P P Y ( ) PROPOSAL:The applicant is proposing to expand an existing gravel mine to a 183-acre permit boundary.Hama Hama River,a Type 1 stream,and associated wetlands are located to the north.Hood Canal is to the east.Any proposed mining within 200 feet of the Hood Canal Shoreline and/or Hama Hama River and associated wetlands would fall under Shoreline Master Program jurisdiction. ZONING:This parcel is designated as Long Term Commercial Forest land(LTCF)with a Mineral Resource Land(MRL)overlay.The expanded gravel mining operation may be permitted as an unspecified conditional use in LTCF and conditional use in MRL through a Mason Conditional Environmental Permit(MCEP).This requires public notice and a public hearing with a decision made by a Hearing Examiner.An application was provided.If the MCEP is approved and the mining operation continues as an ongoing operation,the MCEP will be valid for the life of the operation(this time frame shall be spelled out in the original proposal and will be made a condition of the MCEP).If mining operations cease for a period of more than two years or extends beyond the time limit of the original proposal,then a new MCEP will be required. FOREST PRACTICES:If cutting or removing trees to convert forest land to a non-forestry use and the practice is not a Class 1 activity you will need a Class IV General Forest Practices Application.A Class IV General application requires a SEPA determination and a Mason Conditional Environmental Permit(in Mineral Resource Lands).A Forest Practice Application and Environmental Checklist was provided. SHORELINES/STREAMS:Although there is a Type 1 (Hama Hama River)and Hood Canal shoreline near the proposed mining operation,it does appear that the proposed development is outside of the established buffers.The setbacks will need to be shown on a site plan.If work is proposed within 200 feet of Hood Canal or Hama Hama River then shoreline permits will be required(i.e.Substantial Development/Conditional Use Permit)and would need to meet the Shoreline Master Program Policies and Use Regulations for commercial development,forest management practices,mining,and landfill. WETLANDS:There is a wetland associated with the Hama Hama River to the north.A Wetland Delineation and Categorization has already been completed.There is a 250-foot buffer from the wetland.It appears that the proposed mining will take place outside of the wetland buffer.It does appear there will be some reclamation that will take place within the buffer from the previous mining activity.This work/mitigation will be reviewed under the MCEP. SLOPES:There are existing slopes within 300 feet of the proposed mining operation that are greater than 40 percent and therefore will require a geotechnical report.The requirements for a geotechnical report are outlined in the Mason County Resource Ordinance 17.01.100 Landslide Hazard Areas. SEPA:This proposal will require SEPA review.A Mason Environmental Checklist was given to the applicant's representative. EAGLE MANAGEMENT PLAN:The parcel is tagged as Eagle Territory.An eagle management plan may be required through WDFW(Greg Schirato).A plan was written by Greg Schirato,WDFW,in 1997 and signed by David Robbins in 1999.WDFW should review the new proposal and determine if the current plan is acceptable. A seconded question,assuming that a Class IV G is required,is how to fit a two-year FPA permit with a 50-year mining operation,which will only require the logging of a few acres at a time? The answer to the first question can be found in WAC 222-16-010(which was modified in 2008),in which the definition of conversion activities(those needing a Class IV G)reads as follows: "Conversion activities"means activities associated with conversions of forest land to land uses other than commercial timber operation.These activities may be occurring during or after timber harvest on forest land.They may include but are not limited to the following: o Preparation for,or installation of,utilities on the forest practices activity site.The development or maintenance of existing rights of way providing utilities exclusively for other ownerships shall not be considered conversions of forest land(see WAC 222-20-010(5)). o Any of,or any combination of,the following activities in preparation for nonforestry use of the land:Grading,filling,or stump removal. o Preparation for,or construction of,any structure requiring local government approval. o Construction of,or improvement of,roads to a standard greater than needed to conduct forest practices activities. o Clearing for,or expansion of,rock pits for nonforest practices uses or developing surface mines. The answer to the second question was provided by Planning Manager Bob Fink.He said that only one MEP would be required,but clarified that a series of Class IV G FPAs would be required over the lifetime of the mine.
