Sincerely, Pam nnett-Cumming Land Use Planner Mason County Planning Department 10/7/2008 Page 1 of 3 GRD2008-00016 NOTIFICATION OF INCOMPLETE APPLICATION 10/7/2008 Case No.: GRD2008-00016 Comments: Planning staff conducted a site visit for your proposed grading project at Lake Limerick Division 5 Lot 20, on E Sleaford Road. Staff had difficulty finding the parcel because it is un-addressed, and we could not see any site that just needed an 80 x 20ft access road fill. However, it appears the lot shown on the attached color aerial is the (fill) parcel your permit addresses. Please let staff know if this is not the case. The parcel you identify as the "cut" lot - Lake Limerick Division 3 Lot 102 located at 2220 E St Andrews Drive is not shown in any site plan. Both the cut and fill locations need to have site plans. During site review staff determined that a stream drainage runs diagonally through this parcel, which means the entire parcel is encumbered by the stream and its associated buffers. Across the street this stream drainage is within a drainage easement. For some reason this drainage easement is not shown on your subject parcel or the plat map. This stream is likely a Type Ns stream, meaning not salmonid bearing, and seasonal in nature. As such it would have a 75ft stream buffer with a 15ft building setback from the buffer. RESOURCE ORDINANCE VARIANCE: Your proposal to install a culvert and then fill over the drainage and buffer of a seasonal stream drainage would require application for and approval of a Mason Environmental Permit Variance. This variance process includes application, public notice and notification, a public comment period, and a public hearing before the Mason County Hearings Examiner. Application does not guarantee approval. Enclosed please find a copy of the Resource ORdinance Fish and Wildlife Habitat Conservation Area chapter 17.01.110 which guides in this. review. Per the chapter, section 17.01.110.G, a Habitat Management Plan is required as part of the review (see enclosed list of biologists). A fee schedule is enclosed with areas highlighted which address necessary submittal fees. NOTE: any future proposal to build on this site would also require the same variance process. You may want to consider this when putting together your variance proposal, if you choose to do that. SEPA: Because you are proposing to culvert and fill over a drainage, SEPA review is required. In addition, the total combined amount of cut and fill would require SEPA review regardless. A blank checklist is enclosed. MASON COUNTY SHORELINE MASTER PROGRAM: Once we have an accurate site and grading plan for the "cut" site, we can determine whether or not the cut area is under shoreline jurisdiction - i.e. within 200 feet of Lake Limerick. If so this project will also require a Shoreline Conditional Use Permit. If the value of the work is over$5,718, the permit would be a Shoreline Substantial Development Conditional Use. This determination will be made once we have the requested site plan and grading information (see Site Plans below). SITE PLANS: The site plan you submitted for the grading permit is inadequate. because it does not provide enough detail about the location of the creek which crosses the entire parcel, or the extent of the fill. To meet the standards for a grading permit application (including plan views and cross-sections showing cut and fill) you will need to provide that information for both parcels, including dimensions, setbacks to structures if applicable. In this case, because you are also proposing to culvert a stream, your proposed fill location must also meet the provisions of Mason County Resource Ordinance Fish and Wildlife Habitat Conservation Area Chapter 17.01.110 (see 10/7/2008 Page 2 of 3 GRD2008-00016 NOTIFICATION OF INCOMPLETE APPLICATION 10/7/2008 Case No.: GRD2008-00016 also above). GEOTECHNICAL REPORT: Without the requested information on grading (above), it is too early to tell if the submitted geotech assessment will require update.
