Box 279 Shelton, Wa. 98584 Dear Mr. MacSems, Along with this cover letter you will find a Mason County Forest Moratorium Waiver/Release Application for a portion of a parcel in Section 34, Township 21 North, Range 3 West. Simpson owns most of the South Y2 of the Southwest 1/ of that Section. Our parcel is bisected by the Mason Lake County Road. The portion of the parcel that is east of the road was logged over ten years ago and has been replanted. The portion on the west side still has timber on it and two FPAs were filed (in 1999 and 2000) to permit a road and to permit salvage logging to harvest timber that had been damaged in the ice storm several years back. Both of the permits were for the area west of the Mason Lake Road. As you know, the Notice of Moratorium on Non-forestry Use of Land requires that we enter a tax parcel ID number, of which there was only one encompassing both sides of the Mason Lake Road. Even though there were no FPAs granted for the area east of the road during the last six years the Moratorium has covered that area due to the use of the tax parcel ID. I have included copies of the approved FPAs showing that the activity areas for both are west of the Mason Lake Road. This Application is requesting that the Moratorium be removed for the following tract of land: That portion of the South Y2 of the Southwest 1/ of Section 34, 3 West lying El Township 21 North, Range Yl gastery of the Mason Lake County Road and Southerly of the Mikkleson County Road. he assessors office assign tax I have also requested that t gn a new Parcel number to this tract to avoid confusion about this in the future. ' 1 requires a 1 000 payment I know that a typical application for this removal q $ p y but I recall a situation similar to this last year where we had an FPA in an area where there subsequently was no activity and at that point the fee was waived. I don't know if the same will apply to this situation and, if required, I can get the fee delivered to you. At the least I will owe something to get the release recorded, if it is granted. Box 460 Shelton,WA 98584 October 13,2003 Dear Mr.Wing, This letter is in response to your inquiry regarding the lifting of a six-year development moratorium from some Simpson property located in the S ''/2,of the SW '/4, of Section 34, Township 21N.,Range 3W.,W.M.. I have reviewed the material your dropped off and I understand your reason for questioning whether or not the moratoriums recorded under Auditor File# 1762695 and 1719882 apply to the entire parcel as no logging occurred under FPAs 2406560 and 2406698 east of Mason Lake Road.I also understand that under normal circumstances the property lying on either side of Mason Lake Road could be considered to be separate parcels. Be that as it may, after careful consideration I am forced to conclude that the moratorium in question does apply to property on both sides of the road.The basis for my conclusion rest on the information provided in the Notice of Moratorium.Not only is property on both sides of Mason Lake Road currently carried under tax parcel number 32134-30-00000,but also the legal description on the Notice of Moratoriums includes all land in the S %2,of the SW '/4 of the section. Had the portion of the S '/2 of the SW '/4 east of the road been excepted,then my conclusion would be different. You have submitted the application portion of a request to have the portion of this property east of Mason Lake Road released from the development moratorium. Per the Mason County Forest Practices Moratorium Ordinance,in order to create a complete application package I need the following items: A completed SEPA checklist(application enclosed)and a check for$2,000 payable to the Mason County Treasurer. Once I have those items I can begin a review,which will result in a public hearing before the Mason County Hearings Examiner—who has the authority to grant or deny your release request.While I can not speak for the Hearings Examiner,I expect your case would be a relatively straightforward approval.
