Thank you for the information about Mr. Benton.
Its all right to disagree with me about the easement, however it is pretty specific and I'm sure
you know where the specific access points identified in the easement are for WDFW and the
NMSD to do maintenance. I recall that you had concerns when the PNWSC unlocked one of
the legal access point gates and also starting grazing animals on WDFW property back in
2010. Enough that Mr. Brinson and Mr Cenci of WDFW enforcement got involved in insisting
the PNWSC move the animals and locking the access gates.
The new access sites that are being used by your agency, PNWSC, and the public were
never codified between the parties, and they cant be because it is a perpetual easement that
involves the vacationing of Roessel road. See attached email from 2013 regarding a 2012
meeting in which WDFW erroneously brought the proposal to Theler for their approval.
I think the easiest way to correct the problem is for Mason County, WDFW and the NMSD to
require that the PNWSC comply with their special use permit and the easement and put the
gate back on Roessel road.

Ken—I was at the Union River estuary restoration project on Tuesday, March 24th, to complete some fish
sampling. A new Habitat employee from the Port Orchard office,Josh Benton,joined me to learn about
estuarine fish and estuary restoration. Josh's number is 360-602-0364. While we were at the estuarine
restoration site,we took a walk to the Theler Trail culvert failure as we discussed by phone. Josh will not be
involved in the review or permitting of this project, but is learning about marine waters and estuaries in
general.
I disagree with your interpretation of the easement language. As WDFW employees, we accessed the site
from WDFW property onto a public trail.

My understanding is you had someone with you, in "training", and you were both looking at the freshwater pond
breech on school district property.
Could I get his name and contact information please?
As I mentioned on the phone, public access to school district property off of Roessel road is in violation of the
perpetual easement entered into when the trails were originally established..Both the school and WDFW already
have established legal easements to their lands which were established in part to vacate Roessel Road and to
also limit access to the trails in one spot, Theler community center..
I have attached the easement agreement for your reference.
You also might be interested to know I've discovered an EIS that was written for the original trail development
that identifies the pond and freshwater marsh as that, and it is intended to remain that way.

Barbara, thanks to you and your helpful staff for tracking down the file on Theler. It was very
helpful. My wife and her sister enjoyed seeing the comment letter that their mom, Irene Davis,
had submitted to the original EIS.
Allan, regarding the JARPA application. I have spent quite a few hours reviewing the
preliminary EIS, the final EIS, and all the comment letters. I would be happy to share my
finding with you. I believe you will find that the trail needs to be restored to the original
condition, with a one way valve installed on the freshwater pond. The freshwater marsh and L
shaped pond were recognized as important environmental features that needed to be
protected then and even more so now given all the upland development including the Golden
Bell mobile home court that is not hooked to the Belfair sewer. (I remember when the Belfair
sewer EIS was open for comment they planned to put a pump station right on the edge of the
Theler wetlands, something that myself and Mr. Gary Parrott were able to convince to place
further upland.)
I would suggest that you condition the JARPA permit to include installation of oil/water
separators with required maintenance by the school district in the surface water runoff control
system for Thelers existing parking lot., This was something that several commenter's
including the Department of Game , Ecology and Ms Davis mentioned in their comments
and something that was overlooked when they built the parking lot and established the Theler
community center. For the last 25 years surface water runoff and occasional chlorinated water
from Belfair Water District drain unimpeded into the freshwater marsh and L shaped pond.
I am quite concerned and disappointed that neither the school, the consultant, Mr. McCullough,
or the WDFW and the PNWSC did their due diligence in reviewing these important guidance
documents before spending $21,000 of tax payers money for a preliminary engineering report.
I am also concerned that I had to track down the EIS and that the school did not provide these
important documents to the citizen advisory committee when they first considered establishing
the CAC. They obviously had the EIS in their possession because I was provided some of it by
the current superintendent the first week of March, a little over a month ago. ,
Please notify me of any meetings, either on site or in the office, that might be scheduled
before the application is submitted as I intend to attend and record.

Allan, Grace Miller just called me and informed me you are working with the NM school district
to obtain a permit to fix the 2012 Theler trail breech. I am very interested in this project and
look forward to helping fix it to its original state. I would like to give you a little historical
background and perhaps visit the site with you. Commissioner Neatherlin, myself and other
community members did an emergency repair of a similar breech, although smaller, very near
to this site about 10 years ago after the trail collapsed under a jogger. There are several
relevant perpetual easements, a EIS and covenants of earlier grants that need to be
considered. I think you will find that options are limited and would indicate a repair to original
condition. Please keep me posted if you would like to make a site visit and I would like to be
notified of any preliminary meetings of any involved agencies so that I might attend and
record.

The NMSD has decided to proceed with the entire Theler Trail Repair Project. Since this is an emergency repair
situation that is becoming more of an emergency each day—we are in a bit of hurry now. We will proceed to
prepare contract documents to install the 48" culvert, concrete wall and the SRT. We expect to start the final
design and permitting next week. I have been in contact with Jeff Juel in an attempt to determine if his SRT
would be the best design for this application. Before we spend a lot of time on the SRT I would like to know or
confirm:
1. Will WDFW allow an SRT at this site. I have assumed that you will but I am "just checking".
2. Do you have any issues or recommendations regarding using Jeff Juel's SRT or the Waterman Design.
3. A preference for the horizontal gate design over the vertical gate design has been stated. Is that the
case—or do you care?
Do we need to get together and discuss the above issues?
Note that we will not be filling on any additional wetlands. We will be replacing the fill that has washed out. We
assumed the original slopes were 2:1 similar to the undisturbed trail slopes.

I have spent time preparing the preliminary drawings for the Theler Trial Repair.
Note that this repair alternative includes installing the 4 foot dia. culvert now and adding the SRT later when
there is funding to construct the headwall, purchase the tide gate, and install the tide gate.
I mentioned to Scott and WDFW simply pushing a 40' long 18" PVC 3034 sewer pipe through the existing 21"
culvert and then rebuilding the trail as a temporary fix. My understanding at this juncture is that WDFW is not
comfortable with that concept. From a practical standpoint if they are going to haul in all the fill needed—150
cubic yards—to rebuild the trail, why not just go ahead and install the correct culvert and be done with it.
Anyway, check these out and see if you both think we have enough drawings to proceed ahead with permitting
the repair. I will prepare more details next week. We need a typical section.
At this point I am assuming the Mason County will help install the culvert.The culvert will cost$100 per foot or
$4,000.That is a lot of cookies and donuts but???
I see no need for federal or local permits since this is an emergency repair. What do you think?

The Terry Husseman grant requires a `sponsor' from DOE. The grant administrator told me that this would be
Rich Doenges. It appears that he is willing to sponsor the project, so that means we can move forward with the
application.

The estuarine wetlands receive stormwater input from the Belfair area—wetlands are effective at improving
water quality. We will highlight some water quality benefits of the project as part of the application.
Dogs are not allowed on the trail, although the original use of the diked area was to train dogs by a retriever
club.

Rick and Stephanie, I recently obtained a copy of the original 132 page EIS for the Theler
property. It is obvious that the fresh water pond was identified and intended to be detention
pond and settling basin for stormwater and surface drainage from the uphill properties, which
include the parking lot and Theler community center. This was prior to the Golden Bell mobile
home court land being cleared, built and covered with impervious surfaces. In addition one of
the mitigation measures identified in the EIS was for all surface drainages into the
freshwater pond to pass through an oil grease skimmer. It was intended that the school district
maintenance program would regularly clean out and maintain the skimmer. I don't think the
skimmer was ever installed and I know that there have been several large discharges of
chlorinated water that have happened in the last several months into the drainage system with
ongoing construction of the SR-3 widening project, an issue which I brought to the attention of
the DOE hotline.
Please expedite the repair of the 2+ year erosion of the trail and freshwater pond before any
more turbid water is directly discharged into the Lynch Cove. Hold all parties including the
WDFW and Theler BOD accountable for their inaction and purposeful delay in fixing.

Hi Ken,
As we discussed in our initial phone conversation, our Water Quality (WQ) program may be best
positioned to address your concerns regarding turbid water discharge. I've cc'd Stephanie Zurenko,
who is our non-point pollution specialist in WQ. She may have some ideas.
As for repairing the dike, it sounds like it would qualify for an exemption under the County's
Shoreline Master Program and Resource Ordinance. Most repair and maintenance activities are
exempt from certain permitting requirements. I'd suggest that you contact the County intbat regard as
they would be the lead agency for most permitting. They can also help identify any other necessary
approvals (WDFW, Corps).

Commissioner and Mr. Mraz,
Mr. Carey and I met with Superintendent Rosenbach and Ms Roberts of the NM school district yesterday
afternoon. We offered to help with the trail repair and Ms Rosenbach said that she was working with the
permitting agencies but that they are not willing to call it an "emergency"any longer.
I find that hard to believe as the engineer reported to the school board that Theler and the school waited
several months to notify agencies. This is not true. (see Peterson email to board.)
I have uncovered significant corruption surrounding this project concerning the engineer, the PNWSC, WDFW
and the former superintendent. . (Please see two attached emails dated over a year after breech happened)
there are many more.
Can you intercede in this matter? I am willing to donate and pay for the permit to return to original , whether it is
a emergency or expedited permit. The land involved is school district property not WDFW, PNWSC or Mr.
McCullughs
I believe we can put together a volunteer work party and affect repairs in a short time. Ladies if I misrepresented
you please let Mr. Mraz or Commissioner Neatherlin know.

I should be skiing this weekend. Instead I spent considerable time working up alternatives for repairing the
Theler Trail. I am very concerned about the safety of the trail in its current state.
I have prepared three alternatives for your discussion.
1. A temporary fix.
2. A temporary fix that works will with the final solution.
3. A final solution.
I have assumed that since there are now considerable fish present behind the trail dike that the estuary area
behind the dike will remain estuary. If Theler is going to return to the previous system I believe the cost would
be higher than the temporary fix because the old culvert ought to come out. In addition you have the
opportunity to add up to 7 acres to the Lynch Cover estuary. All kinds of folks would give the NMSD and Theler
an environmental award for that type of action.
If you install the 48" culvert, the cost of the culvert will be approximately $4,000. This alternative will require
somewhere near 150 cubic yards of gravel borrow fill and 20 tons of large loose rip rap. This alternative could be
affordable if Mason County would help out with the construction and borrow gravel import.
My recommendation is that you install the 48" culvert with flow constriction and then apply for grant funding to
install the SRT later.
What you do will depend on WDFW and their response to the WAC. Do not do anything until all the permit
agencies give approval. There are fines and even jail time for proceeding without permits.
Finally, remember that we "volunteers" are trying to help Theler resolve this problem. If Theler wants to go it
alone-just say so and all of us but the regulatory folks will leave Theler and the NMSD alone.

1 have been asked by WDFW, HCSEG,Theler Center, and NMSD for help in resolving this situation. See the above
graphic prepared by Doris Small of WDFW.
Ok, I have discussed the Theler Trial fix with numerous folks and—as best as I can surmise—here is where we
are;
• HCSEG—Is willing to sponsor the project and provide the design and construction supervision for the
final fix.The planning and the construction of the temporary fix will be overseen by Scott Stanton of
Theler.The NMSD, HCSEG, WDFW and ESA (me) will help.
• WDFW—Will consider an emergency permit to get the trail operational but only on the basis that the a
permanent fix is in process and will occur within a relatively short time period. The emergency fix will
include extending the existing 21" culvert and rebuilding the trail fill to historic width.The requirement
for a permanent fix will be an enforcement issue with a time limit. WDFW staff will help with the design
and will assist with funding applications.
• School District—Agrees that the trail has to be fixed so that it is safe but does not have the funds for a
permanent fix. Any permanent fix will have to funded from outside funding sources. WDFW and HCSEG
will help with the applications but the funding applications will have to be sponsored by the NMSD.
• Mason County—Randy Netherland—has verbally suggested that Mason County could provide
construction equipment and personnel to help repair the trail via an agreement they have with NMSD.
Randy stated that he wants the trail fixed ASAP.
• Theler: Scott Stanton wants to get the trail fixed and has volunteers to help out.They do not have any
funding for this project. All materials and labor will have to donated.
I have agreed to donate part of my professional services to help all parties move this along. I agree that the trail
is unsafe in its current condition and that the winter high tides continue to make the situation worse.
Also note that the five acre estuary behind the trail levee is extremely valuable fish habitat. We paid around
$135,000 an acre to restore the Union River estuary.That would make the value of the 5 acre estuary east of the
trail to be around $700,000. Fish have been using the estuary for the last 14 months so there are fish present.
That has changed the regulatory requirements for this repair.
What I am doing this morning.
• 1 am developing an engineering sketch for the temporary fix. That is to extend the existing 21" culvert
and rebuild the trail.
• 1 will develop a concept drawing for a permanent fix that will include a 4' diameter culvert under the
trail along with a concrete headwall and a Self Regulating Tidegate (SRT)to control the elevation of the
tidal flooding in the estuary east of the Theler trail. The SRT would be adjusted prevent the flooding of
Roessel Road. A setback dike would be alternate solution but building a 1,100 foot long setback levee
next to Roessel Road would be very expensive and would cover 1.2 acres of existing wetland.Very

expensive and impactful. I believe the SRT will work in this application and using an SRT will give the WDFW
and HSCEG an excellent opportunity to monitor the devise and report on its operation.
• 1 will attempt to complete my design drawings today. I will develop a cost estimate for the SRT solution.
Given the need to move this along for safety reasons and so we can apply for a grant by the end of the month - I
am proceeding. If any of you receiving this email have a protest-say so now and I will move on to some other
endeavor.

1 have been asked by WDFW, HCSEG,Theler Center, and NMSD for help in resolving this situation. See the above
graphic prepared by Doris Small of WDFW.
Ok, I have discussed the Theler Trial fix with numerous folks and—as best as I can surmise—here is where we
a re;
• HCSEG—Is willing to sponsor the project and provide the design and construction supervision for the
final fix.The planning and the construction of the temporary fix will be overseen by Scott Stanton of
Theler.The NMSD, HCSEG, WDFW and ESA(me) will help.
• WDFW—Will consider an emergency permit to get the trail operational but only on the basis that the a
permanent fix is in process and will occur within a relatively short time period.The emergency fix will
include extending the existing 21" culvert and rebuilding the trail fill to historic width.The requirement
for a permanent fix will be an enforcement issue with a time limit. WDFW staff will help with the design
and will assist with funding applications.
• School District—Agrees that the trail has to be fixed so that it is safe but does not have the funds for a
permanent fix. Any permanent fix will have to funded from outside funding sources. WDFW and HCSEG
will help with the applications but the funding applications will have to be sponsored by the NMSD.
