There are potential risks and monetary liabilities to the homeowner for using an unregistered contractor. Further information can be obtained at 1-800-647-0982. The erson signing this condition is either the homeowner, agent for the owner or a registered contractor according to WA state law. X 3) The use, handling and storage of hazardous materials or flammable and combustible liquids in excess of 10 gallons is not allowed without the approval of the Mason County Fire Marshal. X 4) Provisions for surface/subsurface drainage control must be implemented with new construction or development on site and MUST NOT adversely impact adjacent parcels. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. X 6) All approved plans are required to be on-site for inspection purposes. If an inspection is called for and plans are not available on site, then approval will not be granted. In addition, a re-inspection fee (refer to current fee schedule, minimum 1 hour)will be charged and must be collected by the Building Depart ent prior to any further inspections being performed or approvals granted. X 7) In accordance with the Uniform Building Code, all sites shall have approved numbers or addresses located in such a position as to be plainly visible and legible from the street or road fronting the property. Mason County Building Department requires that this be completed prior to calling for any site inspections. A re-inspection fee based on rates as adopted by the jurisdiction and the Uniform Building Code will be assessed if the owner and/or contractor fail to post the address on site prior to requesting inspections. If an inspection is requested and the"approved" plot plan is not on site, then • approval will not be granted. X 10) All construction must meet or exceed all local ordinances and the 1997 Uniform Building Code requirements as adopted and amended by Mason County and the State of Washington. Occupancy is limited to the approved and permitted classification. Any non-approved change of use or occupancy would result i permit revocation. X 11) REQUIRED INSPECTIONS (Footing Inspection-prior to pour, Set-up Inspection-prior to skirting, Final Inspection-prior to occupancy). I hereby assume all responsibility for the scheduling of my required inspections. If the required inspections are not requested, inspected and signed off(approved) by the inspector in the prescribed order, I understand that reinspection fees and an hourly investigation fee pursuant to the 1997 UBC, and will be assessed in addition to my original permit fees to resolve any questionable practices or problems that have been discovered. The largest landing or deck allowed without drawings or a building permit MUST be under 30" in height from surrounding grade. NO second story decks, or decks above 30"can be built without a permit. X 15) The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance with the Uniform Codes as amended and adopted by Mason County. Any corrections, changes or alterations required by a Mason County Building Inspect r shall be made prior to requesting additional inspections. X 16) The installation permit shall be displayed in clear view of the site access road. The approved site plan and other applicable instructions, including installation instructions, shall be available in this location OR placed in the location specified by WAC 296-150M-655. The Building Official may extend the time for action for a period not exceeding 180 days, upon the receipt of a written extension request indicating that circumstances beyond the control of the permit holder have prevented action from being taken. No more than one extension may be granted. X 20) Location of wetland and wetland buffer flagging approved. Structure to be located a minimum of 15' landward of the wetland buffer flagging. Dimensions on the site plan previously submitted are not accurate. X 21) Temporary erosion control measures must be implemented to prevent water quality degradation of adjacent waters or wetlands. Silt fencing must be installed and maintained until upland vegetation has become established. X 22) All conditions attached to MEP2002-00051apply to this permit. x This permit becomes null and void if work or construction authorized is not commenced within 180 days,or if construction or work is suspended for a period of 180 days at any time after work is commenced. SW Apt. 110 Edmonds, WA 98026 RE: Information regarding site evaluation; Tax Parcel Number 32134-75-00040 Dear Mr. Masters: On October 2, 2002, I conducted a site inspection on the above noted tax parcel number in response to concerns noted by Planner Pam Bennett-Cumming during her processing of Building Permit application number BLD2002-01167. During her site review,Pam noted that recent grading/filling has impacted a wetland and its associated buffer. The graded/filled area is approximately 60' wide and 45' long with an undetermined depth, and impacts a jurisdictional wetland and the associated buffer. Jurisdictional wetlands and their associated buffers are regulated under Mason County Resource Ordinance section 17.01.070. A copy of this section is enclosed for your review. The wetland in question is potentially a Category II wetland with an associated regulated buffer extending 85' from the edge of the wetland(plus a 15' building setback from the edge of the 85' buffer). I met with your representative from Arcadia Drilling this afternoon. He is aware of the following information, and will wait to receive the County approved delineation and categorization from your consultant. Your first step in resolving this issue is to have the wetland delineated and categorized by a qualified wetland consultant. I have enclosed a list of some wetland consultants for your convenience. The delineation and categorization will be evaluated by the County, and if accepted,will serve as the guiding documentation for future development setback requirements. The second step in resolving this issue will be to submit a restoration plan,prepared by the wetland consultant,that meets the criteria found under Mason County Resource Ordinance section 17.01.200(I). A copy of this section is enclosed for your review. As noted, the restoration plan must be accompanied by an acceptable monitoring plan and restoration bond. A restoration bond form is enclosed, and the bond amount is to be based on a reasonable formal estimate to perform the work referenced in the restoration plan. Restoration activities will be tracked through issuance of a Mason Environmental Permit(MEP). A MEP application form is enclosed for your convenience. The fee associated with the MEP is $480($160 standard fee tripled due to after the fact status). The MEP submittal must also be accompanied by a$70 enforcement site investigation fee. Finally,pursuant to state law, submission of a State Environmental Policy Act (SEPA) Checklist may be required if any of the restoration work is to be performed forward of the Ordinary High Water Mark(after the water level rises in the winter months). Expeditious timing on your behalf may eliminate the need for SEPA submission. It is important to note that because this is the end of a very dry summer, current hydrology on the site is a long way into the wetland, and the current water mark is in no way considered the wetland edge. Please submit the delineation and categorization as soon as possible so that processing of current development applications may continue. I think we need to be clear with him what we are looking for so he's acting on what we want, rather than the impression of what we want. information below Planning staff Pam Bennett-Cumming performed a site visit as part of the normal site review for the building permit application (BLD2002-01167). Staff observed that a wetland and buffer had been graded, and fill had been brought in. Extensive sand fill has been placed such that it encroaches both on the wetland, as well as the wetland buffer. Staff photographically documented the violation. Wetland Chapter 17.01.070 provides for protection of both wetlands and their vegetative buffers. 1. Remove fill from wetland and buffer area. See also below for review process. 2. Submit a delineation and rating for the wetland, which is in accordance with the procedures as specified in the Washington State Wetland Identification and Delineation Manual, and as per the Washington State Wetlands Rating System. 3. Submit a restoration plan completed by a biologist with knowledge and experience of wetlands and wetland restoration. The restoration plan must address how the fill will be removed in such a way to not further degrade and damage the wetland. 4. Complete and submit a Mason Environmental Permit with the above delineation, rating and restoration information. Triple fees are applicable. Because the wetland fill encroaches below what would be the high water mark of the wetland, SEPA is also required (triple fees). Based on site review, the wetland is either a Category II or Category III wetland, so when removing the fill that has been placed, it should be placed further upland than 100 ft from the wetland. The wetland edge appears to be approximately halfway back up the sand fill, but it will take accurate delineation of the wetland to confirm this.
