Dear Ms. Wing:
The Washington State Department of Transportation(WSDOT)has reviewed
the applications for the proposed Renaissance Faire&Extreme Sports
Festival events.These events are to be held on the property owned by
Gregg E. &Elisa K. Paisley located in the 4900 block of SR 3 mile post
7.75, left vicinity.The Renaissance Faire is scheduled for August 30
and 31, 2008 with an expected attendance of 5,000 to 10,000.The Extreme
Sports Event is scheduled for September 27, 2008 with an expected
attendance of 1,000 to 2,000.
WSDOT has serious safety and operational concerns with regards to the
impacts to SR 3 that will result from these events.The Renaissance
Faire is the most significant concern due to the expected attendance
levels and in that it will be held on Labor Day weekend. We are
requesting that the County require and condition the applicant and/or
property owner to provide WSDOT with Traffic Control Plans for each of
these events.These plans must be prepared by a licensed professional in
accordance with WSDOT's requirements. In the case of the Renaissance
Faire the plans are due to WSDOT for review no later than August 15,
2008.The due date for plan submittal for the Extreme Sports event will
be September 12, 2008. All submittals should be sent to my attention.
WSDOT will notify the State Patrol of these events.The County should
expect contact by the State Patrol directly or through WSDOT and they
may have requirements in addition to WSDOT's.
We respectfully request that the County not issue the permits for either
one of these events until the Traffic Controls Plans have been approved
by WSDOT.

Dale,attached is the corrected TCP in regards to WSDOT comments, and an
alternative TCP for two access points. The second access point is
approximately 500 feet NE of the existing access,slightly beyond the crest
of a vertical curve.
I think the twin-access strategy will work better. Note that I've reduced
the stoppage time to a maximum of 3 minutes-and I don't think that traffic
will need to be stopped for even that amount of time. The flaggers are
mostly there for safety. Flagger D, in the middle,alerts approaching
drivers if someone turning left is waiting for traffic to clear(that's why
they're at the crest of the vertical curve). Flagger C can stop traffic
during peak egress. Flagger B can stop traffic if a large left-turn queue
builds up. I would anticipate the average stoppage time to be no more than
1 minute,even less-similar to a signal.
If the Do Not Enter, by itself, is not sufficient for WSDOT then a Wrong Way
sign can be added. However,the MUTCD doesn't require a Wrong Way sign.

Though it is possible the Commissioners were not made aware of this by
staff,this attachment verifies what I was trying to tell everyone: On Sept
2, WSDOT sent MC Planning, my engineer, and me an *"Approved as Noted" *Traffic
Control Plan. Note it is stamped "Approved as Noted"and signed by a WSDOT
traffic engineer.
i.e. We already had an approved WSDOT traffic control plan a week before the
Commissioners Sept 9 meeting and MC Planning knew it, or should have known
it. All that WSDOT was requiring was(by Sept 16th)for their notes be
incorporated into a clean copy. We did that two days ago and also submitted
additional plans to WSDOT for a possible second access. But it is a
documented fact that we had an Approved WSDOT plan in hand at the moment the
Commissioners denied our application, citing WSDOT as the primary reason.
If our plans, with the noted revisions, were acceptable to WSDOT, why would
they not be acceptable to Mason County?

Hi All:
The Mason County Commissioners have denied the applications for the 9/08
Extreme Sports Festival and the 10/08 Renaissance and Fantasy Faire
events to be held the Avery Township/Gregg Paisley site (attached).
If you receive any inquiries concerning the County's actions from Gregg
Paisley or his consultant John Heinley I would recommend that you ask
them to contact the County Commissioners Office. The County has the lead
on this now- not us. I will be on vacation until Monday, 9/22 but the
developer and his consultant have everything they need right now from us
and due to the denials by the County any business they have with WSDOT
can wait until my return.

The Washington State Department of Transportation(WSDOT)has reviewed the Notice
of Application and supporting documents for the Paisley rezone and campground
development located at 4911 East State Route 3. It is our understanding that this
proposal is also currently being reviewed under a non-project action State Environmental
Policy Act(SEPA)Determination of NonSignificance.
The applicant does not have a permitted access to SR 3 for the site property. WSDOT
will require that the applicant apply for an Access Connection Permit. It also appears
that the applicant is proposing improvements to SR 3. Any improvements to SR 3 will
require review by WSDOT through the Developer Agreement process. Please have the

Thank you for contacting our office concerning your proposed campground and
resort development located approximately five miles north of the City of Shelton and
west of SR 3. The Washington State Department of Transportation(WSDOT)is
requesting that you provide the following information on your proposed
development:
• The deed documents that demonstrate either that you own the property where
the existing driveway is located or that you have easement from the adjacent
property owner(s) for use of this driveway. The referenced driveway
connects with SR 3 in the vicinity of mile post 7.78,left vicinity.
A traffic trip generation and distribution report for the build-out of your
proposal. Please be advised that WSDOT may request a Traffic Impact
Analysis at a later date.

Dear Ms.Hess,
Thank you for your help with my project that connects with SR3. Enclosed find the remaining
documents requested in your letter dated March 30,2007. To summarize your request:
1. You asked for the deed documents that show my ownership of the parcels and easement in
question. I emailed these to you previously and copies are enclosed.
2. Enclosed is a traffic trip generation and distribution report,both for the single event in 2007 as
well as projections for subsequent years to the extent such projections are possible.
3. Enclosed is a sight distance analysis. This shows a sight distance of 517 feet in the
constrained direction(looking north towards the crest)and over 1500' in the unconstrained
direction.
4. Enclosed are the details of that portion of the project currently undergoing permit review by
Mason County. There are additional structures/land uses/attractions planned but future
elements but these all require variances or special permits or quasi-judicial review or are subject
to special technical review(e.g. geo tech). So it cannot be known at this time what will or won't
be approved.
5. Additionally I have enclosed detailed measurements of the access connection as well as
photos. I am very concerned about safe and efficient access to SR3 and I hope WSDOT will have
ideas how I can best improve access.
On the latter point,I should mention that though SR3 is my sole ingress and egress point at this
time,I expect to eventually purchase adjacent parcels that might provide access to County roads
(Greenview Lane)and additional access points to SR3 (perhaps one or two driveways to the
north). I should know more later in the year, so it might be helpful to sit down with WSDOT and
learn what best practices can be applied,both for the existing access and for possible future
additional access points.
In the meanwhile,I included three ideas that might ameliorate access problems and minimize
traffic disruption. See the driveway drawing for details.
I have submitted a permit application and enclosed a check. Here is my thinking as to possible
next steps. These three facts are key: 1)There is only one,brief event in 2007 and it will
generate negligible traffic(see details on trip generation report),2)the larger attractions(e.g.
Shakespeare Theater,Jewel Auditorium,Farmers Market,Amphitheater,et al)that will generate
the bulk of traffic in subsequent years haven't yet been submitted to the County for consideration
and none will be ready before mid-2008,3)It is possible that I might acquire additional
properties with road access as early as summer,2007.
Consequently,perhaps WSDOT might wish to limit its involvement with my project in 2007 to
simply helping me improve safety for this year's event(July Wh),perhaps by authorizing the easy
improvements noted on the driveway drawing or whatever else you would like to see done. Then
this fall,after I have a better handle on what 2008-forward.will look like for trip generation and
for alternate access points,we can reconvene and agree on further modifications or
improvements.

The driveway shown below has been in existence and unaltered since State Route 3 was built in its
present location. The driveway and adjacent banks are stable with no drainage problems. Due to the 15%
slope, drainage is quickly and thoroughly accomplished with shallow ditches on each side of the
driveway that flow down to the ditch on SR3. Even during the wettest weather(such as last year)
water flows unnoticeably and without creating bog or mud areas. In winter, no standing water has been
observed in the SR3 ditches, due to the slope of SR3 and infiltratable soil.
If the driveway was modified as proposed on the enclosed driveway drawing, this would simply push
the driveway ditch 25'north where it would retain its slope, shape, and drainage flow and characteristics.
The newly-carved embankment would be replanted with native vegetation. If a turn-out lane is create
as proposed over the SR3 ditch to the north of the driveway, then a curtain drain(connected to the
culvert) could be installed where the widened shoulder meets the bank. This same curtain drain would
be enlarged with rip rap where the driveway ditch reaches the bottom.

Between now and May, 2008, there is only one event scheduled, a kids music camp. It
consists of four consecutive sessions, each lasting six days. It commences Saturday July
8`h and ends Sunday, August 4`h, 2007.
The camp has been operating for 34 years at a different site. Every year 550—600 kids
sign up. This year is already 70%booked and enrollment will close at 600. Parents drop
kids off on a Sunday between noon and 6pm and pick them up the following Saturday
between 9am and 3pm. Thus, for 2007 through May, 2008 there are only eight, six-hour
windows where traffic will materially increase in the access connection driveway.
In addition to the students/campers there are 60 instructors. They stay the entire month,
filtering in the week ahead of camp and filtering out the week after.
Trip Generation, 7th Edition, Institute of Traffic Engineers (ITE), does not provide a land
use comparable to this sort of camp. However, in this case the maximum number of
attendees is precisely known, as is their arrival and departure windows, and carpooling/
busing habits.
Attached is Table 1, showing anticipated traffic for the camp.
Based on Table 1, the increase in traffic of SR3 will not be material, in part because the
overall traffic generated by the music camp is small,but also because it occurs on a
Saturday and Sunday.
From the data below, it can be reasonably surmised that weekend traffic at mile 7.78 is
7% lower than weekday traffic, a reduction of 910 cars per weekend day or 1820 for the
weekend. The total number of cars visiting the music camp will be approximately 120
per weekend day or 240 for the weekend. Thus, even with the increase in music camp
traffic, overall traffic on SR3 will still be 6%below weekday averages.

The project will be built in phases over the next five or so years. Each year,new
structures, features, and attractions will be added. However, at this time it is impossible
to accurately establish the timeline or development details (including the resultant traffic)
since there are numerous County approval processes that must first be undertaken.
In addition,the nature of the project is so unusual,both in its individual elements and
taken as an eventual whole,that Trip Generation, 7th Edition, (ITE) provides no
comparable land use categories. However,the following categories provide partial
comparability.
Resort Hotel (330). One part of the project that is today under review by the County and
likely to be approved is the camp structures. There are 24 sleeping rooms being built for
2007 with another 24 for 2008. These 48 rooms will eventually also host corporate
retreats, usually Monday—Friday,when camps(such as the 2007 music camp)are not in
session.. So Land Use 330 bears some comparability, albeit marginal because of lack of
amenities(e.g. cocktail lounge), old-world theme(no technology), and the fact that
people will tend to remain on-site for the duration of their stay(typically 2—5 days)with
little come-and-go in vehicles.
Using Occupied Rooms as the variable and the minimum rates (defensible given lack of
amenities, etc.) and average rates for Weekday/A.M. /P. M. Peak Hour of Generator:
A.M. Peak Hour of Generator;
48 Rooms x minimum rate .34= 16.32 trips
48 Rooms x average rate .47 =22.56 trips
P.M. Peak Hour of Generator:
48 Rooms x minimum rate .36= 17.28 trips

Campground/RV Park(416). The only other part of the project that has been
submitted to the County for review is a request to have 80— 150 primitive camping sites
dispersed through the forest. This will come up for approval later in the year and may be
ready by June 2008. There are no RVs involved and people must hike into their sites,
thereby reducing likely come-and-go in vehicles, so it is reasonable to include the
minimum rate along with the average rate. Taking 100 primitive camping sites as X.
(Note: Land Use 416 trips should not be added to trips from Land Use 330 because most
camping occurs on weekends while most corporate retreats occur on weekdays. Also,
these trips should not be added to music camp trips(Table 1)because for the security of
the kids general camping will not be allowed when camps are in session.

Live Theater(441). By 2009,it is expected that a live theater will be approved and
constructed so this land use is included here. However,the trip generation rate is
obviously too low for this project since the reference study was conducted in suburban
NYC where mass transit is prevalent.
Assuming an audience of 1000 as X:
Weekday P.M. Peak Hour of Adjacent Street Traffic:
1000 attendees x .02 =20 trips.
Arena(460). By 2010 the project expects to have approved and constructed an indoor
auditorium. However,the 40,000 square foot footprint that will be requested is 400%
larger than what zoning allows so a variance will be sought. When and if approved, and
actual square footage is known, a trip generation report will be produced for this land use.
Amusement Park(480). By 2009,various pieces of the project, if approved,will
resemble the ITE description of an amusement park and a trip generation report will be
produced for this land use.
Recreational Community Center Park(495). No comparability: this category is for
YMCAs and the like.

1. I learned from Mason.County this morning that WSDOT has raised SEPA issues. Phase 1 of my
project(1 kitchen/shower,2 bunkhouses, 39 parking spaces, 10,800 sf) is exempt from SEPA. In
talking with the County today, they confirmed that my Phase 1 plans--the only plans under submission
at this time--do not appear to trigger a SEPA review.
As the WSDOT Development Services Manual, Section 3.1.09 states, the threshold for a SEPA
review is by default the minimum flexible threshold unless a County,by resolution, opts for an increase
up to the allowable maximum. Mason County has opted for the maximum threshold: Mason County
Code: 8.16.020: Flexible thresholds for categorical exemptions. (a)Mason County establishes the
following exempt levels for minor new construction under WAC 197-11-800(1)(b) based on local
conditions: (3)For office, school, commercial, recreational, service or storage buildings in WAC 197-
11-800(1)(b) (iii): Up to twelve thousand feet and up to forty parking spaces.
My current submissions are so close to the limit that it is inevitable that a SEPA review will be
triggered when I submit additional building applications to the County,probably in 2008 or later.
However, as stated in the letter that accompanied my access permit application: the attractions that will
eventually generate the bulk of the traffic haven't been submitted to the County and approval of same is
by no means certain if and when I do eventually submit them.
2. One factor that may have led WSDOT to assume I triggered the SEPA threshold is that I have 4
bunkhouses being reviewed. But the County knows,though WSDOT probably doesn't,that only 2 are
slated for construction now and the other two are included on a"Stock Plan" application for future
permitting. This is a County program that avoids redundant reviews of identical structures. In this case,
the County is switching from IBC 2003 to IBC 2006 in July, so they required me to submit all
bunkhouses together if I wished to take advantage of the Stock Plan program. But site plans on file with
the County clearly note that only 2 bunkhouses will be constructed at this time.
3. Today I told the County I currently have a valid access permit under RCW 47.50.080(2),which reads
"...Access connections to state highways identified on plats and subdivisions approved prior to July 1,
1991, shall be deemed to be permitted pursuant to chapter 202, Laws of 1991..." Further, WAC 468-
51-120 (1) "...All connection permits issued by the department prior to the effective date of this chapter
remain valid until revoked..." Finally,WAC 468-51-030(1) states: "...Ifa property owner orpermit
holder who has a valid connection permit wishes to change the character, use, or intensity of the
property or development served by the connection, the department must be contacted to determine
whether a new connection permit would be required...." To prove my assertion to the County that I
already have a valid access permit I am sending them the same documentation(pre-1991 recorded
easements and current deeds)previously submitted to WSDOT.
4. I initiated communication with WSDOT on this project in February, 2007, immediately after my

rezone was approved. I subsequently submitted an application dated May 7, 2007 to upgrade the access
permit, should WSDOT deem an upgrade necessary. No actual change in use or traffic has yet occurred,
no modifications to the access have been made, and I have submitted an application, so under RCWs&
WACs there is no grounds for revoking the existing access permit. Therefore: I have now, and will
continue to have, a valid access permit until such time as WSDOT proposes requirements, if any,
to upgrade the permit and I carry out those requirements. At that time I will have an upgraded
permit,with no gap in-between permits. If WSDOT does not agree with this contention,please say
so and point me to the applicable RCWs/WACs.
5. Consequently,I request WSDOT now confirm to Mason County that I do indeed have a
current access permit and that an upgraded permit is in process. I believe this will satisfy the
County so they can release the hold on my permits caused by WSDOT actions.
6. I should reiterate that at this time I am seeking only a Category I permit(minor connection). i.e. I
now have a Category I permit and wish to stay in Category I which tops out at 99 AWDVTE. That is
the box I checked on the application and why I paid the appropriate$500 fee for Category I. 99 or less
AWDVTE will meet my needs for at least the next 18 months and it is premature for me to forecast
traffic beyond that. As noted in the Trip Generation Report: "...June 2008—forward: The project will
be built in phases over the next five or so years. Each year, new structures,features, and attractions
will be added. However, at this time it is impossible to accurately establish the timeline or development
details (including the resultant traffic)since there are numerous County approval processes that must
first be undertaken..."
Thus it would be unwarranted for WSDOT to make any assumptions as to my future traffic or to
propose to elevate my permit to Category II since no one knows what will or won't happen with Phase 2-
and-beyond applications.
7. SR3 at my driveway is a Class 2 highw�y so all permits are,by law,Nonconforming. WAC 468-51-
100, (Nonconforming Connection Permits), states: " (1) Traffic volume. The maximum vehicular usage
of the connection shall be specified in the permit..." So to make it easier on WSDOT,the County, and
me by maximizing the threshold that triggers a revisit,I wish to amend my access permit application
to request a Category I permit for 99 AWDVTE which of course will be legally binding on me
under WAC. This is substantially above the 10 -40 (25 typical)current and anticipated AWDVTE
levels but provides room to grow and to accommodate spike usage.
Thereafter, any number of occurrences will cause us to revisit the access permit: Eventual additional
County approvals in advance of build-out, acquisition of adjacent properties,unexpectedly high loads
with existing facilities, etc.
8. You asked who prepared the Trip Generation Report, Sight Distance Analysis, et al. Under WAC
468-51-060, an engineer stamp is required for Category II &III traffic data but not for Category I, so I
prepared the documents myself and any questions should be directed to me. Also, the reason I did not
provide drainage calculations is that, if my neighbor's recollection is correct,WSDOT built my
driveway as part of the SR3 relocation project. So please check WSDOT records for those calculations.
I can do them for WSDOT if your records are incomplete or if I am in error as to the the history of the
driveway. Also, I can calculate the additional flows if you wish me to improve/enlarge the driveway as
proposed.
Ms. Hess,your DSM 2.2.09 notes: "WSDOT has increased its commitment to work closely with...the
general public." I can see from your efforts that you take that commitment seriously and, and as noted
in a previous letter, you are a credit to your agency. You will find I too work hard to communicate,
cooperate, and devise win/win solutions. With this project,beyond the relatively simple Category I
application presently under review, I would welcome meeting(s)to lay out a game plan for the next few

The Washington State Department of Transportation(WSDOT)has reviewed the
Traffic Impact Analysis(TIA)and interim event Traffic Control Plan for the Avery
Township development. As indicated in our July 30,2008 correspondence WSDOT
has significant concerns with regards to safety and operational impacts to SR 3 that
will result from this development.
This letter outlines WSDOT's requirements for the construction of necessary
improvements to SR 3 to accommodate traffic to and from the developed site and for
the interim traffic control plans for events scheduled in September and October 2008.
Traffic Impact Analysis
The TIA describes the development as a recreation destination and event resort.
Total trip numbers,the timing of peak hour trips and distribution vary depending on
use and event types and schedule. The following improvements to SR 3 should be
constructed to accommodate this development:
• Construction of a northbound left turn lane and southbound right turn lane on
SR 3 are warranted. Associated illumination and access design will be
required as part of these improvements.
• Construction of these improvements must be done in accordance with
WSDOT standards and specifications and will be subject to review and
approval through the"Developer Agreement"process managed by our office.
All improvements must be constructed by October 1, 2009.

Traffic Control Plan
Traffic control is an interim and temporary means of managing traffic for events at
this location and is subject to WSDOT review and approval on a case by case basis.
The Traffic Control Plan(TCP)has been reviewed for use only with the September
27, 2008 Extreme Sports and October 4'h and 51h 2008 Renaissance Fair events. To
implement the proposed TCP for these two events WSDOT will require the
following:
• Two lanes of traffic to and from the site to SR 3 must be established. Pull
outs may not be used. The owner is responsible for obtaining any necessary
easements,permissions and/or approvals from adjacent property owners.
• The TCP must be revised as shown on the enclosed plan and re-submitted to
WSDOT for review and approval. To enable sufficient review and approval
time to accommodate the September 27, 2008 event schedule these revisions
must be submitted to WSDOT no later than September 16`h,preferably
sooner.
• If two lanes of traffic cannot be established the TCP as revised must be
implemented and a maximum of 100 vehicles may be at the site at any given
time. Allowing more than 100 vehicles on the site with only a one lane
access will result in significant delays and backups on SR 3. The owner will
be responsible for ensuring this limit is not exceeded.
• An insurance bond in the amount of$2 million for each event must he
provided.

Dear Ms.Wing:
The Washington State Department of Transportation(WSDOT) has reviewed
the applications for the proposed Renaissance Faire&Extreme Sports
Festival events.These events are to be held on the property owned by
Gregg E. &Elisa K. Paisley located in the 4900 block of SR 3 mile post
7.75, left vicinity.The Renaissance Faire is scheduled for August 30
and 31, 2008 with an expected attendance of 5,000 to 10,000.The Extreme
Sports Event is scheduled for September 27, 2008 with an expected
attendance of 1,000 to 2,000.
WSDOT has serious safety and operational concerns with regards to the
impacts to SR 3 that will result from these events.The Renaissance
Faire is the most significant concern due to the expected attendance
levels and in that it will be held on Labor Day weekend.We are
requesting that the County require and condition the applicant and/or
property owner to provide WSDOT with Traffic Control Plans for each of
these events.These plans must be prepared by a licensed professional in
accordance with WSDOT's requirements. In the case of the Renaissance
Faire the plans are due to WSDOT for review no later than August 15,
2008.The due date for plan submittal for the Extreme Sports event will
be September 12, 2008.All submittals should be sent to my attention.
WSDOT will notify the State Patrol of these events.The County should
expect contact by the State Patrol directly or through WSDOT and they
may have requirements in addition to WSDOT's.
We respectfully request that the County not issue the permits for either
one of these events until the Traffic Controls Plans have been approved
by WSDOT.
