Demolish the dangerous structure on this site prior to NOVEMBER 15,

FAILURE TO COMPLY WITH THIS ORDER WILL SUBJECT YOU TO PENALTY,
ABATEMENT, AND MISDEMEANOR ACTIONS
MISDEMEANOR/PENALTY
You shall correct all violations by NOVEMBER 15, 1995. Any person, firm or
incorporation violating any provision of this Code shall be deemed guilty of a
misdemeanor and upon conviction thereof, shall be punishable by a fine of not
to exceed $300.00 or by imprisonment in the Mason County Jail for not to
exceed 3 months, or both fine and imprisonment. Each separate day or any
portion thereof during which any violation of this Code occurs or continues,
shall be deeded to constitute a separate offense, and upon conviction shall be
punishable as herein provided. Anyone who fails to comply with any final order
of the Building Official may be guilty of a misdeamenor and applicable penalties
will be assessed.
ABATEMENT WORK/NOTICE OF LIEN
In the event compliance has not been accomplished by NOVEMBER 15 1995,
the Building Official may abate the above violations by causing the correction
work to be done. The cost of the abatement work is charged as a PERSONAL
OBLIGATION OF THE REAL PROPERTY OWNER, THE PERSONAL PROPERTY
OWNER and/or as a LIEN AGAINST THE PROPERTY.

APPEAL
Any person having any record, title or legal interest in the above-described
location may appeal the Notice and Order of any action of the Building Official
to the Board of Appeals, provided the appeal is made in writing, as provided in
this code and filed with the building official within 15 days from the date of
service of such notice and order; FAILURE TO APPEAL WILL CONSTITUTE A
WAIVER OF ALL RIGHTS TO AN ADMINISTRATIVE HEARING AND
DETERMINATION OF THE MATTER. The appropriate form for appeal may be
secured from the Department of General Services, Building Division.
YOU HAVE THE DUTY TO NOTIFY THE BUILDING DEPARTMENT OF ANY
ACTIONS TO CORRECT THE ABOVE VIOLATIONS YOU HAVE TAKEN SINCE
THE RECEIPT OF THIS NOTICE AND ORDER.

an appeal of the abatement in process of the above described

This letter is to inform you that the appeal process will be
placed on hold pending legal action filed in Superior Court under
cause number 96-2003275, filed on May 15, 1996 which is a claim for
adverse possession. The filing of this action will also place a

RE : Abatement of Dangerous Structure
Dear Mr. and Mrs . Greenfield,
On October 4, 1995, a Notice and Order for Abatement was
ordered on the structure which straddles the property lines between
parcel numbers 32136-21-90190, which is owned by you and 32136-24-
03000, owned by William Bullock. The abatement was placed on
"hold" based on information provided by you which indicated that
you would be pursuing an adverse possession claim that included the
structure, in Mason County Superior Court .
After speaking with Rob Johnson of Hueston, Settle and
Johnson last week and verifying with Mason County Superior Court
yesterday, it appears as though no action has been taken on your
behalf to pursue complete ownership as you initially indicated you
were doing and which was the sole reason for placing the abatement
action on hold.
At this time, Mason County will commence the abatement action
pursuant to the Uniform Building Code, Mason County Ordinance No.
37-96 and the Uniform Code for the Abatement of Dangerous
Buildings .

RE: 2nd request to proceed with abatement procedures with dangerous building.
Mr. Byrne,
I have enclosed correspondence between myself and Mr. Robert Johnson whom
represents the Greenfields. The purpose of submitting copies of this correspondence to
you is to establish the lack of good faith on the part of the Greenfields to settle this issue.
It has now been nearly three months since the abatement procedures were halted.
It is my understanding that Mr. Johnson sent your office a letter stating that this dispute
was currently under litigation. I would challenge that statement. The only actions which
have been taken regarding the disputed property line are unsuccessful negotiations
between two attorneys. Nothing has been filed with the court system dealing with a claim
of adverse possession. The Greenfields have not occupied the property for the statutory
time period of ten years and are in my opinion doing everything they can to stall for
another two years. Again, at this time there is NO PENDING LITIGATION concerning the
location of the property line.
Please note the surveys provided to you on our last correspondence establishing the
property boundaries. Both of these documents show the established rear boundary line
running through the dangerous building (barn/shed).
The purpose of this letter is to formally request the County to begin the abatement
process again and the establishment of a time line outlining when items of concern are to
be resolved. I would like to again express my interest in assisting the County with the
abatement procedure if the Greenfields continue to ignore the issue at hand. The
Bullock's main concern is rectifying the problem with the dangerous building.

On August 15, 1995, our office sent notification to both Mr. and Mrs.
Greenfield and Mr. Bullock regarding the posting of the wood frame structure

which straddles the property line between the parties with a Dangerous Building
Notice. This notice was posted pursuant to the 1991 Uniform Code for the
Abatement of Dangerous Buildings citing Section 302 in response to a
complaint received on July 25, 1995.
For your referral, I have included a photo copy of Section 302 of the
Uniform Code for the Abatement of Dangerous Buildings. In addition to the

subsections 5, 7, 8 and 13, there may also be others to which the building may
meet the Dangerous Building classification which were not cited.
As the letter of notification indicated in August, our office was informed
by Mr. Bullock that the property issue was in litigation but that a survey clearly
showed the encroachment of the structure onto his property and within the
Mason County required 5' setback. At that time, both parties were informed
that the building would remain posted but the abatement order would be on
pending status until the property issue was resolved. Both Mr. and Mrs.
Greenfield contacted this office by separate phone calls on August 14, 1995
in response to the notification letter and were told why the building was posted
and what the letter meant as they did not seem to fully understand.
On September 25, 1995, a letter of request to proceed with the
abatement order was received by our office from Mr. Bullock along with
another copy of the recorded survey, a photo copy of the letter is enclosed. In
response to that request and Mr. Bullocks indication that the dangerous building
was the only issue left to be resolved, Mason County formally sent a Notice and
Order for Abatement to both parties.

The information you requested regarding code and sections applying to
the abatement notice is briefly explained below and entire code references are
included with this letter:
14.04.010-F Mason County Ordinance No. 138-92 pertains to the
adoption of the 1991 Uniform Code for the Abatement of Dangerous
Buildings.
14.08.030-12 Mason County Ordinance No. 138-92 refers to
Maintenance and permitting exemptions. The emphasis being on the first
sentence within that section. "All buildings and structures, both existing
and new, and all parts thereof, shall be maintained in a safe and sanitary
condition.
14.08.180 Mason County Ordinance No. 138-92; Building Setbacks. "All
structures shall be set back five (5) feet or more from any right of way,
easement or property line from the closest projection.
Uniform Building Code, Section 203: All buildings or structures regulated
by this code which are structurally unsafe or not provided with adequate
egress, or which constitute a fire hazard, or are otherwise dangerous to
human life are, for the purpose of this section, unsafe.
Uniform Building Code, Section 205: It shall be unlawful for any person,
firm or corporation to erect, construct, enlarge, alter, repair, move,
improve, remove, convert or demolish, equip, use, occupy or maintain any
building or structure or cause or permit the same to be done in violation
of this code. Within this section we are referring to the lack of
maintenance of the structure.
Section 302 of the Uniform Code for the Abatement of Dangerous
outlines the eighteen classification categories and is enclosed.

As per your request, an application for appeal is also included as well as
the outline for the appeal process per the Uniform Code for the Abatement of
Dangerous Buildings.
Mr. Bullock has been informed that the abatement order has reverted
back to a pending status due to misinformation provided that led Mason County
to believe that the property line and structure ownership issues were resolved.
The initial letter of August 15, 1995 indicated that demolition or repair
to correct the violations would be required. The Notice and Order only referred
to demolition. Repair would be an option but must be permitted and permitting
requirements would necessitate that the structure meet current code, including
setbacks or that a variance be secured by the adjacent property owner.

We represent Jeffrey and Diane Greenfield. It is our
understanding that the Mason County Building Department inspected
a structure located on the Greenfield property pursuant to a
request by a employee of Mason County, William Bullock. Mr. and
Mrs. Greenfield have a boundary dispute with Mr. Bullock involving
the property on which the structure is located. It is our opinion
that the Greenfields ' are the equitable owners of this property and
Mr. Bullock has no valid claim therein.
On 10/6/95, the Greenfields were served with the above
referenced notice of abatement. Despite assurances by your
department that no action would be taken until the property dispute
has been resolved, Mason County has now ordered the demolition of
the structure. The boundary issue is not resolved. Mr. Bullock
has no legal ability to trespass on the Greenfield property and
destroy the structure and any such trespass will be met with a
lawsuit.
Please be advised that the your notice does not specify the
conditions which make the structure subject to the order or provide
any method to bring the property in compliance other than
destruction. Please consider this letter an appeal of the above
referenced notice. We request that you immediately send copies of
all ordinances which you rely upon for issuance of this notice and
a complete set of ordinances relating to the appeal thereof.

performed on August 9, 1995 and the agricultural st
