Moll JUL 1 19�� 6219 View Street Northeast Tacoma, Washington 98422 'ENERA.L SERVICES Dear Mr. Moll: Reference your discussion on July 3, 1985, with Mr. Robert Martin of my staff concerning the proposed construction of a bulkhead and placement of fill in Pickering Passage, Puget Sound near Shelton, Mason County, Washington. You inquired as to Department of the Army permit requirements. Paragraph 330.5(a)(13) of Department of the Army regulations dated July 22, 1982, authorizes bank stabilization activities in waters of the United States provided (1) the bank stabilization activity is less than 500 feet in length, (2) the activity is necessary for erosion prevention, (3) the activity is limited to less than an average of l cubic yard per running foot placed along the bank within waters of the United States, (4) no material is placed in excess of the minimum needed for erosion protec- tion, (5) no material is placed in any wetland area, (6) no material is placed in any location or in any manner so as to impair surface water flow into or out of any wetland area, (7) only clean material free of waste metal products, organic materials, unsightly debris, etc. , is used, and (8) the activity is a single and complete project. Based on the information you have provided, the proposed work consists of placing leas than 40 cubic yards of fill along 83 lineal feet of water- front property to be bulkheaded and will not involve the filling of wetlands. The work is authorized by nationwide permit provided the above criteria and enclosed conditions can be met. If you can comply with these conditions, an individual Department of the Army permit will not be required. This letter does not excuse you from compliance with other Federal, state, and local statutes, ordinances, or regulations which may affect this work.
