SEE IMPORTANT GENERAL PROVISIONS ON REVERSE SIDE THAT ARE ALSO PART OF THIS APPROVAL. GENERAL: 1. Work shall substantially conform to plans and specifications sub- mitted to the Department of Wildlife with the Hydraulic Project Application except as modified by this approval. This approval is for the removal of approximately 80 feet of culvert and for the relocation, restoration and mitigation of this stream reach to reproject condition. This Approval also allows for the removal of two culverts under the driveway to be replaced with one culvert, the upstream end to be aligned with the relocated stream reach directly upstream. There shall be no stream relocation down- stream of the drivewa and no culvert placed on the east side of the property adjacent to the post office parking lot. The project shall be accomplished in two phases. The 80 feet of culvert shall be removed and the channel relocated and restored rior to the installation of the culvert under the driveway. A emporary bypass shall be constructed, like a sandbag revetment or similar device, at the downstream end of the relocated channel to prevent stream flow from entering the work area when the culvert is installed under the driveway. The bends in the channel located between the post office culvert and including the bend 45 feet from the Douglas fir tree shall be greater than 110 degrees so as to create gentle bends. The relocated channel shall have the capacity and channel shape , similar to re-proj]ect conditions. Stream width shall be a minimum of five feet, not to exceed ten feet. Slope of the banks shall not be reater than one foot of rise for every two feet of horizontal dis ance. A minimum of 15 feet of horizontal distance shall be retained in native trees shrubs, forbs and sedges as a streamside buffer for erpetuit the gravel file located on site shall be mixed with top soil �o provide an appropriate planting substrate for the banks and to prevent water see age out of the stream. This material may be urchased or found on he upland portion of .this propert only �ive cubic yards may be used from the wetland area adjacen to the work site. This approval does not authorize dredging of the wetland. 2 . EQUIPMENT LIMITATIONS: 3 . Drive mechanisms of wheeled or tracked equipment shall not enter the wetted perimeter. Equipment shall be cleaned prior to beginnin this project. Equi ment shall be properly maintained to prevent petroleum products Trom entering the water. OPERATION: 4 . All work shall be accomplished during a low flow period. All work shall cease during periods of high flows or muddy working condition that could result in the addition of sediment to the stream. 5. Erosion control methods shall be utilized to prevent siltation. These may include, but are not limited to, straw bales filter fab- ric, temporary sediment ponds, check dams, and immediate mulching of exposed areas. 6. Extreme care shall be taken not to disturb, damager destroy any of the existing trees, brush, shrubs, grasses or otheor streamside vegetation. 7 . Under no circumstances is there to be created a block to stream flow or fish passage. 8 . During construction the new channel shall be isolated from the flowing stream by pugs at the upstream and downstream ends of the new channel. The new channel shall be constructed in the dry. The same process shall be used for the installation of the :Avert. There shall be no excavation in flowing water. Since the culvert closest to the post office parking lot needs to be removed prior to construction of the final bend, a temporary bypass shall be con- structed diverting the flow so the culvert can be removed. Before water is diverted into the permanent new channel or into the culvert, all bank protection or armoring shall be completed to pre- vent erosion. On outside of bends, rocks of not less than one person size and angular in shape shall be used to armor the bank. 10. Diversions of flow into a new channel shall be accomplished by: �a� First removing the downstream plug; b removing the upstream plug; and kc) closing the :upstream end cf the old channel . The same process shall be used for the installation of the culvert. 11. Filling of the old channel shall begin from the upstream closure and the fill material com acted. Water discharging from the fill shall not adversely impact fish life. 12 . The angle of the structure used to divert the water into the new channel shall allow a smooth transition of water flow. SITE RESTORATION: 13 . After completion of the permanent new channel and filling of the old channel all stream banks shall be revegetated with native plants adapted to stream banks, such as cottonwood alder willows, redosier dogwood. Shrubs such as salmonberry shall be established immediately above high water mark and spaced not more than three-foot-square spacing thoughout the 15-foot steamside zone. Trees shall be established every 10 linear feet. Forbs and sedges shall be established throughout. Cuttings, seedlings or nursery stock may be used. Plants shall be established before the end of the next planting season or not later than May 31 , 1994 and shall be maintained for two years to ensure the survival of 90% of all plants evenly distributed throughout the streamside zone. 14 . All waste material such as construction debris, silt, excess dirt or overburden and temporary fill used to provide access resulting from this project are to be de�osited outside of the streamside zon in the '.:plands, not In the Wet.and. Dear Mr. Manassee: This letter is my summary of discussions held in the field with you on March 18, 1993 in Belfair. Al Wald, of the Floodplain Section, Ann Remsberg of the Wetland Section and I met with you to inspect two sites. Site #1 was adjacent to the Belfair Post Office and consisted of a small wetland associated with the creek. Both the wetland and the creek channel had been partially filled. One of the creek channels had been routed through a large plastic culvert. Another smaller channel had a perforated pipe placed in it that may or may not transport water under the fill to the larger channel adjacent to the wetland. We determined that the wetland could not be called a wetland associated with Hood Canal because it did not meet the tests of proximity and influence. The creek is a tributary to the wetlands associated with Hood Canal but is too far away and separated by a steep gradient between this small wetland and the larger wetland complex. Al commented that the perforated pipe was too small to carry the water that had previously flowed through the small channel and was likely causing a backwater effect. He recommended reopening the channel. He also expressed concern about whether the large plastic culvert that is taking the main channel flow is sized appropriately for high flow events. Ann noted that the filling activity that occurred on this site may be a violation of the Clean Water Act and an Army Corps of Engineers permit may be needed for that work. Individual wetland fill permits are needed for any amount of fill into wetlands that the Corps considers to be adjacent to other waters. If the flow of the creek at that point is 5 cubic feet per second (cfs) or more, the Corps would most likely consider those wetlands to be adjacent. Al noted that the flow could be close to 5 cfs. The Corps ought to be notified of this activity. The number for their Seattle regulatory branch is (206) 764-3495. Site #2 was the Jack Johnson site adjacent to the Byerly site. The proposal apparently involves placing construction debris on approximately one acre of upland directly adjacent to a wetland that is considered associated with Hood Canal. Mr. Jason Manassee Page 2 April 7, 1993 Concerns expressed by Ann and Al included the need for a buffer of 50 to 100 feet between the wetland and the landfill. The larger buffer is strongly recommended given the sandy soils present on the site that could allow leachate to enter the wetland. Because the wetland is part of a large, diverse wetland complex, there should be adequate buffers on at least three sides.
