SEPA ended on 01/16/2025 and included no comments. Mason County
retained the SEPA Determination of Non-Significance (DNS).The SEPA record number for the project is
202500011. Mason County's file number for the projects is SEP2024-00033.
This 2-Acre Forest Practices Moratorium Waiver Approval decision is final and subject to appeal to the
Mason County Hearings Examiner(per Mason County Code Title 15, Chapter 15.11—Appeals)within 14
days from date of decision (the date at the bottom of this notice).Appeal deadlines are short, and
procedures strictly construed.Anyone wishing to file an appeal of this decision should consult with an
attorney to ensure that all procedural requirements are satisfied.
Time Limit for Action. Per Mason County Code 15.09—Review and Approval Process—this
administrative final decision will become effective at the expiration of the 14-day appeal period (ending
on 01/31/2025) if no appeal is submitted. If a written notice of appeal is received during the 14-day
appeal period,this project will be referred to the Hearings Examiner for an open record public hearing
and the decision will not become effective until the Hearings Examiner renders a decision on the appeal.
No permitted activities (ie.construction, harvesting, etc.) may begin until the aforementioned deadlines
have passed.
Notice is given pursuant to RCW 36.706.130 that property owners who are affected by this decision may
request a change in valuation for property tax purposes notwithstanding any program of revaluation.

The WA Department of Natural Resources issued a Class///Forest Practices Activity,
known as FPA/N#2423733, effective on 12/0412023. The resulting six-year
development moratorium (MCC 11.04.010) will expire on 1210412029.
That this Moratorium Waiver is in conformance with Mason County Code 11.04.090:
(a) The director of the department of community development [or their
designee, per MCC 15.01.0201 shall have the authority to approve, approve
with conditions,or deny a request for a waiver of the moratorium, pursuant
to the procedures and requirements of this chapter.

That this Moratorium Waiver is in conformance with Mason County Code 11.04.100:
(a) The request will be made to the department of community development on
the application form provided by that department and accompanied by a
completed county environmental checklist and any established fees.

(b) The application shall be reviewed as a Type II, administrative decision with
notice,as provided for in the Mason County Title 15 Development Code.
Yes, the Type 11 review(with public notice)procedures of MCC 15.09.040 were
followed. The Notice of Development Application was posted on-site on October
22, 2024, in accordance with MCC 15.07.010. The Notice of Administrative Final
Decision will be sent, in accordance with MCC 15.07.040,following the signing of
this Finding of Fact.
(c) Standards for waiving the moratorium:
(1) The development area shall be no larger than two acres in size.
Yes, the development area waived is 2 acres.
(2) The harvest and reforestation of the property shall be completed as
specified in the approved forest practices application/notice.That
portion of property subject to the waiver application shall be
excepted from reforestation.
Yes,following approval of this waiver, the applicant will still have
replanting obligations for the area outside of the 2-acre waiver.
(3) There shall be no damage to a critical area or its associated
vegetation area nor to the shoreline area or that any damage to
those areas is repairable with restoration.

(4) The proposed development shall be consistent with the county
comprehensive plan and development regulations.
Yes, the proposed development is limited to residential use per the
criteria of the waiver process. The land use zoning for the property is
Rural Residential 5, which is consistent with residential development.
The activity proposed for the site affected by this waiver from a six-year
moratorium is compatible with the Mason County Comprehensive Plan
and Development Regulations.

(5) Mitigation shall be required for impacts to critical areas,
stormwater, and shorelines. Other mitigation shall be required to
prevent significant adverse environmental impacts, pursuant to
M.C.C. Chapter 8.04 to 8.40.
No mitigation is required because no damage to critical areas or their
buffers has occurred.
Mason County Resource Ordinance
The issuance of this permit will not result in a violation of the Mason County Resource
Lands and Critical Areas Ordinance. The site was inspected on October 22, 2024, by Luke
Viscusi, of the Mason County Planning Department, who determined that any critical
area buffer issues have been sufficiently documented. Project activities will partially
occur within 300 feet of slopes with greater than 40%slopes, therefore a Geotechnical
Report was submitted for the project(see below).All project activities are outside of
wetland, stream, and landslide hazard area buffers.
Geotechnical Report/Geological Assessment Review
A Geotechnical Report and submittal checklist, dated August 8, 2024, prepared by
Envirotech Engineering, PLLC, was approved by Luke Viscusi, of the Mason County
Planning Department, as being complete on December 31, 2024, under case#GE02024-
00096.A 0-foot vegetation removal buffer and a 50 foot construction setback from the
top of the slope exceeding 40% were recommended by the engineer. All future
development must comply with the recommendations of the Geotechnical Report.
Shoreline Master Program
N A the proposal is not within shoreline jurisdiction.
Flood Ordinance
NIA, approval of this Moratorium Waiver will not violate the provisions of the Flood
Damage Prevention Chapter of Mason County Code Title 14.
State Environmental Policy Act
This application for MOR2024-00006 has been reviewed for SEPA compliance under case
#:SEP2024-00033. The SEPA record number is 202500011.

Stormwater Management
An engineered storm water plan for Mason County Public Works is N/A. The project
requires Minimum Requirement#2 of the 2019 Stormwater Management Manual for
Western Washington due to land-disturbing activities less than 7,000 sqft. Narratives for
Minimum Requirement#2 were submitted and meet the standards of the Manual.
CONCLUSION
In conclusion,this application for a 2-Acre Forest Practices Moratorium Waiver, associated with
FPA/N#2423733, is consistent with the above criteria and Mason County has fulfilled its
statutory obligations. Per MCC 11.04.110,the following permits may be issued and conditioned
as necessary to be consistent with Mason County Code prior to 12/04/2029 under this waiver:
(1) Building permits for the single-family residence and for residential
outbuildings;
(2) Single-family on-site septic system permit;
(3) Road access permits;
(4) Earth modification permits;
(5) Shoreline master program approvals;
(6) Well or potable water permits;
(7) Other approvals necessary the development of a single-family
residence and outbuildings.

FPA Stormwater Minimum Requirements
Guide to Preparing Required County Submittals (last update: 09/2018)
Figure 1-2.4.1 of the 2014 Stormwater Management Manual for Western Washington identifies
thresholds that determine which Minimum Requirements will apply to various projects. Most Forest
Practice Applications will have "land-disturbing"activities of 7,000 square feet or more, meaning that
Minimum Requirements#1 through#5 of the Manual will generally apply. These minimum
requirements are briefly described in pages 1 -4. A professional engineer is typically not required in
these cases.
Some FPAs may trigger the need to comply with all Minimum Requirements (#1-#10). These typically
are projects where new road construction is necessary for harvest, particularly if there is also the need
for a MEP and/or geotechnical report or study. A professional engineer is needed in these cases.
Finally, some FPAs may be considered to have such a low potential for sediment or sediment-laden
water leaving the site,that Minimum Requirement 42 (SWPPP) can be met by conditioning the FPA with
the following conditions:
1. The boundaries of the clearing limits shown on this plan shall be clearly flagged in the field prior
to construction. During the construction period, no disturbance beyond the flagged clearing
limits shall be permitted. The flagging shall be maintained by the applicant/contractor for the
duration of construction.
2. Stabilized construction entrances shall be installed at the beginning of construction and
maintained for the duration of the project.Additional measures may be required to insure that
all paved areas are kept clean for the duration of the project.
3. The ESC facilities shown on this plan are the minimum requirements for anticipated site
conditions.During the construction period, these ESC facilities shall be upgraded as needed for
unexpected storm events and to ensure that sediment and sediment-laden water do not leave
the site.
PLEASE NOTE.In addition to County Code, applicants may need to obtain a Construction Stormwater
General Permit(CSWGP)issued through the Department of Ecology.

Minimum Requirement#1: Prepare a Stormwater site plan
This minimum requirement will always apply, although in a much-abbreviated form of the full
requirements for an engineered stormwater site plan. The site plan used for the SEPA and/or FPA
application can be used as the stormwater site plan, if it includes the following information:
1. Note the construction access location and type of stabilization to be used to prevent tracking
sediment off-site.
2. Identify the clearing limits, sensitive areas and their buffers, and any trees required for
preservation.
3. Note the location of any proposed sediment controls to be used to contain sediments on-site.
4. Note the location of any soil and/or slope stabilization that will occur.
S. Note the location of all natural and constructed drainage features on site and in the near
vicinity. Natural features may be wetlands,streams,draws, ravines, springs, etc. and
constructed features could include culverts, ditches,catch basins, ponds, dikes, berms, or
others.
The site plan should also provide a brief narrative of the project including:
1. Project location and any associated permit numbers
2. Total site acreage and the acreage to be disturbed (logged) a
3. Description of any new road construction(length,width, materials), or if existing roads re to be
used, note this
4. Genera I description of soils, topography and drainage including where surface water enters and
leaves the property
5. Anticipated start and end date
6. Description of logging method and expected use after logging /�/t=
This narrative can be the same as that included in the beginning of the SWPPP template found on pages
3 through 7. Applicants may use information also included in SEPA, MEP, and/or FPA applications.
Minimum Requirement#2: Prepare a Construction Stormwater Pollution Prevention Plan (SWPPP)
This minimum requirement will also always apply and includes 12 elements. Depending on the project
size, location, timing, and other considerations, some projects will need to address all 12 elements
while others may only address a few. If an applicant feels that an element is not applicable, the
rationale should be clearly described. See pages 3 through 7 for a FPA Construction SWPPP template
applicants may choose to use.

Some projects are small in nature, do not require a Construction Stormwater General Permit, have very
limited ground disturbance, are generally flat, have little or no constructed stormwater conveyances or
facilities, have no critical areas, and have soils with low erosivity potential. In these cases a SWPPP is not
required but the FPA permit will be conditioned with the following:
1. The boundaries of the clearing limits shown on this plan shall be clearly flagged in the field prior
to construction. During the construction period, no disturbance beyond the flagged clearing
limits shall be permitted.The flagging shall be maintained by the applicant/contractor for the
duration of construction.
2. Stabilized construction entrances shall be installed at the beginning of construction and
maintained for the duration of the project.Additional measures may be required to insure that
all paved areas are kept clean for the duration of the project.
3. The ESC facilities shown on this plan are the minimum requirements for anticipated site
conditions. During the construction period, these ESC facilities shall be upgraded as needed for
unexpected storm events and to ensure that sediment and sediment-laden water do not leave
the site.
Minimum Requirement#3: Pollution Source Control
This minimum requirement will likely be N/A(not applicable) because most of the BMPs will already be
addressed in Minimurn Requirement 42,the construction SWPPP. The applicant may want to call out
those elements of the SWPPP that provide pollution source control;for example: "See Element 9 of the
SWPPP,,,
Minimum Requirement 44: Preserve Natural Drainage Systems and Outfalls
The applicant should have provided a brief narrative of the natural drainage patterns and constructed
drainage features on the property(Minimum Requirement#1), These locations should also be clearly
identified on the site plan (also Minimum Requirement#1) with the note that they are to he protected
to the maximum extent feasible.
The applicant can repeat and/or reference the applicable sections from Minimurn Requirement#1. If
drainage systems or features need to be altered,the applicant should note the possible downstream
impacts and how they will be mitigated.

To the maximum extent feasible, projects shall infiltrate, disperse, and retain stormwater runoff onsite
to prevent flooding and erosion impacts. Most FPAs will manage stormwater onsite through dispersion
and infiltration, and can simply note that under this minimum requirement. Sites that include steep
topography, and/or erosive soils, low permeability, sensitive downstream areas may require additional
onsite management features and the applicant should describe how this will be accomplished. Sites
that require a geotechnical report or study,or MEP are potential candidates for additional on-site
stormwater management beyond dispersion and infiltration.

construction will be clearly marked before land-disturbing activities begin. Trees that are to be
preserved, as well as all sensitive areas and their buffers, shall be clearly delineated, both in the field
and on the plans. In general, natural vegetation and native topsoil shall be retained in an undisturbed
state to the maximum extent possible. Applicant should describe how clearing limits will be marked
prior to logging and note on the site plan.
Element 2: Establish Construction Access
Construction access shall be established and access points shall be stabilized to minimize the tracking of
sediment onto public roads. If sediment is tracked off site, public roads shall be cleaned by shoveling or
sweeping at the end of the day to prevent sediment from entering surface waters. Applicant should
describe where the construction access will be, obtain a Road Access Permit if it is a new location, and
construct access to minimize sediment tracking. # \
Element 3: Control Flow Rates
Downstream properties and waterways shall be protected from erosion due to increases in stormwater
runoff volume,velocity and peak flow rate. The applicant needs to clearly identify where runoff will
leave the site so potential downstream impacts can be evaluated. This element will be "not
applicable" (N/A)for most FPAs because the increase in runoff and/or erosion due to logging will be
negligible. If no BMPs are proposed,the applicant needs to describe rationale: e.g.,flat topography,
highly permeable soils, large vegetated buffers at site perimeter, logging method, others.

Element 4: Install Sediment Controls
Stormwater runoff from disturbed areas shall pass through a sediment removal Best Management
Practice (BMP) before leaving the site or prior to being discharged to an infiltration facility. In most
cases, an FPA will not require the construction of an infiltration facility. Whenever possible, sediment
laden water shall be discharged into onsite, relatively level,vegetated areas.
If no BMPs are proposed, the applicant needs to describe rationale.
More complex sediment control/treatment BMPs, such as infiltration facilities, should be used if
sediment controls are not(or not anticipated to be) adequate for the site-specific construction activities.
These BMPs are primarily used on:
• Larger sites(i.e. greater than 5 acres), or,
■ Sites that have continual soil disturbance and are difficult to temporarily stabilize, or,
• Sites at higher risk of erosion (i.e.slopes), or,
■ Sites where the downstream environment is particularly sensitive and more stringent
discharge controls are required. rya,
Element 5: Stabilize Soils
Exposed and unworked soils shall be stabilized with the application of effective BMPs to prevent erosion
throughout the life of the project. In general, cut and fill slopes will be stabilized as soon as possible and
soil stockpiles will be temporarily covered with plastic sheeting. All stockpiled soils shall be stabilized
from erosion, protected with sediment trapping measures, and where possible, be located away from
storm drain inlets,waterways, and drainage channels.

Element 5: Protect Slopes
All cut and fill slopes will be designed,constructed, and protected in a manner that minimizes erosion.

Element 7: Protect Drain Inlets
All storm drain inlets and culverts made operable during construction shall be protected to prevent

priority is to keep all access roads clean of sediment and keep street wash water separate from entering

All onsite pollutant sources shall be handled and disposed of in a manner that does not cause
contamination of stormwater. Good housekeeping and preventative measures will be taken to ensure
that the site will be kept clean,well organized,and free of debris.
Applicant should describe all potential pollution sources and how they will be managed.

Element 10: Control De-Watering

Element 11: Maintain BMPs
All temporary and permanent erosion and sediment control BMPs shall be maintained and repaired as
needed to assure continued performance of their intended function. Maintenance and repair shall be
conducted in accordance with each particular BMPs specifications. Visual monitoring of the BMPs will
be conducted at least once every calendar week and within 24 hours of any stormwater or non-
stormwater discharge from the site. If the site becomes inactive, and is temporarily stabilized, the
inspection frequency will be reduced to once every month.
All temporary erosion and sediment control BMPs shall be removed within 30 days after the final site
stabilization is achieved or after the temporary BMPs are no longer needed.
