When the location was purchased last summer, there was a sign in place, complete with power. That sign was located approximately thirty-one feet east of the centerline on Highway 3.This allowed for a sixty-foot right of way as required by the State Highway Department. This location provided for easy identity for traffic approaching from the north and south on Highway 3.The Realty Company replaced that sign with a "For Sale"sign. After the sale of the property the Realty Company removed their sign. Our desire is to place our sign in the same location as the previous sign. Under the terms of the permit that has been issued, the replacement sign would be set back from the location of original sign by 10 feet. This would place the new sign very near the front porch of the hospital. Because of the set back, the sign would not be visible to traffic approaching from the south until the motorists were nearly at the south edge of the property. This has the potential of being a safety issue for those motorists looking for our hospital. If unfamiliar with the location, they could easily be in front of the hospital before they actually see the sign with the name and address. If a variance were allowed,we would place the sign near the location of the old sign allowing for better visibility for those motorists approaching from the south. Thank you for your consideration in this matter. Sincerely, .1-47 Gary C.Ledray Pet's Choice, Inc. 305 - 108th Avenue NE, Suite 200, Bellevue, WA 98004 (425) 455-0727. 1-888-774-0009 • Fax (425) 455-0225 I LETTER OF HARDSHIP When requesting a variance to Section 14.08.180 of the amended Mason County Building Code, the applicant must submit a letter indicating why it is necessary to encroach into the five (5) foot setback established by the code. A hardship must be demonstrated (i.e. constraints of citing a structure because of topography, location of septic, location of accesses or other physical features, or what the use of the structure is and why the size is such that it will be encroaching.) The purpose of the ordinance is to maintain a ten (10) foot separation between structures for fire protection and access. When requesting a neighbor to agree to the infringement of the five (5) foot setback, the neighbor is agreeing that any structure that is proposed on his/her property must set back farther than five (5) feet in order to maintain a ten (10) foot separation. When requesting a variance from an EASEMENT, only the owner is required to sign the setback form provided indicating he/she is taking the responsibility of the structure near an easement. In no case will a variance be granted to place a structure within an easement.
