Agreement with City of Shelton - Landfill Services - Supersedes 388 MASON COUNTY RESOLUTION NO. 146-85 RESOLUTION No. 481 Superseding Mason County Resolution No. 388 and Shelton City Resolution No. 307 WHEREAS, on County, hereinafter the County, agrees to accept for disposal solid wastes collected by the City of Shelton, and WHEREAS, it is the desire of the City of Shelton, hereinafter the City, to dispose of solid wastes at the Mason County Solid Waste Landfill: 11UW, THEREFORE, BE IT RESOLVED, by the and of County Commissioners of Mason County that the County does hereby agree to accept solid wastes collected by the City within the limits of the City and to dispose of such solid wastes in accordance with current regulations and disposal charges as may be adopted by the County from time to time in conformity with laws of the state and regulations of the on County Health Department, provided that this agreement shall be inoperative and the County shall be relieved of any of its obligations defined herein at and during any time or times that the County solid waste facilities are closed as directed by the Mason County Commissioners or by any other governmental entity with such jurisdiction due to any reason or reasons whatsoever; however, on County will notify the City of Shelton as soon as practical. In the performance hereof: 1. The City does hereby agree to pay to the on County landfill Operator a disposal fee of $2.50/cubic yard. Payment by the City shall be monthly, based upon the volune actually disposed of within the previous month. 2. The charge per cubic yard may be adjusted by the County when necessary or desirable following a Public Hearing; provided that any increase in fees by the County shall be submitted to the City for review sixty (60) days prior to adoption. 3. This disposal agreement shall be for the period January 1, 1986 to December 31, 1986, and shall be automatically renewed for each succeeding twelve month period unless a request for termination or renegotiation by either the City or the County is submitted to the other party on or before the first day of (October) of the then current year: provided that either party may terminate this agreement with or without cause after ninety (90) days written notice to the other party.
