There are several items in the application that were not completed,(and are very important for the engineering review of this project. The following items in your application need to be completed: #5, #10, #15, and the TOPOGRAPHY PROFILE DRAWING. Your application can not be sent to engineering review until this information is available. Enclosed, find a copy of your application. Complete the above items and supply a Topography Profile Plan indicating the areas where soil will be removed. Also, this letter is to notify you about the existence of a bald eagle nest adjacent to your property. Under the Washington State Bald Eagle Protection Rules (WAC-232-12-292) a cooperative Site Management Plan is developed whenever activities that alter habitat are proposed near a verified nest territory or communal roost. Each Site Management Plan is based on the unique characteristics of individual eagles and their home range, as well as surrounding land uses, in relation to the proposed activity and landowner goals. O'Day for Tax Parcel #32135-33-00000. Dear Hugo, Your office recently received a entry road installation permit application from Michael N. O'Day, who recently purchased a 40 acre parcel of property within the Oakland Bay Bald Eagle Territory. I appreciate you sending me the information regarding the Hawk Hill Master Plan which is being proposed by the landowner. A Bald Eagle Management Plan shall be required for the property based on the presence of a documented bald eagle nest within 400 feet of the property. The Bald Eagle Protection Rules (WAC 232-12-292) and the enabling legislation (RCW 77.12.655) were enacted in 1986 to provide some means of protection for important bald eagle habitat. As we discussed yesterday, I had met on the property with the new landowners prior to their purchasing the large undeveloped parcel. The Washington Department of Fish and Wildlife is in full support of the proposed Hawk Hill Master Plan and is quite grateful that such environmentally sensitive individuals have bought the property. I am presently in the process of developing a Bald Eagle Management Plan for the property. Due to my present workload after taking some time off for the holidays, I will not be able to complete the plan for a week or two. It is my understanding that Mr. O'Day would like to complete some initial clearing and grading as soon as possible. A small portion of the driveway is located within 800 feet of the nest tree and the WDFW would prefer any heavy equipment work needed in this area to be completed prior to February 1st. To prevent any delays I would request that you issue Mr. O'Day his grading permit as soon as possible. A copy of the finalized Bald Eagle Management Plan will be sent to you after completion.
