Dear Mr. Janousek:
Enclosed please find the Flood Protection and Shoreline
Stabilization Chapter of the Mason County Shoreline Master Program.
This is the Chapter that applies to the proposed rip-rap you would
like to place along the river. I was incorrect earlier today when
I was calling it a bulkhead. Because it is on Cranberry Creek, it
is reviewed as shoreline stabilization and requires a Shoreline
Conditional Use Permit. This permit takes approximately six months
to process and could be combined with the Shoreline Variance for
the setbacks.
I have enclosed the application and explanation for the Shoreline
Permit Process. The placement of the residence and garage, as
proposed, would require an approved Shoreline Substantial
development Permit and Variance. Because the proposal is within a
Conservancy Environment, the minimum setback from Cranberry Creek
on all parts of the property is 50' as measured from the ordinary
high water mark. The setback from the side property line is a
minimum of 251 . The 25' setback is applicable to the side of the
property where you propose to place the garage.
Please note the criteria necessary for granting shoreline
Variances. In staff' s opinion and from my experience with previous
Shoreline Variances, it does not appear that the proposal could
meet the Variance criteria. The decision is up to the Mason County
Commissioners and the Washington State Department of Ecology. The
shoreline permit process involves Public Hearings before the Mason
County Shoreline Advisory Board, who make a recommendation to the
Commissioners and then the Commissioners' s have a hearing where
they make a decision. A real hardship with the property must be
proven. You, of course, have the option to apply for the Variance
for the setbacks of the residence. If you have any questions,
