Pursuant to your application, a site pre-inspection (SPI)was performed on your property. Below you
will find comments made regarding the proposed development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must
be included in your specific proposal; these setbacks are included as part of the comments listed
below.
This information is based on County and State regulations as they exist to date. These regulations
may change and may affect the requirements for development of the subject property.

Comments:
Site inspection of June 26, 2006 for Jake LeGault:
The purpose of this inspection was to determine applicability of
planning regulations to building on this site. The subject parcel
(PN: 32127-53-00196 in the Lake Limerick subdivision) is about
0.36 acre in size and is located along the east side of Cranberry
Creek, a type 1 stream in an area of several bends in the creek
alignment. The property slopes slightly downward from the upper
area near the road (a cleared area where a previous mobile site
and septic drainfield are situated), to the native tree and shrub
cover of 80 to 100 feet depth along the creek.
Mason County Resource Ordinance:
A designated Type 1 stream is a perennial water of significant
volume and fish bearing capability and falls under the jurisdiction
of the Fish and Wildlife Habitat Conservation Areas Chapter
(17.01.110) of the Mason County Resource Ordinance. These
provisions establish a 150-foot vegetation buffer and a 15 foot
building setback requirements for a type 1 stream, for a total of
165 feet from the channel migration zone (CMZ). In accordance
with the Resource Ordinance, buffers are to be retained in their
natural condition, but portions of established use area may be
maintained. New residential development is not permitted within
Fish and Wildlife Habitat Conservation areas or its buffers, except
for as approved through a variance or reasonable use exception
review process.
Staff noted that a septic system tank and drainfield are located in
the first 50 feet of the lot near the road and a level area to the
northwest is likely where a mobile home was once located. Staff
made a measurement along the east property line from the bank
of Cranberry Creek towards the road and septic system; that
distance from the creek was 165 feet to the creek side of the
septic tank.
Based on these field measurements, no area exists on the lot that
would not be unencumbered by the critical areas buffer and
building setback and the presence of the septic system and
needed setbacks near the road. The review of a request
application and questions for a variance from the Fish and Wildlife
Habitat Conservation Areas chapter would be necessary to
pursue a reasonable sized and located residence on this property.
A Habitat Management Plan (HMP), prepared by a qualified
biologist, would be required as part of the variance request to
support the proposed development. The HMP study addresses
impacts to the buffer and offers measures to preserve and protect

the buffer or to mitigate impacts of a reasonable development
proposal. A copy of the Fish and Wildlife Habitat Conservation
Areas chapter, including details on the contents of an HMP and
the variance public review procedure, was given to the owner.
Application for a variance to these standards does not guarantee
approval of the development as proposed.
Mason County Development Regulations:
The site is zoned Rural Residential 5 (one dwelling unit per 5
acres). Development regulations for this zone set forth a front
yard and Road right of way setbacks of 25 feet from the edge of
easement and a sideyard setback of 20 feet from side property
lines. An administrative variance may be requested to reduce the
front setback as low as 10 feet, or the side yard setback as low as
5 feet, if the size, shape, or features of the property constrain
development front yard and road right of way setbacks. This
process requires application and review at the time of the building
permit submittal. These setbacks are measured from structures
or projections greater than 30 inches above grade, such as roof
overhangs, balconies, stairs, decks, fuel tanks, heat pumps, etc.
General process: Future site development must include a site
plan, reflecting all of these setbacks from property lines, any
slopes, stream, or other improvements. The site plan will be
needed for the Resource Ordinance variance review and building
permit application submittal.
No other critical areas such as steep slopes or wetlands were
identified on site that would have an impact on future
development. County Codes referred to can be obtained from the
