Joint Use Agreement
This agreement entered into by and between the McCormick Family, LLC, a Washington
limited liability company(hereinafter"McCormick Family") and Diane Patricia Tarr, a
married woman, as her separate estate, Dana Tefft Strandjord, a married woman, as her
separate estate, and Paul Leslie Tefft, a single man (hereinafter"Tefft Family")
WITNESSETH
McCormick Family, LLC, a Washington limited liability company is the owner of
property described as the "McCormick Property"the legal description of which is
attached as Exhibit "A"hereto, and Diane Patricia Tarr, a married woman, as her separate
estate, Dana Tefft Strandjord, a married woman, as her separate estate, and Paul Leslie
Tefft, a single man, are the owners of property described as the "Tefft Property"the
legal description of which is attached as Exhibit `B"hereto, incorporated by reference as
though fully set forth herein;
The parties will build and maintain a dock facility approximately 115 feet by 48 feet
consisting of a pier, ramp and float to provide recreational opportunities and private
vessel moorage in Hood Canal, and such facility will be located on portions of the
respective property of the parties hereto; the parties hereto further agree that the initial
design and construction will be agreed upon and that the initial costs of construction shall
be joint and equal;
The "McCormick Property" owners and the "Tefft Property"owners hereby grant to each
other for"joint use" an easement for placement, use and maintenance of the dock facility
and such area of their respective properties as reasonably necessary for the use and
enjoyment of the dock facility, such easement to be appurtenant to the properties
described above and to run with the land;
The parties hereto agree that the facility shall be used by each and their guests in a
reasonable manner and consistent with the use of similar facilities;

Second Page/Joint Use Agreement
The parties hereto agree that any alterations made to the facility will be done only with
joint agreement and with a joint and equal sharing of costs;
The parties hereto agree that the maintenance of said dock facility will be joint and equal.
The decisions regarding maintenance shall be agreed upon as well as distribution of cost
and responsibility for providing such maintenance. In the event that maintenance or
repair is required on the dock in order to maintain the dock in a safe condition, which
shall be defined as a condition necessary to meet code requirements, every effort shall be
made by the parties to reach agreement on cost and the type of work. If one of the parties
refuses to participate or pay for the cost, then the party that pays for the cost of the
maintenance shall have a lien against the property of the other for one-half of the amount
of the maintenance or repair;
The parties hereto agree that each shall be responsible for the proportionate share of taxes
attributable to each property and shall hold the other harmless from loss or damage there
from;
Each party hereto shall maintain insurance against loss or damage to the facility or for
personal injury, including medical coverage, and shall hold the other harmless from loss
or damage regarding the dock facility or personal injury to each party or their guests.
Each party hereto shall indemnify the other for any damage claimed made by the invitees
or guests of that party, including any amount paid to defend against such claims.
