Dear Mr. and Mrs . Paulson,
On March 27, 2000, our office posted a correction notice at
23150 NE State Route 3 , Belfair for construction/remodel
work which was occurring without the required building permits .
Mason County adopted the 1997 Uniform Building Code through
Mason County Ordinance 45-99 . With the adoption of the code,
Section 106-Permits, requires that a building permit for the work
which was commenced is required.
Pursuant to the 1997 Uniform Building Code, Section 103-
Violations : It shall be unlawful for any person, firm or
corporation to erect, construct, enlarge, alter, repair, move,
improve, remove, convert or demolish, equip, use, occupy or
maintain any building or structure or cause or permit the same to
be done in violation of this code .
In the effort of cooperation between this department and
your contractor, the inspector posted a Correction Notice to
obtain an after the fact permit in lieu of a Stop Work Notice
which would have resulted in penalties and fines . I spoke with
Stephen Johnson on March 28, 2000 and he indicated that he would
make application at our Belfair Annex either on Tuesday 3/28 or
Wednesday 3/29 . To date, our office has not received an
application for the after the fact permit . All parties either
performing the work, causing the work to be done or having legal
interest in the property are considered responsible for
compliance . Since your contractor has failed to apply as we
discussed, I have included the necessary applications so that you
can make application.

1997 Uniform Building Code
Dear Mr. Johnson,
In response to our telephone conversation on March 28, 1999
and your later discussion with Betty Wing regarding "responsible
parties" relating to permit requirements, I felt it necessary to
communicate with you, the regulations which effect you as a
contractor. In 1992, when the enforcement program was
established, it came to my attention that numerous contractors
believed that the burden of permit responsibility fell soley on
the legal owner or persons having legal interest in the parcel or
structure. This is erroneous information. While Mason County
typically pursues or prosecutes only those with legal interest,
the code does allow for or grant us authorization for enforcement
activities to commence against any person, firm or corporation
who is deemed a responsible party.
In May, 1999, Mason County adopted Ordinance 45-99 regarding
Building and Construction Codes . Prior to that, the same
sections which apply to this letter, have been adopted repeatedly
for a number of years by other ordinances. With the adoption of
this ordinance, the 1997 Uniform Building Code regarding
construction was subsequently adopted. Section 103 of that
code, which a copy is enclosed for your perusal, clearly states :
"It shall be unlawful for any person, firm or corporation to
erect, construct, enlarge, alter, repair, move, improve, remove,
convert or demolish, equip, use, occupy or maintain any building
or structure or cause or permit the same to be done in violation
of this code. " Section 14 . 12 . 030 Violations and Penalties of
Mason County Ordinance 45-99 goes further into the legal
consequences of such violation and is also enclosed. There are
also other remedies available for repeated offenders which we
have exercised in conjunction with the Mason County Sheriff' s
Department . It .is really difficult to educate the general public
and the registered contractors regarding the multiple regulations
pertaining to construction and we would like to believe that the
reputable contractors who are registered are consciencous in
their workmanship and are knowledgeable with the current code and
permitting requirements .
It is understandable that a contractor not only has to keep
up with the Uniform Building Code requirements as those codes are
updated and adopted but that there are also amendments to those
codes that may vary county to county by ordinance . We are
fortunate enough to have a good working relationship with
surrounding counties that we find our building code requirements
are, for the most part, consistent with those bordering counties .
We encourage all contractors performing work within Mason County
to familiarize themselves with the various code and development
regulations to assure that the permit requirements upon submittal
and ensuing inspection process be as efficient and productive for
our staff as well as yours .
The Director of the Permit Assistance Center, Betty Wing,
and the Building Official, Dana Herron, attempt to accomodate all
contractor' s concerns and welcome the opportunity to meet
individually with those that may have specific questions that can
not be addressed by either field or technical counter staff.
