McCreavy Rd., Union, WA Legal Description: NE NE Parcel No.: 32130-11-00000 To all interested parties: The Mason County Building Department has an open enforcement case against the above described parcel of land situated within Mason County for construction of single family residence and barn and failing to obtain final inspection and approval of occupancy and use. According to the Mason County Assessor records, you are the current Title Owner and Taxpayer of this parcel. Pursuant to Mason County Code, Title 14 Building and Construction, a permit and final occupancy is required under the 2006 International Building Code and your property is currently in violation status. Our records indicate that you have three outstanding permits that have never had a final inspection and you are currently in violation for occupancy and use: BLD2000-00554 - Construction for single family residence. Final inspection failed on 6/17/2002 and you were granted 180 days temporary occupancy on 6/26/2002. To date, no inspections have been scheduled and your permit has since expired. BLD97-00069 -Construction of 2034 sq. ft barn. Only inspection conducted was for a hole inspection, which passed on 3/24/97. To date, no inspections have been scheduled and your permit has since expired. SWG99-00206 - Final Installation inspection failed. As-built is required prior to final inspection. Case referred to Environmental Health. Please contact Cindy Waite at (360) 427-9670 ext. 353 regarding permit requirements and compliance actions. A letter was sent to you regarding scheduling a final inspection on BLD2000-00544 on 12/12/2007 requesting you schedule an inspection within 21 days of the date of the letter. We received your response in a letter on 12/31/2007. You responded inaccurately in the letter stating that "the code and title requirement under Title 14 was not in effect when all permits and compliance's were in effect and have no bearing on your permits or building process. Therefore no further action is required or necessary." I have included the 1994 and 1997 Uniform Building Code along with the 2006 International Building Code, which does apply to your parcel and permits issued under BLD2000-00554 and BLD97-00069. Per Mason County Code, Title 14, Building and Construction Code, 1994 and 1997 Uniform Building Code, Section 106.1 Permits Required Except as specified in Section 106.2 of this section, no building or structure regulated by this code shall be erected, constructed, enlarged, altered repaired, moved, improved, removed, converted or demolished unless a separate permit for each building or structure has first been obtained from the building official. Per Mason County Code, Title 14, Building and Construction Code, 1994 and 1997 Uniform Building Code, Section 106.4.4 Expiration Every permit issued by the building official under the provisions of this code shall expired by limitation and become null and void if the building or work authorized by such permit is not commenced within 180 days from the date of such permit, or if the building or work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of 180 days. Before such work can be recommenced, a new permit shall be first obtained to do so, and the fee therefore shall be one half the amount required for a new permit for such work, provided no changes have been made or will be made in the original plans and specifications for such work, and provided further that such suspension or abandonment has not exceeded one year. In order to renew action on a permit after expiration, the permittee shall pay a new full permit fee. Per Mason County Code, Title 14, Building and Construction Code, 1994 and 1997 Uniform Building Code, Section 108.3 Inspection Requests It shall be the duty of the person doing the work authorized by a permit to notify the building official that such work is ready for inspection. Per Mason County Code, Title 14, Building and Construction Code, 1994 and 1997 Uniform Building Code, Section 109.1 Use and Occupancy No building or structure shall be used or occupied, and no change in the existing occupancy classification of a building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy therefor as provided herein. Per Mason County Code, Title 14, Building and Construction Code, 1994 and 1997 Uniform Building Code, Section 109.4 Temporary Certificate If the building official finds that no substantial hazard will result from occupancy of any building or portion thereof before the same is completed, a temporary certificate of occupancy may be issued for the used of a portion or portions of a building or structure prior to the completion of the entire building or structure. The Mason County Code, Title 14, Building and Construction Code, 2006 International Building Code reads the same as the 1994 and 1997 Uniform Building Code, except changes to the Chapter and Section references. Please reference 2006 International Building Code, Section 105.1 Permits Required, Section 105.5 Expiration; Section 109.5 Inspection Requests; Section 101.1 Use and Occupancy; and Section 110.3 Temporary Occupancy. i I have attached a copy of our amendments to Title 14, Building and Construction, Mason County Code, which states when the codes were updated and amended. Also included are the codes that are referenced above. The code strictly applies to both of your permits, which have since been cancelled. You are required to get a final inspection and approval of occupancy and use on both structures and further inspections are required in order to meet compliance and avoid further enforcement actions. A final inspection is required and will be conducted under the code in which your permit was issued. Current violations consist of the following: Illegal occupancy and use of barn and residence as per Mason County Code Title 14, Chapter 14.12.050. Failing to obtain final inspections and occupancy as per 2006 International Building Code, Section 109.1, 109.5, 110.1, 110.2 and 110.3 under Mason County Code Title 14, Chapter 14.08.10. To bring your site into compliance, you must: 1 . Obtain final passing inspections and permanent occupancy under BLD97-00069 for barn and BLD2000-00544 for single family residence. 2. A $68.00 investigation fee is required for each inspection, per permit until final inspection and conditions are met. 3. Schedule inspections along with $68.00 inspection fee for each inspection within 21 days of the date of this letter or prior to March 31, 2008. Pursuant to the Mason County Code, this department may issue civil infractions when a violation of Title 14, Building and Construction Code, occurs. Additionally, Title 15 of the Mason County Code also allows for the case to be heard and penalties assessed according to Section 15.13 through the Hearings Examiner process. Hearing Examiner fee for hearings and/or appeals is $1875.00. In the event that you fail to comply, by the compliance deadline of March 31, 2008, we will pursue additional enforcement action against you, including, but not limited to recording against parcel, civil infractions, liens against the property through the Mason County Hearings Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code. I just talked to my husband and he can have the whole thing built but the final panels for filling in between the railing and the steps will not be done by that time. We are having glass people come out to give us an estimate and tell us what they can do today. (It really has taken this long to decide.) However, the glass won't be ready probably for weeks. S000000---- if the rails are built, but not stained and finished, can we still get signed off? don't think that the county can regulate the finish, right? Could we put in panels that meet the code of not having more than 4 inch spaces and get a final signoff? Having this loom over us seems to be the part that makes Charlie angry and uncooperative, being someone who naturally rallies against authority. If we could get this settled, I think he'd calm down and do the final finish work immediately. He's angry again and wants this signed off finally. Extending the next 180 days would be the logical approach but that is just the authoritarian viewpoint that he can't settle with. The county just needs to know that the railing will be safe, right? Ideas? The house is built well and the other things are done. How do we get past this? If the barn is done, I suggest scheduling the inspection,which shows progress and that you are working on closing the case. But technically,you do have 180 days from the last inspection to comply. I understand that the inspection on the house will take more time due to the nature of work that you must preform. All I ask is that you keep me updated on your progress and make sure that you don't let the 180 day time frame lapse. If you have any questions or concerns, please don't hesitate to contact me. Is it possible for you to pass this on for possible enforcement on your end as well? The owners have never had a final on the barn and the single family residence. I am also working with the Assessor's office on this one as well,as they have never been assessed for taxes on these buildings,only the land for the last seven years. The homeowner's are going to be difficult on this as we have already received a letter from the owner who went on about his constitutional rights and that we have no jurisdiction.This is why I am suggesting that all the departments contact the owner. I think that all of us(Building, EH and Assessor's)will have a better chance of compliance if we work together on this one. Dixie Smith has been in contact with Mr.Olin and has asked for permission to enter his property for assessment. To date, she has not had a response with him.
