feasibility of building a new residence in the footprint of the previously burned down residence on tax parcel#32135-43-00050.Date of Site Visit/Meeting:June 6,2023 General property description:The site is located at 5171 E State Route 3,Shelton,WA 98584.The property can be accessed by an existing gravel driveway.The site is mostly cleared,with native grasses in the southwest corner of the site.There is currently a mobile home and a few small accessory structures on the site.The previous manufactured home burned down on May 9, 2002.The residence was demolished at the time of this visit,though parts of the foundation remained.There is an existing retaining wall around the outer edges of the footprint of the burned down residence.The site is 1.71 acres total.Zoning:The zoning designation for the site is Rural Residential 5(RR5).Standard setbacks for this zone are a 25-foot front yard setback and a 20-foot setback for side and rear yards.The front yard refers to the lot line adjacent to the property access,including access easements,which would be the western property line for this lot.An administrative variance can be applied for to get a reduction in the required setbacks(minimum of 5 feet for sides,minimum of 10 feet for front and rear)if the lot meets certain criteria.All setbacks are measured from the furthest projection of the structure(including roof eaves,decks,heat pumps, gutters,etc.).Setbacks apply to all structures including building permit exempt structures,propane tanks,decks,sheds,etc. Height limit per Mason County Code(MCC)17.04.224(c)is 35 feet.Size limit per MCC 17.04.224(b)is 4,800 square feet for accessory building not to include dwellings.Reconstruction:Mason County Codes only require timelines for permit submittals/issuance in the cases of reconstructing nonconforming structures.The previous manufactured home was a conforming structure,and the current use of the site is a conforming use,therefore there is no time limitation on applying for reconstruction on this site.The footprint of the proposed residence is also not required to match the footprint of the previous residence because there were no critical areas observed on or around the site.The proposed residence must still meet the property setbacks outlined in the Zoning section above.The Mason County Building Department has requirements regarding the dimension between retaining walls and foundations.Please contact the Building Department(360-427-9670,ext.352)for any concerns regarding the remnants of the existing foundation and the existing retaining walls.The permitting process for a new residence may be expedited with the Property Damage Report.Please contact the Fire Chief of Mason County Fire District 5 to obtain the report.Stormwater Management:All projects shall be in conformance with the small parcel stormwater management requirements.A small parcel stormwater application is required for properties creating new impervious surface.Please consult the Small Parcel Stormwater Worksheet here or the Stormwater Handout here for more information.Streams:In a previous Site Pre-Inspection conducted by the Planning Department(SP12020-00014),it was determined that there is a seasonal drainage ditch that was dug historically to drain upland property.This ditch does not meet the definition of a regulated stream,so no additional setback is required.Septic/Drainfield:It is strongly encouraged that you consult with our Environmental Health Department for requirements on new septic system designs and existing septic systems,to make sure that it is sized accordingly to serve the improvements as well as water connection requirements.The permit assistance center requires an approved septic design prior to submitting a building permit.For more specific information,please contact Environmental Health,at 360-427-9670 x400.Septic and Water Utility Note:Septic tanks and drainfields are prohibited in protected critical areas,such as streams,marine shorelines,and hazardous slopes.Septic infrastructure may be placed in the protected setback area without additional permitting and environmental studies.In the event that there is no other practicable alternative for placement,septic infrastructure may be placed in the outer buffer with a Mason Environmental Permit and Habitat Management Plan along with written documentation that there is no other feasible location.Further shoreline restrictions may apply towards building envelopes or expansions for septic.Fire Apparatus Access Improvements:Per MCC 14.17,driveways and other accesses for structures must meet fire apparatus access road standards.
