NOTICE OF MASON COUNTY CODE VIOLATION
ENFORCEMENT CASE FILE NUMBER: ENF2015-00103

Dear Mr.Ares and Ms. Cook,
Mason County Dept. of Community Development has received complaints to a potential violation
of the Mason County Code regarding land use activities. This site was identified as containing
violations of the Mason County Resource Ordinance Chapter(17.0 1.100), Landslide Hazard
Areas [cutting down trees on slopes that exceeds 15 percent,or within the buffer, and providing
no on-site erosion control for land disturbing activities].; and Chapter(17.01.110) Fish and
Wildlife Habitat Conservation Areas {[vegetation removal and filling in stream critical areas and
its vegetation buffer].
Unstable conditions remain on the steep slopes on your property,especially after continuous
surface disturbances from vegetation clearing and potential surface flows during winter and
spring runoff. New tree and shrub cutting within the stream area(and its vegetation buffer)
should not occur prior to county review of your project and site plan. These conditions(exposed
slide faces, greater subsurface drainage, and uncontrolled surface runoff)have grown worse and
remain on the property as the fall and winter seasons approach.
As noted in the findings of a Site Pre-Inspection completed in September 2010(SPI2010-00075),
a current geotechnical report reflecting the now-present conditions on the property must be
prepared, in accordance with the Resource Ordinance Landslide Hazard Areas Chapter
(17.01.100). A qualified person,as defined in the Mason County Resource Ordinance,must
prepare this special report and set forth the corrective stabilization and restoration actions;a list
of these professionals is included.You must provide a list of proposed activities (temporary and
permanent techniques), and a site plan,all detailing the actions which will stabilize site conditions
to your property and the properties to the north,east, and south. The study is provided to the
landowner, and all documents submitted to Mason County. A submitted Mason Environmental
Permit serves as the means to implement the corrective measures that may be approved. An
application for the MEP is included with this letter.

Due to the continuing unstable slope conditions,and the continued vegetation impacts near
the stream,you will now need to submit the following:
• Mason Environmental Permit-$630.00
• Geotechnical Report Review- $255.00
• Planning compliance fee- $255.00
It is very important that in a timely manner you understand that you are responsible for
addressing these unstable conditions and stream impacts that continue on your property.
You may comply to address these concerns by submitting the needed site plan of actions
and geotechnical report that evaluates the current conditions and presents the corrective
measures that shall reduce further damage to your property,nearby properties,and nearby
road improvements.
Please provide as soon as possible,and by no later than Tuesday December 1,2015,the
Geotechnical Report,the Mason Environmental Permit and site plans of proposed actions
and corrective measures,and the necessary fees noted above.

enforcement case ENF 2015-00103 was logged in on 9/11/15. Currently we are without a dedicated
code enforcement officer, so I have ask the Director to assign this case to the area planner for Belfair.

I received a call from Bill Gregory 09/30/2015 about a neighbor cutting trees in/around water. Made a visit to
the site on 10/01/2015 and spoke with his wife Jessica. I wasn't able to confirm cutting in/around a stream
without trespassing but there was definitely work being done and possibly in a critical area,the area did appear
to be very wet. Mrs. Gregory had the idea that Mr. Ares is trying to develop the land and build a road into the
property.
I am working with our enforcement to see what WDFW options are at the moment. Let me know if you have any
questions.

Bill,
I don't see that they have applied for any permits. The latest date in the ENF case long is 9/16. If
anything else has occurred since then, Allan Borden should know. I'm not involved in this case, but if
they apply for a Conversion logging permit, I would be reviewing that.

A complaint was filled on this site (ENF 2015-00103) on 9/11. Looking in TM I can not determine
who this case was assigned to and I don't see that there has been any follow up. This is in Allan's area
(Belfair). Can you let Mr. Gregory know what the status of his complaint is?

Hello, I left a message on the voice mail explaining what's going on here. I have enclosed a couple
pictures for you. I also have taken measurements for the slope. Fish and game came by and deemed
his property a wet land. the water is coming from a spring in the side of the hill. Mr. David Ares is
trying to put a drive way in my front yard and dive off the side of this hill. First I figured out that he
doesn't have an easement, so I'm in a battle with that. Second,this proposed drive way is dangerous for
the road and is a problem for my hill side. I have sent you a violation letter a while back explaining
that he is clearing this hill side with a chainsaw and there is no permit. (case number ENS2015-
00103) My boundary stake was also removed by David Ares. I'm worried about the hill and the road.
This is a liability for the county and myself if he is given permission on this project. Please take the
time and look at this to verify if I am correct on this matter. This is considered a critical area, with
slopes greater than 40 degree's.
