It's been a while since we've communicated on this project. I want to start by thanking you for being so helpful and working with us in resolving issues with this project. Can we assume that this attachment is the SDP for the project and that we won't be receiving anything else from the county? Additionally I want to follow up with you on the grading permit and the use of that county lot for dredge materials storage. Based on our conversation a few months back, you've spoken to the Mason County Parks trail manager who seems to be OK with our proposal to storage/dispose of dredge spoils at that parking lot. We are in the process of filling out the Grading Permit now, and have a few questions. - Under the section Owner information, who/which address/contact information should I put here as it is Mason County. - Do you have an actual address for that site? the parcel number is #32219-12-60010 - Besides this very simple one page form for the Grading Permit, is there anything else we need in order to get permission to store/dispose of dredge materials there. - What is the approximately turn-around/ permitting time for a grading permit? Hi AII, s-( l I finally have been able to get this project moving at WDFW and just realized I have not seen a SEPA determination letter for Tahuya. Can Rick or Allan speak to the SEPA determination? It is usually something we get from the county, however I am asking Ecology as well as the SDP approval letter came from Ecology in this case. I've been contacted by DNR and the Tribe with their responses to this latest proposal, but am still waiting to hear from WDFW. In general, their response is favorable and should allow us to issue the permit with a couple of added conditions to reflect their concerns. Location of channel dredging: The current proposal from Marine Surveys and Assessments project proponent Nam Siu is dated January 1, 2015 and is attached. Pursuant to comments received, the dredge channel has been changed to follow more closely with the current manmade channel but avoids private tidelands. The estimated dredged material has been reduced from 1166 CY to 763 CY.The dredging project will still impact State lands and tribal shellfish rights. Regulatory opinion is that dredging the channel in order to keep open water access to the boat basin is not a sustainable action and future dredging of this site will be required.Therefore the impacts associated with this project will not be a one-time occurrence and environmental impacts must be evaluated as a frequent temporal disturbance to the shellfish and aquatic vegetation. Frequent disturbances at this site from natural and manmade occurrences, including dredging operations, have already reduced the shellfish production of this beach to 20-30%of what it historically was. The plans propose a 50 foot wide channel (See P1 through P10 Revised dredge map). The vessels using the channel are maybe 8 to 10 feet wide, so the dredge could be further reduced to still allow vessel passage and reduce the amount of dredge spoils produced. Mitigation sequence should be followed, if the channel is dredged where it currently occurs impacts to shellfish and public access to the beach would be reduced. No impacts to shellfish or limitations to public access should be allowed by the project. Agency input should be restricted to analysis of the project proposal rather than finding solutions to the project limitations, however it has been suggested by agency staff that dredging in the current channel following the existing channel contours and limiting the channel width is a better option to not only reduce the amount of material being dredged but limit the disruption to habitat and open space protected by the deed covenant and of concern to tribal shellfish rights and WDFW protection mandates. Method of channel dredging: The proposal of using a land excavator rather than a barge mounted excavator to conduct the dredge operation is presented by proponents as the only financially feasible option.A letter was written to WDFW from House Representative Kathryn Haigh requesting WDFW to allow the use of land based equipment.The WDFW response stated that land-based equipment was not specifically excluded, but that mitigation would be required for impacts associated with this method. The agency preference of dredging methods is based on the analysis of environmental impacts and not limited to cost analysis.The agencies therefore will only consider options that limit the environmental impacts to nearshore habitat and nearshore processes that will compensate for the negative impacts of land excavation. Dredged Material Disposal: The current proposal is to distribute the dredged material within the alluvial fan of the drift cell.The proponent is limited to where the dredge spoils can be placed due to lack of support for the deposition to occur on private tidelands.The neighboring property owners have not granted permission for the dredge spoils to be deposited on their land. it was previously believed that the US Army Corp of Engineers(USACE) had limited the proponent from removing the dredge spoils from the drift cell and a deposition site within the drift cell must be found.This however was determined to not be the case pursuant to a conversation with Darren Habel (USACE). Deposition of the sediment within the drift cell is problematic for many reasons:The material has historically refilled the dredge channel over time.The natural creek processes combined with the movement of sediment by wave energy must be evaluated. Hugh Shipman was consulted for his opinion, and concurred with the findings from agency staff. Placing the material within the drift cell presents logistical and cost issues.The sediment tends to move in a Southeasterly to Northwesterly direction stopping at the delta. Any placement within the drift cell will move the sediment into the delta, refilling the channel and causing impacts to aquatic vegetation and shellfish. WDFW concurs that the decline of oysters will occur from increased sedimentation, destabilizing the habitat. Salt marsh habitat is another important consideration. DNR,Tribal and WDFW requirements limit the amount of sediment to be deposited on tidelands to create no net loss of shellfish or forage fish habitats. Given these restraints,the agencies are still open to alternatives for placement of dredged material. Reducing the volume of dredged material is also advised. Agency analysis is restricted to project design and the associated environmental impacts.The deposit of the dredged material on state managed tidelands will negatively impact fish and shellfish habitat as well as salt marsh vegetation.The volume of dredged material (approx. 763 Cubic Yards) is too large in volume to be deposited in a single instance on near shore beaches and will negatively impact fish life and shellfish production, as well as saltmarsh habitat. Longer term geologic processes were also investigated to understand what the impacts to the drift cell would be by deposition of this volume of sediment.The material will move with the hydraulic action of wave energy and the Rendsland Creek natural flow regime.The dredged channel created in the 1970's is unsustainable and will require future dredging, as the natural processes only work to return the sediment to this location. The agency opinion is that new alternatives will need to be presented for the placement of the dredged material.Although there is no clear solution to appropriate placement of this volume of sediment,the agencies are willing to investigate any alternative proposals, including upland disposal. Currently the proposed alternatives s all present negative impacts to fish, shellfish and nearshore vegetation and would require mitigation as part of the proposal. Here are a few considerations about the DNR conditions. I don't know if any of this will be useful: 1 . DNR has not done anything to the spit since the early 1970's when they put in riprap from the bridge to about halfway down on the creek side. 2. The excavation equipment is not going to be on any shellfish beds; the beds are further out toward the low tide line. 3. Ww can not afford to pay for barge dredging. Of the 15 member households, 7 are households where both people are retired on fixed incomes; in 4 of the others, one person is retired and/or on fixed income. 4. The old pilings in this area are at least 100 years old, and we have been told that after that many years the creosote effects are probably minimal.
