SUBJ: Stormwater Clearing Requirements NAME: Olson; ENF2002-00141
Under the requirements of the County's Stormwater Management Ordinance (Mason County
Ordinance No. 141-97), land disturbing activities(including grading&clearing)of 1 acre or
more, are required to have a Large Parcel ESC (Erosion and Sediment Control) Plan, and a
Permanent Stormwater Quality Control Plan (PSQC)prepared for the proposed activity. These
two plans are collectively termed a Stormwater Site Plan(SSP). The SSP is required to be
prepared and stamped by a licensed Civil Engineer. The SSP is required to be implemented
through the various stages of site development.
Typically the requirements of Mason County's Stormwater Management Ordinance are called
into effect when either the planning department or the building department are contacted
regarding other County permitted activities. The lack of any other County permit requirements
does not relieve an activity from the County's Stormwater Management Ordinance.
The County's Stormwater Management Ordinance is administered and enforced by the Public
Works Director. The Director has the authority to serve a stop work order if an action is being
undertaken in violation of the Ordinance. Failure to comply with the terms of a stop work order
shall result in an enforcement action including, but not limited to,the issuance of a civil penalty
which shall not be less than $ 50.00 or exceed $ 100.00 for each site per day.
The activities you described sound as thou a Stormwater Site Plan should have been prepared

for the clearing because it encompasses an area greater than one acre.
If you have found the above cited enforcement activity to be in violation of these requirements,
please provide the name of the owner and his mailing address and Public Works will contact him
or them as stipulated in the County's Stormwater Management Ordinance.

Could you provide a formal response to this question for inclusion in my enforcement
file?
Could an County
based stormw Y ater review/enforceme
nt take place against a 1.7 acre
parcel that was completely cleared of all vegetation? The runoff is culverted under
Pickering Road and into the complainant's ditch. I do not have any Planning Department
review authority as the site is fairly flat with no evident critical areas. As the clearing is
under the 2 acre minimum for referral to DNR, I am wondering if any County level issues
exist. Thanks for your help.
