I am enclosing the April 26, 1993 letter that indicates an
inspection has been done on your structure. According to the
report by the inspectors, the structures meet the minimum codes of
the Uniform Building Code in effect at the time. If there are
product failures, the supplier or contractor should be notified
regarding these kinds of defects.
Unless there are structural failures because of non-code
compliance, the Building Department is limited in any action that
can be taken.

Dear Mrs. Foote:
On March 26th 1993 Wayne Krause and myself completed an inspection as per your request.
After reviewing your concerns we came across the following findings:
1. Cracking in the ceiling, kitchen and living room wall is determined to be caused by
shrinkage and truss lift.
2. The siding on the North and East side has a rated span of 24 inch on center. After
further discussion with Mike Byrne, Building Official it has been -determined that this is a
aesthetic problem not a structural problem.
3. The foundation cracks are found to be of a normal nature. Recommendation for this
is to contact the office if you observe further cracking.
4. The floor framing was found to be at the joist 2 x 8 16"on center, I1' 10 112" max,
Beam 4 x 8 span 7'max. This meets code requirements per UBS Chapter 25.
5. The beam post base was found to be a continuous footing, which more than exceeds the
UBC requirements.

Attached is a letter to Shelton Construction concerning problems
still unresolved with the home I purchased on E 101 Rainbow Lake
the end of July 1992 .
As the letter explains, I am still having problems with truss lift
& moisture ( interior wood & exterior siding ) , as well as numerous
other problems.
In 1993 , I requested reinspection of this house and your office
stated they felt it unnecessary since the structure met
specifications.
Please retain this letter in your files as Home Owners Warranty
Association and my mortgage company may require reinspection of
this structure.

I placed a call to your office on March 25 , 1994 and upon receiving
your return call on March 29th and attempting to explain the needed
repairs & corrections to the structure , stated I would notify you
in writing since there seems to be a difference in opinion in
correcting the problems still prevailing on my house .
Much to my dismay, the remaining portion of the original siding
( which was not replaced in November 1993 ) warped through the wet
months ( Nov 93 - *larch 94 ) & in some areas has again nearly resumed
flat appearance since warmer/dryer weather has arrived (which was
the tendency of the panels previously replayed ) . The panels
adjoining those replaced because of warpage on the back side of the
house near the deck, were warped at the time you replaced the
siding (Nov. 1993 ) & continued to increase in warpage , making it
quite visible where the new siding had been replaced. Also there
were areas on the front of the house which were warped (not as
severe , but noticeable at the time your crew replaced the siding in
Nov. 1993 ) which increased in warpage .
You have indicated this is a manufacturer' s defect . It is obvious
that all remaining siding needs to be replaced as it is apparent
all the original siding used on my house at E 101 Rainbow Road was
defective and will need to be replaced in entirety. Your painting
contractor painted only those panels which were replaced, in which
case any newer siding being replaced will not match that which was
painted in Nov ' 93 . The entire exterior will have to be repainted
to ensure all areas match since the panels are only primed (not
painted ) . You verbally disagreed with me on this matter on March
29 , 1994 . As we both know, paint fades in weather/rain/sun, etc .
I 'm sure you can understand my point in not wanting a mismatch of
colors on my home ( particularly since this home was new when
purchased ) and still under warranty. Also , I need to inform you
that at the time your painting contractor arrived & painted the
siding ( in November 1993 ) & panels in the garage door, it was
raining . Mildew has surfaced again on the more recently painted
areas . I emphasize "again" due to the initial problem reported to
you in October of 1992 ( ie . page 2 )

As you have been made aware , all the houses you built ( my house &
the houses purchased by Robert Howell , Mike & Lynn Rostvold and
Vikki Siccoro ) developed mildew shortly after being built . Upon
purchasing my house & taking possession the end of July 1992 , I
observed discoloration on the siding ( some panels lighter in color
than others ) . I notified you in early fall of 1992 ( October 1992 )
that it looked as if the paint was washing off the siding on my-
house . when you came to investigate , you informed me that mildew
had formed and that it was not your responsibility , but the buyers
responsibility to take care of mildew .
I find it unreasonable to accept your explanation "because we live
near a lake" , particularly since it occurred so soon after
construction & during dry weather. Also , the paint under the eaves
of the roof has cracked peeled away in several areas , all the way
around the house . It appears as though no primer was used prior to
painting . There are other areas under the eaves where the roof
adjoins , which are showing bare wood ( no paint ) , this may be due to
shifting resulting from the truss lift & separation. The paint has
chipped off around the front door area & concrete landing ( as I had
indicated in my previous letter ) . All areas need to be repainted
& corrected . My reasoning for disagreeing with your consensus
comes from factual problems stemming from moisture & separation in
the trusses of the house as well .
The wood on the front of the house (where the roof changes pitch &
to which the gutter is attached, ( ie . the valley) is beginning to
turn black and I observed when cleaning the gutters that the
necessary flashing needed was not installed which causes the water
to run down between the roof and the gutter ( through the wood
rather than into the gutter ) creating puddles of water at the base
of the concrete step ( entrance ) to the house & the foundation.
This is an area which has no drainage . The proper flashing needs
to be installed at all areas where gutters are attached, and all
damaged wood replaced . One of the trim boards on the front of the
house ( near the front entry ) is badly split ( as is one of the two )
main support poles on the deck (which weakens the entire support
system of the deck ) , as well as some of the railings on the deck.
Mr Howell has asked me to report any & all defects ( of which I am
aware ) to you & to make certain repairs are completed since his
work requires him to be in Clallam Bay, WA 5 days out of the week.
Since his house also has excessive mildew problems , I am hereby
reporting the problem to you. Mr. & Mrs . Rostvold who purchased
the house next door ( also constructed by Shelton Construction) is
also experiencing the mildew problems . Mrs . Rostvold has indicated
that she has contacted you concerning the problem but without
satisfaction.
We are not "HAPPY/SATISFIED BUYERS" !

There have been continual problems of one type or another & the
problems with my house have not been satisfactorily rectified. I
purchased a new home to avoid assuming someone elses problems ;
instead I have encountered problems which should not have occurred
in a "NEW" home and more than necessary personal hassles . I could
have purchased a manufactured or modular home which would have been
soundly constructed and at a much lower cost with a guarantee of
workmanship.
Your attitude towards most of the repairs has been that of
reluctance and that I created the problem ( ie . the closet bar
cracked & broke , but did not have the needed sturdy bracing
installed) of which I replaced two of the braces & the rod & paid
for myself , then the discoloration in the bathroom tile which was
not from "sweating" of the commode ( as you indicated ) , but was
instead a legitimate error in the stool not being seated properly
(which has yet to be corrected due to water damage in the flooring
again) .
It would seem a craftsman would show pride in his work and concern
in customer satisfaction. I do not feel that I am being demanding
or asking for repairs which are not legitimate . My loan company
has financed this house & I ' m sure will be as concerned about the
value of the home as I am & that it is "properly built" Since I
am paying for it (with interest ) I should have the right to expect
any and all repairs made will not "lessen the value" my home at a
later time or cause further problems/damage later.
A major problem which has not been resolved is the truss & lift
separation in my home . The truss which runs the full length of my
rambler continues to separate , leaving an ugly gap between the
ceiling and the wall in my living room/dining room/kitchen. This
gap has expanded and receded four times since purchase in July
1992 . At the time our contractors arrived the truss gap had

shrunk & they merely filled in the gap with new caulking , hammered
the nails back into the ceilingand filled the holes . This truss
has caused separation again. The nails have protruded through the
ceiling in several places throughout the center truss -area of my
house & now above the front door. Each time this truss separates
the wall & ceiling cracks open and makes it impossible to close the
doors to the bedrooms & bathrooms . Eventhough your work crew
caulked the crack ( after it had receded ) the truss continued to
separate . There is a definite difference in the color between the
caulking and the paint in the ceiling and walls , which will force
me to repaint the walls in all areas since there is open concept
( living room/dining room/kitchen/hallway ) . You have not
volunteered to repaint the walls eventhough this separation in the
ceiling & wall is a problem over which I have no control . I am
requesting that once the problem is corrected permanently that the
walls be repainted so that there is no discoloration & look of
"patch" work.

Since my kitchen cabinets are attached to this wall , I am concerned
that they will not hold properly & also be stressed out of
conformance . There is a noticeable space which has developed
between the ceiling and the kitchen cabinets , and the cabinet doors
are now uneven . You have told me there is little or nothing that
can be done about this truss lift other- than cutting the truss
shorter which will not be beneficial . I disagree , I am not
satisfied owning a home in which the ceiling and walls continually
separate , doors stick ( will not open and close properly ) & floors
bulge . I do agree that cutting the truss shorter is not the answer
& will ultimately weaken the structure of the house . Consequently,
I have contacted two separate licensed contractors who have checked
out the problem & have estimates from both. These contractors have
advised me that since my home is still under warranty, the builder
is held responsible for costs of repairs . I have also been advised
that there is still moisture in the wood , which may be causing the
truss lift ( that the walls and interior of the house may have been
completed before the structure of the house was allowed to dry
thoroughly ) . Both contractors indicated that the ceilings in the
kitchen, dining room and living room have not been nailed properly
( this was determined by lightly pushing up on the ceilings ) , &
eventually the nails will protrude through the ceilings throughout
these areas . One contractor stated that it could possibly be six
months or two to three years before this occurred, but that it
would eventually happen. I also had them check the flooring in the
living room, dining room, hall and entrances to bedrooms as there
is excessive bounce and creaking/cracking when walking with normal
walking across the floors (as I had indicated to you at the time
you arrived to check the problems prior to your contractors making
repairs ) , and there is raise in the floor ( which can be detected
through the carpeting & was observed by both contractors ) near the
two back bedrooms ( appearing to be the center brace which runs the
entire length of the house ) . The folding door on the linen closet
at the end of the hall bound & would not open more than six ( 6 )
inches due to the warpage in the flooring making it impossible use .
The explanation was that the flooring may not have been properly
nailed down prior to the carpeting & padding being installed, or
that the footings at the opposite end of the house are sinking .
Appropriate corrections need to be made to keep my floors , walls &
doors from warpage & further damage and eliminate the
creaking/cracking and bounce throughout the flooring . I was also
informed that floor warpage may also cause problems in the
carpeting rippling .

The problem in the main bathroom ( which I had hoped was resolved
when the commode had to be reseated to leakage ) continues to be of
major concern . The moisture damage from the flooring has surfaced
again & discolored the tile in the bathroom. The repairman from
Viking Floors who replaced the tile said that the wood flooring was
wet . apparently- this flooring had permanent water damage & needs
to be replaced ( and/or has developed dry rot ) .
There has been no "sweating" of fixtures ( as originally suggested
by you ) in either bathroom as I have checked this continually and
carefully. It may be that eventhough the commode was reseated, it
is still leaking .
While cleaning my pantry in the kitchen I discovered large black
carpenter ants had come through the space between the door jamb
the wall & found that the molding was never placed around the door ,
leaving approximately 1 1/2" or more gap. Since the house is an
all electric heat & intended to be energy efficient ( super good
cents ) , this molding needs to be installed to prevent cold air flow
( as well as prevention of ants & mice entering through this space ) .
At the time of your first contact visit in the fall of 1992 , I
informed you that the concrete work on my driveway had cracked
completely across the width of the drive & that all the concrete
walks & the driveway are mottled ( badly discolored ) . You replied
that there was nothing you could do about it .
My concern is that (not only is this extremely ugly) and will lower
any resale value of my home , but , that with aging the walks and
drive way will deteriorate more rapidly. At that time ( 1992 ) I
requested contractors correct the unsightly concrete work on the
foundation on the front of the house . The patch is still unsightly
as it is a completely different color than the rest of the
foundation. I spoke with you about the discoloration & the crack
in the driveway at that time . I am not satisfied with a "patch"
being made to the crack on the drive way and request that the
concrete work be corrected ( replaced if necessary) with no
unsightly blemishes/cracks ( such as there is now) at no additional
cost to me & any clean-up accomplished . I have found the pieces of
concrete buried in the ground around the areas where the concrete
pads were poured.
My request is to have all repairs corrected immediately except the
truss lift, the ceiling problems and replacement of remaining
siding & the painting ( inside & exterior) . These problems will
need to be corrected following a "reasonable/allowable length of
time determined by Home Owners Warranty to see what further
problems may develop, and stated repairs should be completed &
during warm, dry weather to prevent future problems .
