X 3) Provisions for surface/subsurface drainage control must be implemented with new construction or development on site and MUST NOT adversely impact adjacent parcels. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. Clearing for the residence has encroached into a wetland buffer and, perhaps, into the wetland itself. The Mason County Resource Ordinance No. 77-93 requires setbacks from such wetlands. The size of the setback depends on the category of wetland. Clearing inot wetland buffers is not permitted without detailed review and receipt of a Mason Environmental Permit. A wetland categorization by a qualified wetland biologist will be necessary to determine the correct category for this wetland. Per the Wetlands chapter of the Resource Ordinance, construction may occur within the vegetative buffer provided that the applicant demonstrate that the activities have no adverse impacts to regulated wetlands. Placement and scope of the proposed development shall cause the minimum impact necessary to achieve the goal of residential development. The form for such demonstration of impact is a Functional Assessment of the wetland prepared by a qualified biologist per the Washington Department of Ecology criteria. In addition to the Assessment, an analysis by the biologist that evaluates the proposal's impact to the buffer shall also be provided. These documents shall be of sufficient depth for review of development impacts to the vegetation areas. A list of wetlands consultants and a copy of the Wetlands chapter are enclosed for your use and review. If you have questions or require clarification of these issues, please contact me.
