2-Acre Moratorium Waiver Approval MOR2024-00004
Notice is hereby given that Ted and Suzie Dahm of Goldwater Properties LLC,who are the applicants for
the above referenced permit, have been granted approval for a 2-Acre Forest Practices Moratorium
Waiver to waive a 6-year development moratorium,which was incurred as a normal condition of a Class
II Forest Practices Application (#2422124) issued by the WA DNR, on Mason County tax parcels 42132-
31-00060 and 42132-31-00070.The waived area is 2 acres.
The applicant intends to develop both lots with single-family residences, septic systems, and a well in
the future.
A SEPA Determination of Non-Significance (DNS)was issued on 11/13/2024.The formal 14-day
comment period though SEPA ended on 11/27/2024 and included one comment from the Squaxin Island
Tribe. Mason County retained the SEPA Determination of Non-,Significance (DNS).The SEPA record
number for the project is 202405007. Mason County's file number for the projects is SEP2024-00027.
This 2-Acre Forest Practices Moratorium Waiver Approval decision is final and subject to appeal to the
Mason County Hearings Examiner(per Mason County Code Title 15, Chapter 15.11—Appeals) within 14
days from date of decision (the date at the bottom of this notice).Appeal deadlines are short, and
procedures strictly construed. Anyone wishing to file an appeal of this decision should consult with an
attorney to ensure that all procedural requirements are satisfied.
Time Limit for Action. Per Mason County Code 15.09—Review and Approval Process—this
administrative final decision will become effective at the expiration of the 14-day appeal period
(12/16/2024) if no appeal is submitted. If a written notice of appeal is received during the 14-day appeal
period,this project will be referred to the Hearings Examiner for an open record public hearing and the
decision will not become effective until the Hearings Examiner renders a decision on the appeal. No
permitted activities (ie. construction, harvesting, etc.) may begin until the aforementioned deadlines
have passed.
Notice is given pursuant to RCW 36.708.130 that property owners who are affected by this decision may
request a change in valuation for property tax purposes notwithstanding any program of revaluation.

Yes.
The proponent has submitted a site plan appropriately depicting the area to be
waived from the development moratorium.

That the development moratorium is the result of:
The WA Department of Natural Resources issued a Class H Forest Practices Activity,
known as FPA/N#2422124, effective on 0210612021. The resulting six-year
development moratorium (MCC 11.04.010) will expire on 0210612027.
That this Moratorium Waiver is in conformance with Mason County Code 11.04.090:
(a) The director of the department of community development [or their
designee, per MCC 15.01.020] shall have the authority to approve, approve
with conditions,or deny a request for a waiver of the moratorium, pursuant
to the procedures and requirements of this chapter.

That this Moratorium Waiver is in conformance with Mason County Code 11.04.100:
(a) The request will be made to the department of community development on
the application form provided by that department and accompanied by a
completed county environmental checklist and any established fees.

notice, as provided for in the Mason County Title 15 Development Code.
Yes, the Type 11 review(with public notice)procedures of MCC 15.09.040 were
followed. The Notice of Development Application was posted on-site on
September 6, 2024, in accordance with MCC 15.07.010. The Notice of
Administrative Final Decision will be sent, in accordance with MCC 15.07.040,
following the signing of this Finding of Fact.
(c) Standards for waiving the moratorium:
(1) The development area shall be no larger than two acres in size.

(2) The harvest and reforestation of the property shall be completed as
specified in the approved forest practices application/notice.That

excepted from reforestation.

moratorium is compatible with the Mason County Comprehensive Plan
and Development Regulations.

(5) Mitigation shall be required for impacts to critical areas,
stormwater, and shorelines. Other mitigation shall be required to
prevent significant adverse environmental impacts, pursuant to
M.C.C.Chapter 8.04 to 8.40.
No mitigation is required because no damage to critical areas or their
buffers has occurred.
Mason County Resource Ordinance
The issuance of this permit will not result in a violation of the Mason County Resource
Lands and Critical Areas Ordinance. The site was inspected on September 6, 2024, by
Luke Viscusi, of the Mason County Planning Department, who determined that any
critical area buffer issues have been sufficiently documented.All project activities are
outside of wetland, stream, and landslide hazard area buffers.
Geotechnical Report/Geological Assessment Review

Stormwater Management
An engineered storm water plan for Mason County Public Works is NIA. The project
requires Minimum Requirement#2 of the 2019 Stormwater Management Manual for
Western Washington due to land-disturbing activities less than 7,000 sqft. Narratives for
Minimum Requirement#2 were submitted and meet the standards of the Manual.
CONCLUSION
In conclusion,this application for a 2-Acre Forest Practices Moratorium Waiver, associated with
FPA/N#2422124, is consistent with the above criteria and Mason County has fulfilled its
statutory obligations. Per MCC 11.04.110,the following permits may be issued and conditioned
as necessary to be consistent with Mason County Code prior to 02/06/2027 under this waiver:
(1) Building permits for the single-family residence and for residential
outbuildings;
(2) Single-family on-site septic system permit;
(3) Road access permits;
(4) Earth modification permits;
(5) Shoreline master program approvals;
(6) Well or potable water permits;
(7) Other approvals necessary the development of a single-family
residence and outbuildings.
RECOMMENDATIONS
I, being the review authority(designee of the Director of the Mason County Department of
Community Development), hereby attest to and certify that appropriate provisions have been
made for this Forest Practices Moratorium Waiver and hereby grant approval.

Element 1: Mark Clearing Limits
To protect adjacent properties and to reduce the area of soil exposed to construction, the limits of
construction will be clearly marked before land-disturbing activities begin. Trees that are to be
preserved, as well as all sensitive areas and their buffers, shall be clearly delineated, both in the field
and on the plans. In general, natural vegetation and native topsoil shall be retained in an undisturbed
state to the maximum extent possible. Applicant should describe how clearing limits will be marked
prior to logging and note on the site plan. 1' l V,6J, L�4'V�"`�
Element 2: Establish Construction Access
Construction access shall be established and access points shall be stabilized to minimize the tracking of
sediment onto public roads. If sediment is tracked off site, public roads shall be cleaned by shoveling or
sweeping at the end of the day to prevent sediment from entering surface waters. Applicant should
describe where the construction access will be,obtain a Road Access Permit if it is a new location, and
construct access to minimize sediment tracking.
Element 3: Control Flow Rates
Downstream properties and waterways shall be protected from erosion due to increases in stormwater
runoff volume,velocity and peak flow rate. The applicant needs to clearly identify where runoff will
leave the site so potential downstream impacts can be evaluated. This element will be "not
applicable" (N/A)for most FPAs because the increase in runoff and/or erosion due to logging will be
negligible. If no BMPs are proposed,the applicant needs to describe rationale:e.g.,flat topography,
highly permeable soils, large vegetated buffers at site perimeter, logging method, or others.

Element 4: Install Sediment Controls
Stormwater runoff from disturbed areas shall pass through a sediment removal Best Management
Practice (BMP) before leaving the site or prior to being discharged to an infiltration facility. In most
cases, an FPA will not require the construction of an infiltration facility. Whenever possible, sediment
laden water shall be discharged into onsite, relatively level, vegetated areas.
If no BMPs are proposed,the applicant needs to describe rationale. " t
More complex sediment control/treatment BMPs, such as infiltration facilities, should be used if
sediment controls are not (or not anticipated to be) adequate for the site-specific construction activities.
These BMPs are primarily used on:
■ Larger sites (i.e. greater than 5 acres), or,
• Sites that have continual soil disturbance and are difficult to temporarily stabilize, or,
■ Sites at higher risk of erosion (i.e. slopes), or,
■ Sites where the downstream environment is particularly sensitive and more stringent
discharge controls are required. o^

Exposed and unworked soils shall be stabilized with the application of effective BMPs to prevent erosion
throughout the life of the project. In general, cut and fill slopes will be stabilized as soon as possible and
soil stockpiles will be temporarily covered with plastic sheeting. All stockpiled soils shall be stabilized
from erosion, protected with sediment trapping measures,and where possible, be located away from
storm drain inlets, waterways, and drainage channels.
This element will be "not applicable" (N/A)for most FPAs unless there is new road construction that
includes cuts and fills. If no BMPs are proposed,the applicant needs to describe rationale.
Element 6: Protect Slopes , � - S �
All cut and fill slopes will be designed, constructed, and protected in a manner that minimizes erosion.

Element7: Protect Drain Inlets
All storm drain inlets and culverts made operable during construction shall be protected to prevent
unfiltered or untreated water from entering the drainage conveyance system. However, the first

priority is to keep all access roads clean of sediment and keep street wash water separate from entering

Element 11: Maintain BMPs
All temporary and permanent erosion and sediment control BMPs shall be maintained and repaired as
needed to assure continued performance of their intended function. Maintenance and repair shall be
conducted in accordance with each particular BMPs specifications. Visual monitoring of the BMPs will
be conducted at least once every calendar week and within 24 hours of any stormwater or non-
stormwater discharge from the site. If the site becomes inactive, and is temporarily stabilized, the
inspection frequency will be reduced to once every month.
All temporary erosion and sediment control BMPs shall be removed within 30 days after the final site
stabilization is achieved or after the temporary BMPs are no longer needed.
This element will be "not applicable"(N/A)for most FPAs if Element 3's 3—8 are N/A or very minimal.

Element 12: Manage the Project
Erosion and sediment control BM Ps for this project have been designed based on the following
principles (not all will be applicable):
' Design the project to fit the existing topography, soils, and drainage patterns.
' Emphasize erosion control rather than sediment control.
' Minimize the extent and duration of the area exposed.
• Keep runoff velocities low.
Retain sediment on site.
• Thoroughly monitor site and maintain all ESC measures.
• Schedule major earthwork during the dry season.
In addition, project management will incorporate the key components listed below (again, not all will be
applicable):
Seasonal Work Limitations
' From October 1 through April 30, clearing,grading, and other soil disturbing
activities shall only be permitted if shown to the satisfaction of the local
permitting authority that silt-laden runoff will be prevented from leaving the
site through a combination of the following:
❑ Site conditions including existing vegetative coverage, slope, soil type,
and proximity to receiving waters;and
❑ Limitations on activities and the extent of disturbed areas; and
❑ Proposed erosion and sediment control measures.
' Based on the information provided and/or local weather conditions,the local
permitting authority may expand or restrict the seasonal limitation on site
disturbance.
