Thank you for the opportunity to comment on the determination of nonsignificance for the Creek/Pond
Maintenance& Repair project(SEP2009-00059) located at 22581 Northeast State Route 3 in Belfair as
proposed by Raymond and Betty Kilsby. The Department of Ecology(Ecology) reviewed the
environmental checklist and has the following comment(s):

Property owners, developers,and contractors are encouraged to recycle all possible leftover
construction, demolition, and land clearing(CDL) materials and reduce waste generated. Recycling
construction debris is often less expensive than landfill disposal. Please visit
http://1800recycle.wa.gov to find facilities that recycle construction, demolition,and landclearing
materials in your area.

Shorelands/Wetlands: Changing the course of a stream is not considered a minor activity and will
require at minimum authorizations from Washington Department of Fish and Wildlife,The U.S.
Army Corps of Engineers,and Ecology.
The location of the proposal appears to be within the Urban shoreline environment of Hood Canal.
There are also extensive wetlands mapped in the vicinity of the project site. It will be necessary to
identify the ordinary high water mark on site to confirm the proposals proximity to the shoreline
and surrounding wetlands.

The text in the SEPA,which mentions the stream creating"a wet boggy area",appears to be
describing a wetland resulting from stream flows. Such wetlands are typically considered critical
areas and are subject to local,state and federal regulations and protections. Rerouting streams to
dewater wetlands are activities that are generally prohibited or,if authorized, require mitigation for
lost wetland functions.
Ecology's comments are based upon information provided by the lead agency. As such,they may not
constitute an exhaustive list of the various authorizations that must be obtained or legal requirements
that must be fulfilled in order to carry out the proposed action.

i A JARPA and HPA will be required before any work can be performed as this is a
fish bearing stream. As such the Skokomish Tribe is requesting an extension on the
comment period until such a time as the other permits have been acquired and the
following concerns addressed.
It is impossible at this time to judge the type and extent of impact from this
project to fish and fish habitat associated with the unnamed stream. This is due largely in
part to the lack of information provided in the SEPA. There are several questions that
need to be answered before the Skokomish Tribe can sign off on this project. Why divert
the stream from its current course away from a cedar tree instead of removing the cedar
tree itself? Why does the dredging need to occur in the first place? If the proponent
simply wants to dredge the stream for his pond I don't know that the benefits to one
individual out weigh the negatives to the surrounding habitat and fish. Why does a
culvert need to be constructed in the stream for access,when a simple footbridge could be
placed over it so the proponent can access his property fully? How will the pond serve
local wildlife,or is it for aesthetic purposes or raising fish? Amore detailed description
of the work and the purpose of the work needs to be provided. Along with all other
permits required(water right diversion for pond,JARPA,&HPA). There also may be
some water quality concerns associated with the pond that DOE may need to address
before the proponent can begin construction.
The Skokomish Tribes Tribal Historic Preservation Officer will be providing
comment as to the potential cultural impacts of this SEPA and you should not move
forward with the above project until you receive those comments. Thank you for
