determined that the contents of the application are incomplete or do not provide
enough detail for review.
Therefore, review of your application will not proceed until the necessary information
is provided (see the comment section of this letter for details.) Once the information
is submitted and the application is complete, I will continue to process your
application accordingly. If the additional information is not provided to the County
within 180 days of this request, the application shall expire and no further action on
the proposed development shall take place.

NOTIFICATION OF INCOMPLETE APPLICATION

Comments:
This shall serve as a notice of incompleteness regarding the
inadequacy of the Habitat Management Plan (HMP) and other
additional information submitted with the Resource Ordinance Variance
application. A field inspection of the subject property was conducted
on 5/2/2003. Based on the field review, the Habitat management plan
and site plan submitted does not accurately reflect the stream location
on the subject property and the setback measurements. We
understand a field inspection by the contractor and staff is scheduled;
which may result in a revised site plan for the property.
This is to inform you, that, in addition to a revised site plan, the
following requirements are necessitated, for continued review of the
Resource Ordinance Variance:
1. A satisfactory map as described in the Fish and Wildlife Habitat
Conservation Areas chapter of the Mason County Resource Ordinance
No. 77-93. A copy of the chapter is enclosed. The map should include
the correct setback measurements, stream location and alignment,
property corners, lot lines, proposed building location and size of
proposed building.
2. A location of listed species and their critical habitat.
3. A discussion and/or analysis of the initial activity and subsequent
mitigation on fish and wildlife in the vicinity of the project site.
A copy of the HMP was submitted to Washington Department of Fish
and Wildlife and the Squaxin Tribe for comments. A 28-day review
period is provided for these organizations. If as anticipated, the site
plan and HMP are revised, the comment period will be extended to
allow sufficient time for these organizations to review the revised plans.

Comments: Based on our discussion regarding the Preston's revised proposal,
(variance request-VAR 2003-00014), the following comments resulted:
It is staffs understanding after meeting with Jack Frost Construction
(9-11-03) the proposed site plan has been modified. The revisions
were partially based on the comments received per the variance review
process by the County planning staff and the Squaxin Tribe biologist.
The previously proposed project provided for locating a manufactured
home within 50' of the Ordinary High Water Mark of Cranberry Creek.
The revised project currently consists of remodeling the existing garage
and adding an additional 30 feet to the existing structure along the east
facing wall; in order to establish a residence and disregarding
placement of a manufactured home on the property.
A site visit was conducted based on the revised proposal on 9-15-03.
Measurements were taken from the Ordinary High Water Mark of
Cranberry Creek to the existing garage and an additional 30 feet
beyond. The existing structure's west facing wall (closest to Cranberry
Creek) measures 11 5' from the OHWM of the creek. The existing
structure's east facing wall measures approximately 145' from the
OHWM of the creek. 30 additional feet to the east would create a
measurement of 175 feet from the OHWM to Cranberry Creek. As
described in previous letters, Cranberry Creek runs along the westerly
boundary line of the subject property. Exactly where it bisects the
property is unknown.
Per the Mason County Resource Ordinance Fish and Wildlife Chapter,
Cranberry Creek, a Type 1 stream requires a 150 foot vegetative buffer
and 15' building setback, for a total of 165' setback. A primary focus of
the site inspection was to assess if the parcel contained any lands
unencumbered by the stream buffers and other development regulation
setbacks. Based upon the field review, few areas exist on the subject
property. Remodeling the existing structure, and as the revisions
propose, moving farther east, away from the stream would still require,
as was the case in the first proposal, a Resource Ordinance Variance.
Placement of a structure or expansion* (See next paragraph) of an
existing structure within a type I stream buffer requires the
aforementioned variance and a Habitat Management Plan to support
that variance. The variance requires any development proposal to
show it is the minimum necessary to afford relief. The HMP addresses
impacts to the buffer and offers measures to preserve and protect the
buffer or mitigate impacts. These revisions to the site plan
acknowledge the recommendations submitted by staff and the Tribe.
Application and review of a variance does not guarantee approval.

*It is permissible however to replace the existing garage within its
footprint (total replacement), in accordance with the Mason County
Resource Ordinance (17.01.110 Section f), as stated, " The remodel,
repair or change of use of an existing building within its existing
footprint, plus or minus ten percent and provided that such an
expansion does not increase any intrusion into the aquatic
management area or buffer." It is also permissible, as long as the
structure is maintained in its existing footprint, to add height, up to a
maximum of 35'.
To continue review of the project the following information is required:
1. A revised site plan reflecting stream location, buffer standards and
all setbacks.
2. A supplemental or new Habitat Management Plan based upon entire
subject property relative to stream buffer and proposed project.
Enclosed is a checklist of requirements of a Habitat Management Plan.
3. A completed revised variance application. The variance case
number will remain the same, Variance 2003-00014.
Fees for the variance, Hearings Examiner and Habitat Management
Plan were paid in April 2003. Revisions to the application may incur
some minor additional fees such as a revised site plan review fee
however the application fee, Habitat Management review fee and
Hearings Examiner fee still apply.

Diane,
As a follow up to our field visit may 12, 2003, I would like to reiterate our position for
the variance for the Preston property.
Cranberry Creek is a highly productive salmon stream that currently experiences high
water temperatures partially due to the alteration and disturbance of canopy cover. The
Tribe is not in favor of allowing variances to the buffer width on this stream.
The current existing buffer is approximately 65 feet from the OHWM of the stream and
shows signs of instability along the high bank adjacent to the proposed house site. The
landowners' proposal to place a mobile home on the top of this bank has a high potential
to accelerate soil movement causing ongoing erosion problems,which would
continuously undermine the foundation of the house site. The landowner also wishes to
build a deck onto the front of the house,which would farther impact the buffer site and
may also contribute toward the banks instability.
Fortunately the landowner also owns the adjacent parcel, and between the two parcels
there are several options for an alternate building site,which will not impact the existing
buffer and the unstable slopes. To help reduce the risk of accelerating bank erosion above
the break in slope, I would recommend that all storm water be routed away from this area
and eliminate excessive lawn watering.
