Dear Applicant:
Pursuant to your application, a site pre-inspection (SPI)was performed on your property. Below
you will find comments made regarding the proposed development and its critical values.
In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands
must be included in your specific proposal; these setbacks are included as part of the comments
listed below.
This information is based on County and State regulations as they exist to date. These
regulations may change and may affect the requirements for development of the subject property.

Comments: The property was re-inspected by Planner, Grace Miller. No
additional work has been done since I originally visited the site
and posted the Stop Work Order on April 3, 2015. While on site,
staff observed that the Stop Work Order had been removed and
there was a Washington Home Center sign posted on the road. It
is unclear if this sign is associated with the site. A manufactured
home is not proposed for this site as far as the Planning
Department is aware of and cannot be permitted under these
pre-inspection findings. It appears that an approved Resource
Ordinance Variance would be required for installation of a
residence, as it may encroach into the buffers.
The purpose of the pre-insepction was to determine if the
applicant's current proposal is outside of both the 50' vegetative
Landslide Hazard Area buffer and the 150' Type "F" sream buffers
and may be accomplished without additional shoreline,
environmental or variance permits at this time.
Buffers shall be retained in their natural condition, except as
provided elsewhere within the Resource Ordinance. I had given
you the Fish & Wildlife Chapter and the Landslide Hazard Chapter
of the Resource Ordinance during our meeting on June 9th, but
have enclosed an additional copy for your information with the
applicable sections highlighted.
The current proposal is to: "Remove gravel from below the 50'
vegetative buffer, place old gravel at top of property, where
proposed recreational site will be located. See attached map.
Reseed areas where gravel was removed with clover. Remove
electrical and water podium from current location to front of
property. See new location on attached map. Cap all underground
lines at said location. Re-gravel front of property for new
recreational site."
The property is regulated by the Mason County Shoreline Master
Program and the MC Resource Ordinance. When there are
different setbacks and buffers from critical areas, the strictest
setback measurements apply.
Cranberry Creek is regulated as a Conservancy Shoreline
Enviroment under the Shoreline Master Program. The minimum
buffer under this ordinance from the creek is 100' and the
minimum building setback from the creek is 115'.
Cranberry Creek is regulated as a Type "S" and 7" stream under
the MC Resource Ordinance and the buffer is a minimum 150'

with an additional 15' building setback so the minimum setback for
all structures above grade is 115' from Cranberry Creek.
The ravine between the creek and the proposed site is considered
to be a potential Landslide Hazard Area as regulated by the
Mason County Resource Ordinance, Section 17.01.100. All
development within 300' of a steep slope requires a geotechnical
report be prepared to address the proposed development.
Landslide Hazard Areas have a minimum 50' buffer from the top
of the bluff. This buffer is to be retained with native vegetation.
Apparently this and the creek buffers have been cleared for some
time. The gravel and utility podium have been placed in the buffer
and are considered to be a violation of development in the 150'
stream and 50' landslide hazard area buffers.
In order to place any structures within the minimum 150' shoreline
buffer or the 165' building setback from Cranberry Creek, an
approved Resource Ordinance must be obtained. A Resource
Ordinance Variance must go through the Public Notice and
Hearing process. In addition, a Habitat Management Plan that
meets the criteria within the ordinance would need to be prepared
to work within the buffer and to mitigate any potential impacts to
the resource. The Mason County Hearing Examiner would make
the Decision to approve or deny such a Variance, after a Public
Hearing.
You have proposed to move the gravel and utility podiums outside
of the buffers and replant the disturbed area with clover where
grass grew previously. Under the Mason County Resource
Ordinance section 17.01.110 (F)(2), Maintenance and use of
existing landscaped areas within the buffer area, such as mowed
grass, may be continued in the previously maintained area only.
This area should also be enhanced with native vegetation.
Maintenance and use includes mowing and weeding.
Maintenance does not include the removal of native trees over 6
inches in diameter at 4 foot height. Exposure of more than 200
square feet of soil at any one time requires stormwater
precautions so that no contaminated runoff reeaches the stream.
If such maintenance or use in the buffer area is abandoned or
discontinued for greater than 3 years, actvities must conform to
section 17.01.110 G.1. A Habitat Management Plan must be
prepared prior to any work in the buffer other than the currently
maintained area.
Staffs understanding is that you intend to place an RV on the site
for recreational purposes. The RV will be placed outside the

shoreline setbacks and buffers. You may have one RV on the site
but it must be a recreational vehicle, not a "park model RV". Park
model RV's, mobile homes and manufactured homes are
regulated as single family residences in Mason County and
require a Buiding Permit. They must meet all setback and
environmental permitting requirements. Are you putting in a park
model RV or an RV? Please clarify if you are proposing a park
model so that we can give you a Building Permit Application and
you will need to move it outside the 165' building setback.
Recreational vehicle means a vehicular type unit primarily
designed for temporary occupation such as recreational camping,
travel, or seasonal use which has its own motive power or is
mounted on or towed by another vehicle. Park model recreational
vehicles set up in a permanent fashion, as defined by the building
code, shall be permitted as a residence and require an approved
Building Permit. It is unclear if you can meet the 165' setback from
the creek with a park model RV or manufactured home.
Any new development such as a residence or structures within the
buffers and building setbgacks shall require both a Habitat
Management Plan (G)(1)(c)(1&2) and a Resource Ordinance
Variance (K) per section 17.01.110 of the Fish & Wildlife Habitat
Conservation Area Chapter. In addition, any proposed
development such as a residence will require a Geotechnical

Potential erosion from the site must be prevented. Silt fencing and
/or vegetation should be installed to prevent erosion. Because of
the drought this year, it will take some time after the fall rains
begin before the seeding of the disturbed area may be
successfully seeded and established.
This letter confirms that the work that you have proposed on the
proposed site plan and within the narrative may be completed at
this time, with the conditions outlined wthin this letter. Please let
