will find comments made regarding the proposed development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must
be included in your specific proposal; these setbacks are included as part of the comments listed
below.
This information is based on County and State regulations as they exist to date. These regulations
may change and may affect the requirements for development of the subject property.

Comments:
Inspection for Jeremy Seamons on Sept. 6, 2007:
The purpose of the pre-inspection was to evaluate issues related
to the construction of a new garage or addition to the residence
on a 1-acre parcel along Deer Creek Rd. The parcel is mostly
cleared of evergreen and deciduous trees (maintained as lawn
area), has a residence and small outbuildings closer to the road,
and has a 5 percent slope to the southeast towards Deer Creek.
The zone designation for the site is Rural Residential 5. Standard
building setbacks for this zone are a 25 foot front yard setback,
and 20 foot side and rear yard setback (lot line setbacks). These
setbacks are measured from structures or projections above
grade, such as roof overhangs or gutters, balconies, stairs, decks,
fuel tanks, or heat pumps. An administrative variance may be
requested to reduce these setback distances from property lines,
to as low as 5 feet (side yard) or 10 feet (front yard or road), if the
size, shape, or features of the property constrain development
from the proper setbacks. This process requires application and
review at the time of the building permit submittal.
Slope: Slopes do not exceed 5 percent. No special geologic
study is needed for development review.
Resource Ordinance - Shoreline: The shoreline designation for
the area is Urban Environment per the Mason County Shoreline
Master Program, and setbacks would be determined by the this
Program. In this portion of Deer Creek, the shoreline setback is
typically determined in the same manner as the Resource
Ordinance stream critical areas. Any portion of the new structure,
including decks, balconies, and rooflines, must be behind the
determined setback line.
Resource Ordinance - Streams: The observed stream that flows
through this property is a Type 1 or S stream, a portion of the
Deer Creek flowing to the south and southwest. A designated
Type S stream is a perennial water of state-wide significance,
having fish-bearing capability and that falls under the jurisdiction
of the Fish and Wildlife Habitat Conservation Areas Chapter
(17.01 .110) of the Mason County Resource Ordinance. These
provisions establish a 150-foot vegetation buffer and a 15-foot
building setback requirements for a type S stream, for a total of
165 feet from the channel migration zone (CMZ). In accordance
with the Resource Ordinance, buffers are to be retained in their
natural condition, but portions of established use area may be
maintained. New residential development is not permitted within

Fish and Wildlife Habitat Conservation areas or its buffers, except
for as approved through a variance or reasonable use exception
review process.
Staff made measurements from stakes at the proposed footprint
of a new garage (closest to the creek) to the channel of Deer
Creek; the distance is 109 feet to the stream channel. Measuring
back to the existing fence equal to the road side of the proposed
garage that distance is 145 feet from the creek. Based on this
field review and the presence of the stream alignment, no area
exists on the subject parcel that would not be unencumbered by
the critical areas buffer and building setback of Deer Creek. The
review of a variance from the Fish and Wildlife Habitat
Conservation Areas chapter would be necessary to pursue a new
garage, outbuilding, or expansion of the existing residence on this
property. A Habitat Management Plan (HMP), prepared by a
qualified biologist, would be required as part of the variance
request to support the proposed development. The HMP
addresses impacts to the buffer and offers measures to preserve
and protect the buffer or to mitigate impacts of the development
proposal. A copy of the Fish and Wildlife Habitat Conservation
Areas chapter, including details on the contents of an HMP and
the variance public review procedure, was given to the owner.
Application for a variance to these standards does not guarantee
approval of the development as proposed.
General process: Future site development must include a site
plan, showing all setbacks from property lines, slopes and
shoreline. This plan will be needed for the variance request and
building permit application submittal.
