Dear Mr. Grotjan:
Our letter dated April 14, 2003 (enclosed) notified you of the unauthorized discharge of
dredged or fill material into a water of the United States. In this letter, we requested certain
information and set a response due date of May 15, 2003. As of the date of this letter, I have not
received your reply. This information may assist us in determining the appropriate course of
action. Without your response, we will proceed without your input.
During an on-site meeting with members of my staff, your agent, Ms. Michelle Fusman,
stated her company(Aqua Tierra Environmental Consulting, Inc.) was developing a plan to
restore this site. Restoration of the site would resolve your violation. Please note, you must
receive approval from the us before commencing any restoration work.
If you have already developed a restoration plan, please submit this with your response. If
not, please submit an anticipated date for completion of this plan and its submission to us for our
approval.
Please furnish this information within 15 days from the date of this letter. If you have any
questions concerning your reply, please contact Mr. John Pell at (206) 764-6914. A copy of this
letter without enclosures will also be sent to your agent, Agua Tierra Environmental Consulting,
Inc., 506 Edison Street Southeast, Suite 100, Olympia, Washington 98501.

Dear Mr. Grotjan:
Members of my staff recently met with your representative, Ms. Michelle Fusman, from
Agua Tierra Environmental Consulting, Inc., at your property located on Forest Service Road 24,
at Tenas Lake, near Hoodsport, Mason County, Washington. You have discharged dredged or
fill material into waters of the United States without a Department of the Army permit. This
work includes the placing over 0.90 of an acre of fill material into Tenas Lake. I consider this
work to be in violation of Federal law. I direct you to do no further discharging of dredged or fill
material waterward of the original ordinary high water mark, at this site. Enclosed are
definitions and extracts of the laws which may apply to the unauthorized work.
To assist in the evaluation of this violation, I request the following information:
a. As-built sketch of the work. Enclosed for your use is a copy of our sketch. You
should make any necessary changes to reflect current conditions, sign, and return with your other
comments.
b. Who did the work? If a contractor, please furnish name, address, and telephone
number.
c. Date when the work started.
d. Reasons why the work was started before obtaining a Department of the Army permit.
e. Property ownership at time of construction.
f. Primary purpose of the fill.
g. Practicable alternatives available that would not involve filling of wetlands.

The U.S. Environmental Protection Agency(EPA) also enforces Section 404. The EPA
will receive a copy of this letter and may provide views and/or recommendations concerning this
matter to our office.
Your agent indicated that you intend on resolving the violation by removing all
unauthorized fill in wetlands and replanting the disturbed wetland areas. Please submit a
restoration plan and schedule for our review and approval.
Please furnish this information within 30 days from the date of this letter. Your comments
will be beneficial in resolving this matter. If you have any questions concerning your reply,
please contact Mr. John Pell at (206) 764-6914. A copy of this letter without enclosures will also
be sent to your agent, Agua Tierra Environmental Consulting, Inc, 506 Edison Street Southeast,

Declaration of Intention
It is my hope and intention to put a small hydroelectric generator entirely on land owned by
myself and my children by Tenas Lake. Electricity from this generator would be only for use on
the property, which is not near existing power sources. There are presently a shop and a small
mobile home on the property. One man stays in the shop while he is working on the place and
another, Dave Woodard, lives in the mobile home. Both are presently served by a gas-powered
generator, which is noisy, polluting, and expensive to run. Dave, 63 and on low limited income,
has said he would like to live out the rest of his life on the place. This would be fine with me, as
he is a friend and he helps look after the place. Dave requires electricity for documentable health
needs including recharging batteries for a breathing machine for when he sleeps, and for a cell
phone for emergencies. He has sleep apnea, heart problems, back problems and is going
through a series of operations on his hands and shoulders. Electric heat, among other things,
would be a great asset through the winter.
I also have hopes of bringing in a small, portable, AC-powered sawmill sometime, but that would
probably be mainly solar-powered in the sunnier months.
(a)An eight-inch high wier would be built downstream from the 36" culvert now under F.S. Road
24 on the small seasonal stream feeding Tenas Lake. Some of the water raised by this would
pass through an 8" pipe to a pelton wheel and generator located as close as acceptable to
Tenas Lk. The pelton wheel would normally produce from 1 to 2 kw and would be completely
shut off during low stream flow. Outflow from the pelton wheel would go to Tenas Lk. Most of the
pipe has already been laid along existing logging roads and is completely on the property. There
would be no reservoir.

(c)(1) Storage or pondage would be minimal, probably less than 1000 gal. Impact on lower end,
to Tenas Lk and below, would be small, since most of the water goes through there already.
There would be some increased aeration of the water at the pelton wheel, and there would be no
pollution.
(i) During 10-day low water period stream is already dry.
(ii) When stream approximates average (estimated) yearly flow the natural flow would be approx.
540 gpm and regulated flow would be approx. 420 gpm.
(iii) In a low water year diversion of water would be reduced. This system would not operate on
minimal flow, and would never have to reduce the normal number of days that the stream would
flow.
(c)(2) The above information addresses this about as well as I am able to. It is my intention to
make the proposed project fit the supply, as gently as possible, rather than the other way around.
During a heavy runoff period more power would be generated for heat, work and battery
charging, etc. During a low or dry period no power at all would be produced by this system. Solar
panels would be used as possible, and the gas generator could be used as needed.
