Dear Mr. Paisley, This letter is in follow up to my site visit to the above referenced property back in October and to Pam Bennett-Cumming's letter of 4/16/09. Last Fall you submitted a Forest Practices Application (FPA 2008-00010)to selectively log portions of your property. During that visit we identified critical areas and their buffers but agreed to hold off of further review of the application until other permits that had been combined under the same SEPA application were ready for a threshold determination. I am now of the understanding that you have withdrawn your MHP application and that any other permits reliant on the SEPA have since expired. Can you confirm that this is also you understanding. If so, your next step is to submit a fresh SEPA checklist that is written with the focus on the activities that will occur under the FPA. It would be advisable to explain in the checklist that this FPA is only the first phase of a larger project and that successive phases will be reviewed under SEPA at a later date (if and when necessary). Once I have a checklist that is focused on the FPA review, I will be able to make a threshold determination. Assuming that no substantive comments are received, I would be able to issue the FPA shortly after the conclusion of the comment period. The intention here is to memorialize the issues that we discussed relative to your FPA application. The only critical area I identified on your property is a spring feed stream that I understand to be classified as a Np which has a 100' buffer and an additional 15' building setback. There is also what appears to be a non jurisdictional wetland in the SW corner of your We also discussed a Pileated woodpecker snag that I flagged and the Eagle Tree that-you have been working with WSF&W on (staying out of a 400' radius). I measured the slopes on your property in several locations and came up with a slope of 13%. There is however a much steeper slope NE of your property above Cranberry Creek,but that is over 600' north of your property line. As we discussed, you are not looking to have this FPA issued prior to other permits that you already have under review. Here is a list of the items that will need to happen before I can sign off on the FPA. SEPA(SEP 2008-00060)needs to be issued(I will add condition relevant to the FPA). A stormwater and erosion control plan needs to be approved by Mason County Public Works. The Eagle Tree radius should be shown on your site plan. A Pileated Woodpecker snag was observed on site. It is my understanding that most of this site will remain undisturbed. Pileated Woodpeckers are protected by chapter 17.01.110 of the Mason County Critical Areas Ordinance. Disturbance of snags showing the distinctive characteristics of Pileated foraging are to be avoided. If the removal of 1 such a snag can not be avoided, then a Mason Environmental Permit(MEP) and a Habitat Management Plan(HMP)will be required for mitigation. Page 3 of 4 i NOTE: Copies of all FPA Applications will be forwarded to Mason County Public Works for stormwater and erosion control review.Projects which disturb more than one acre(regardless of total lot size)will require an engineered stormwater plan consistent with the Mason County Stormwater Ordinance(Chapter 14.48.)and the 1992 WSDOE Stormwater Manual(2005 in Belfair&Allyn UGA's).Applicants will be charged for Public Works staff time to review these plans and applications. Property owners should also be aware that the Washington State Department of Ecology(WSDOE)might ask for a NPDES(National Pollution Discharge Elimination System)Permit.The threshold for such a permit is equivalent to Mason County's threshold.WSDOE will notify applicants through SEPA review if a NPDES is required.An NPDES is not a perquisite for FPA approval.It is the responsibility of the applicant to obtain this permit when required.
