The Mason County Building Department received your request for
an appeal of the abatement in process of the above described
property.
This letter is to inform you that the appeal process will be
placed on hold pending legal action filed in Superior Court under
cause number 96-2003275, filed on May 15, 1996 which is a claim for
adverse possession. The filing of this action will also place a
hold on the abatement of the structure until the case is settled.

RE: Bullock/Greenfield: Order to abate dangerous building.
Mr. Byrne.,
I am including copies of my attempt to coordinate the abatement of the dangerous structure as
per your order on May 4, 1996 with the Greenfield's, the owners of the dangerous structure.
The Greenfield's have continued their lack of interest in cooperative efforts in resolving this
matter. Because of this, I do not foresee any action on the part of the Greenfield's to comply
with this order by June 15.
1 have received legal advice which indicates that if I proceed without their cooperation that I may
be liable for the damage of any personal property belonging to the Greenfield's due to the fact
that I do not own the building. Therefore, I wish to express my intent to cooperate with your
department in every way possible if the county finds it necessary to perform abatement
procedures due to the Greenfield's failure to act. Let there be no question that I intend to meet
my obligations outlined in the abatement order, if the Greenfield's refuse act on their
responsibilities, we have no choice but to wait and coordinate our efforts any actions taken by
Mason County.
Furthermore, if your personnel need to gain access to the dangerous structure to perform
inspections or assess the citation at hand, they may do so by entering across my property. E

If the deadline of June 15, 1996 is not met by compliance with the order of abatement, I would
request that the County take immediate action. This order has been a concern since October
of 1995 due to stalling tactics used by the Greenfield's attorney Robert Johnson (he falsely
implied that a boundary line dispute was currently undergoing formal litigation procedures).
They should not be afforded any leniency if they fail to comply with the order. Let it also be
known that as of this date, no lawsuit has been filed involving an adverse possession claim
on the part of the Greenfield's with the Mason County Court.

Dear Mr. Johnson,
I have recently received an order of abatement from the Mason County Building
Department concerning the removal of the shed which lies across the property line.
would like to request a meeting with yourself and your clients, the Greenfields, to
coordinate abatement efforts; as both parties are responsible for demolition and cleanup
of their respective halves of the building, which lie on each side of the legal surveyed
boundary. We would be willing to obtain the needed permits for this procedure in the
interest of demonstrating our desire to make this a cooperative effort.

RE: Abatement of Dangerous Structure
Dear Mr. Bullock,
On October 4, 1995, this office issued a Notice and Order for
Abatement on the structure which straddles the property line
between yourself and The Greenfields . Upon receipt of the notice
and order, The Greenfield' s attorney, Rob Johnson, indicated that
his clients would be pursuing an adverse possession claim to the
structure and the property upon which it sits and requested that
the abatement be placed on "hold" until the ownership issues were
resolved. Upon speaking with Mr. Johnson last week and contacting
Mason County Superior Court yesterday, no action has been taken on
The Greenfield' s behalf to pursue actual ownership as they
initially indicated they would be doing.
Mason County has issued a subsequent Notice and Order and will
now commence abatement action pursuant to Mason County Ordinance
No. 37-96, Uniform Building Code and the Uniform Code for the
Abatement of Dangerous Buildings .

MISDEMEANOR/PENALTY
You shall correct all violations by JUNE 15, 1996. Any person, firm or
incorporation violating any provision of this Code shall be deemed guilty of a
misdemeanor and upon conviction thereof, shall be punishable by a fine of not
to exceed $300.00 or by imprisonment in the Mason County Jail for not to
exceed 3 months, or both fine and imprisonment. Each separate day or any
portion thereof during which any violation of this Code occurs or continues,
shall be deeded to constitute a separate offense, and upon conviction shall be
punishable as herein provided. Anyone who fails to comply with any final order
of the Building Official may be guilty of a misdeamenor and applicable penalties
will be assessed.
ABATEMENT WORK/NOTICE OF LIEN
In the event compliance has not been accomplished by JUNE 15 1996, the
Building Official may abate the above violations by causing the correction work
to be done. The cost of the abatement work is charged as a PERSONAL
OBLIGATION OF THE REAL PROPERTY OWNER, THE PERSONAL PROPERTY
OWNER and/or as a LIEN AGAINST THE PROPERTY.

APPEAL
Any person having any record, title or legal interest in the above-described
location may appeal the Notice and Order of any action of the Building Official
to the Board of Appeals, provided the appeal is made in writing, as provided in
this code and filed with the building official within 15 days from the date of
service of such notice and order; FAILURE TO APPEAL WILL CONSTITUTE A
WAIVER OF ALL RIGHTS TO AN ADMINISTRATIVE HEARING AND
DETERMINATION OF THE MATTER. The appropriate form for appeal may be
secured from the Department of General Services, Building Division.
YOU HAVE THE DUTY TO NOTIFY THE BUILDING DEPARTMENT OF ANY

Dear Mr. Johnson,
On August 15, 1995, our office sent notification to both Mr. and Mrs.
Greenfield and Mr. Bullock regarding the posting of the wood frame structure
which straddles the property line between the parties with a Dangerous Building
Notice. This notice was posted pursuant to the 1991 Uniform Code for the
Abatement of Dangerous Buildings citing Section 302 in response to a
complaint received on July 25, 1995.
For your referral, I have included a photo copy of Section 302 of the
Uniform Code for the Abatement of Dangerous Buildings. In addition to the
subsections 5, 7, 8 and 13, there may also be others to which the building may
meet the Dangerous Building classification which were not cited.
As the letter of notification indicated in August, our office was informed
by Mr. Bullock that the property issue was in litigation but that a survey clearly
showed the encroachment of the structure onto his property and within the
Mason County required 5' setback. At that time, both parties were informed
that the building would remain posted but the abatement order would be on
pending status until the property issue was resolved. Both Mr. and Mrs.
Greenfield contacted this office by separate phone calls on August 14, 1995
in response to the notification letter and were told why the building was posted
and what the letter meant as they did not seem to fully understand.
On September 25, 1995, a letter of request to proceed with the
abatement order was received by our office from Mr. Bullock along with
another copy of the recorded survey, a photo copy of the letter is enclosed. In
response to that request and Mr. Bullocks indication that the dangerous building
was the only issue left to be resolved, Mason County formally sent a Notice and
Order for Abatement to both parties.

The information you requested regarding code and sections applying to
the abatement notice is briefly explained below and entire code references are
included with this letter:
14.04.010-F Mason County Ordinance No. 138-92 pertains to the
adoption of the 1991 Uniform Code for the Abatement of Dangerous
Buildings.
14.08.030-12 Mason County Ordinance No. 138-92 refers to
Maintenance and permitting exemptions. The emphasis being on the first
sentence within that section. "All buildings and structures, both existing
and new, and all parts thereof, shall be maintained in a safe and sanitary
condition.
14.08. 1 80 Mason County Ordinance No. 138-92; Building Setbacks. "All
structures shall be set back five (5) feet or more from any right of way,
easement or property line from the closest projection.
Uniform Building Code, Section 203: All buildings or structures regulated
by this code which are structurally unsafe or not provided with adequate
egress, or which constitute a fire hazard, or are otherwise dangerous to
human life are, for the purpose of this section, unsafe.
Uniform Building Code, Section 205: It shall be unlawful for any person,
firm or corporation to erect, construct, enlarge, alter, repair, move,
improve, remove, convert or demolish, equip, use, occupy or maintain any
building or structure or cause or permit the same to be done in violation
of this code. Within this section we are referring to the lack of
maintenance of the structure.
Section 302 of the Uniform Code for the Abatement of Dangerous
outlines the eighteen classification categories and is enclosed.

As per your request, an application for appeal is also included as well as
the outline for the appeal process per the Uniform Code for the Abatement of
Dangerous Buildings.
Mr. Bullock has been informed that the abatement order has reverted
back to a pending status due to misinformation provided that led Mason County
to believe that the property line and structure ownership issues were resolved.
The initial letter of August 15, 1995 indicated that demolition or repair
to correct the violations would be required. The Notice and Order only referred
to demolition. Repair would be an option but must be permitted and permitting
requirements would necessitate that the structure meet current code, including
setbacks or that a variance be secured by the adjacent property owner.

On August 15, 1995 1 sent notification to both parties that the building
had been declared dangerous and that the ownership of the property was in
question and this department would not take any further action until the
property ownership issues were resolved.
On September 25, 1995, this office received a copy of a recorded survey
which indicates that the structure straddles the property line between both of
your parcels and therefore, both parcel owners are responsible for the
demolition of the portion of the structure located within their property
boundaries.

To All Parties Listed above:
In response to a complaint received by this office, a site investigation was
performed on August 9, 1995 and the agricultural structure was posted as a
Dangerous Structure. It has been brought to our attention that ownership of
the property is presently in legal litigation between the named parties above and
based upon a survey provided to this office, it appears that the structure
straddles the indicated property line.
The posting of the structure will remain in effect until the property line
issue is resolved. Once the resolution has been reached regarding ownership,
Mason County will require that the owner bring the structure into compliance
by either demolishing it and disposing of the debris per Mason County
regulation or apply for a permit and make the necessary repairs to alleviate the
items listed for the Dangerous Structure classification.
Pursuant to the Uniform Code for the Abatement of Dangerous Buildings,
the structure meets the following criteria for classification purposes:
Section 302 (5), (7), (8) and (13).
Enclosed is a copy of Chapter 3 of the Uniform Code for the Abatement
of Dangerous Buildings.
