RE: Squaxin Island Tribe's appeal of water adequacy determinations for DB Industries, Cases No.
[(]M2009-00002 & 00083
Dear Members of the Mason County Board ofHealth:
By this letter, the Squaxin Island Tribe withdraws its appeal to the Mason County Board of Health of two
water adequacy decisions for DB Industries recently made by the Mason County Public Health and
Human Services Department.
The basis of our appeal withdrawal is the commitment of county staff to work with the Squaxin Island
Tribe tm clarify procedures, decision points, and public disclosure requirements related to building
permits, subdivision approval and determinations of water adequacy.
Our hope is to make the entire process more transparent to protect the timely right of appeal for all
parties, not just the tribe. Tinning of building permits or subdivision approvals vs water adequacy
decisions, dates of decisions,the paper trail, the permit website, etc. all need to be clarified and
consistent for the public to have the option and opportunity to appeal per Mason County Code 6.68.070.
In addition, we urge the county when making a determination of water adequacy to include a
requirement that the applicant prove the legal availability of water, not just physical availability, based
on recent case law.
