A site investigation was done on July 30, 2007 and Mason County staff gave a verbal notice to your employee, Jerry, who was asked to contact our office. On August 2, 2007, 1 received a phone call from Mike Shoe, who was told that the Commercial Coach on site requires a permit, he assured me that a permit would be acquired. As to date, no permits have been applied for. You are required to submit for permits prior to August 16, 2007 to resolve this issue and avoid additional enforcement actions. I have included a copy of the Mason County Code Chapter 14.40 that explains the requirements for all Commercial Coaches. We are specifically responding to the comment that the proposal is a nonconforming use and that a rezone is required. We do not agree. The sand and gravel mine processing facility was approved by the Mason County Hearing Examiner on July 10, 2003. The permit is valid for 25 years from the date of issuance. In the course of review, the Hearing Examiner considered a variety of exhibits including an Environmental Impact Statement. The documents received by the Hearing Examiner included a proposed lay-out for an operations plan for the facility, and the plan specifically showed a scale house. A copy of Figure 6, the Operations Plan, is enclosed with this letter. Thus, the scale house use was specifically approved as part of a permit that this still in effect and the use is not a nonconforming one. The proposal specifically conforms to an approval that remains in effect for a number of years. We request that you review the file associated with the Hearing Examiner's decision to confirm for yourself that the operation, including the scale house, are approved uses. Even if the use was nonconforming, the scale house is a part of what was approved and is lawful. Port Orchard Sand & Gravel is certainly willing to process the building permit application as evidenced by its timely submittal. As you know, the scale house is a commercial coach bearing an insignia issued by the Washington State Department of Labor and Industries. As a result, it is subject to RCW 43.22.410 which reads: "Any mobile home, commercial coach, conversion vending units, medical units, recreational vehicle and/or park trailer that meets the requirements prescribed under RCW 43.22.340 shall not be"required to comply with any ordinances of a city or county prescribing requirements for body and frame design, construction or plumbing, heating and electrical equipment installed in mobile homes, commercial coaches, conversion vending units, medical units, recreational vehicles, and/or parked trailers." Therefore, we, do not believe the plumbing provisions of county codes can be made applicable to this building. In any event, Port Orchard Sand & Gravel has a maintenance contract for the portable toilet that serves the building. Even if the above provision were not applicable, the maintenance contract and use of the portable toilet should qualify as an alternate method of achieving the end sought by the provisions of the International Building Code. Dear William T Lynn: A copy of Chapter 29,Washington State Amendment to the 2003 International Building Code(IBC)is enclosed. The chapter addresses plumbing system requirements. Note that Section 2902.2.2.1 specifies that plumbing fixtures shall be located in each building or conveniently adjacent thereto on the same property. Section 2903.3 specifies that each required sink,lavatory, bathtub and shower shall be provided with hot and cold running water necessary for its normal operation. Note that our office is not requesting that the structure be altered. Our office is requesting information that demonstrates compliance to the referenced code requirements. Included in the enclosure find Section 2902.1.1,second paragraph;"plumbing fixtures need not be provided for unoccupied buildings or facilities."You may find this code section helpful if the applicant can demonstrate that the building is not normally occupied. It does not appear that the code section is applicable based upon the information that was provided with the submittal documents. The particular project includes a gold label modular unit to be used as a weigh shack, occupied by staff for various periods during the day and during inclement weather. Has Pierce County developed a policy that addresses when sanicans would be allowed in lieu of plumbing fixtures equipped with hot&cold running water as required in Washington State Amendment, Chapter 29.? If you have a process or policy in writing it would sure be nice to have. The inspection fee will be as set forth in the adopted fee schedule by Mason County for site inspections/site investigations. 14.17.030 - When required by the Fire Marshal, approved signs or other approved notices shall be provided and maintained for fire apparatus access roads to identify such roads and prohibit the obstruction thereof. 14.17.040 - Roadways shall be constructed/designed with an all-weather driving surface (gravel, crushed rock, concrete or asphalt) and the ability to support the imposed load requirements of fire apparatus. 14.17.050 - Fire apparatus access roads shall extend to within 150-ft. of all portions of the exterior wall of any residential or commercial structure, and within 50-ft. of at least 25% of the exterior wall of any commercial structure. 14.17.060 - A fire apparatus access road shall be a minimum unobstructed width of 20-ft. for commercial structures, or 4 or more parcels or building sites. The access road may be reduced to 12-ft. of unobstructed width with a minimum 10-ft.wide driving surface for 1-3 parcels or building sites on approval of the Fire Marshal. 14.17.070 - A fire apparatus access road shall have an unobstructed vertical clearance of not less than thirteen feet and six-inches (13'6") for the full width of the road. 14.17.080 - A 10-ft.wide fire apparatus access road exceeding 300-ft. in length will be required to make provisions for the passing of fire apparatus by providing approved pullouts. Pullouts shall be reasonably located,based on sight distance, road curvature, and grade; and shall be a minimum size of 8-ft.wide and 30-ft. long with tapered ends. See exhibit A—HammerHead Turn Around,B—Modified Hammer Head, C- Cul De Sac Turn Around, D &E—Pullouts, for examples of accepted turnarounds and pullouts. 14.17.100-The turning radius of a fire apparatus access road shall be a minimum of 25-ft.interior, 45-ft.exterior centerline radius. 14.17.110-A fire apparatus access road,which is newly constructed or existing, and which is in excess of 14% grade, and which is greater than 150-ft. from a primary access point intersecting with a County or State road Right of Way, to new residential or commercial structures will require an automatic fire sprinkler system to be installed. 14.17.120-Where more than 50 units are designed in a residential development, either single family, multifamily, retirement or similar,there shall be a minimum of two access points to the county road system. Such access points shall be located so as to provide for general circulation, alternate emergency vehicle access routes, through access, and general transportation design considerations. One of these access points may be for emergency vehicle use only where the number of units does not exceed 100. Design of an"emergency vehicle use only"access must be approved by the local fire district and Fire Marshal. 14.17.130- When buildings are completely protected with an automatic fire sprinkler system, the provisions of these standards maybe modified by the Fire Marshal. 14.17.140- When a bridge is required as part of a fire apparatus access road, it is to be constructed and maintained in accordance with nationally recognized standard. It shall have designed live loading capacity sufficient to carry the imposed load of fire apparatus. An evaluation by a professional engineer will be required to determine the imposed load rating for all of the responding fire districts fire apparatus and shall be approved by the Fire District and Fire Marshal. 14.17.150- When access roads cannot be installed to these standards due to topography, waterways, nonnegotiable grades or other similar conditions, the Fire Marshal is authorized to require additional fire protection or mitigation as specified in Section 1001.9 of the UFC (See 2006 IFC 901.4.3). The Fire Marshal may also approve access roads that do not meet these requirements if the road provides reasonable access under the individual facts of the case. 14.17.160-Approved numbers or addresses pertaining to any and all new commercial or residential buildings shall be placed consistent with Chapter 14.28, Addressing Ordinance. 14.17.170—Traffic calming measures on fire apparatus roads(speed bumps, etc) shall be approved by the Fire Marshal before installation. Y PORT ORCHARD SAND & GRAVEL PROPOSAL FOR SCALE BUILDING We do not believe that the Scale Building requires plumbing facilities for two independent reasons: First, Section 2902.1.1 of the 2003 International Building Code provides: "Plumbing fixtures need not be provided for unoccupied buildings or facilities". This particular building is not normally occupied. It accommodates scale equipment and a refrigerator. It provides a space for the odd occasion when plans might need to be reviewed during inclement weather. It should be noted that this is a surface mine, not involving building construction, and so plans are infrequently consulted. Occasionally, the employees might spend a half hour eating lunch inside on a particularly bad day, just as they might find refuge in a shed or other building not normally occupied. We also note that there are a number of days during the year when no one would use the facility at all. The scale equipment can be read from outside the building and so entry is not normally needed for the primary purpose of a scale house. A second independent reason why the plumbing should not be required can be found under the provisions of the IBC allowing for alternate methods to achieve the goal of the requirement. The building is a temporary one and will not remain on the property after the mine is reclaimed. For that reason, we have provided a portable toilet and that facility is maintained under a contract with a local service provider. This method meets the purpose of the Code in requiring plumbing facilities while at the same time recognizing the temporary nature of the building. We note that this method of approval is used in other jurisdictions and have enclosed a permit for a Miles Sand and Gravel facility in Pierce County where a building permit was issued based on this very same kind of arrangement. Although we have not done extensive research, we believe that this same approach is followed elsewhere. Certainly it is not the norm to provide indoor plumbing with septic tanks and drainfields for these kinds of "construction shack-type" uses.
