SHELTON,WA 98584 • (360)427-9670 November 18, 1998 Rick Krueger E 14241 State Highway 106 Belfair, WA 98526 WARNING NOTICE PER CHAPTER 17 .01.200 INTERIM RESOURCE ORDINANCE Certified Mailing RE: Grading Permit no. : GRD 98-0004 (.relocation of access road for Hood Canal Heights preliminary plat) ., Dear Mr. Krueger: Mason County Department of Community Development is sending you this letter in accordance with Enforcement Chapter 17. 01.200 C1 of the Mason County Interim Resource Ordinance. The conditions of your grading permit requires compliance with' the 25-foot setback requirements from the Type V stream on your site, and compliance with all requirements of Aquatic Management Area Chapter 17. 01. 110 of the Mason County Interim Resource Ordinance. Plans submitted by you or your agent to the Planning Department represented your project as meeting that setback. It has come to our attention that a portion of the vegetation area near Highway 3 has been graded, and that the stream has been routed into a culvert. The activity was observed by planner Randy Neff and Public Works engineer Rich Geiger on November 17, 1998, and photographically documented. We understand from this field visit that the activity has caused erosion and sedimentation. This grading in the stream buffer and stream relocation activity is in violation of the Mason County Interim Resource Ordinance and Mason Environmental Policy; both regulations are administered by the Mason County Department of Community Development. We understand that Rich Geiger and Randy Neff instructed you to stabilize the area and control erosion when they met you on site on November 17, 1998 . In confirmation of that information, you are hereby required to stabilize the disturbed area immediately with the appropriate erosion control measures to prevent siltation and further impact to the stream, adjacent buffers and impacts offsite; intrusion by equipment shall be the minimum to achieve stabilization, and the disturbance in the vegetation buffer shall be the minimum necessary for stabilization. With the exception of the above stabilization for erosion control, no activities are to occur in the stream area or its buffer. Any proposal to modify a stream or its vegetation area requires prior permit application and review, environmental (SEPA) review, Recycled r,'a and approval PRIOR to commencing the activity. Part of the permit/SEPA review process involves notifying and receiving input from other jurisdictional agencies including the Departments of Fish and Wildlife and Ecology, and tribal authorities. Based on the review and agency input, the Department of Community Development determines if the proposal is possible in its proposed form, needs revision, or if the stream and vegetation area should remain undisturbed. In other words, application and review does not automatically mean project approval . In addition the proposal requires separate permit application to Washington State Department of Fish and Wildlife and the Department of Ecology. Triple fees are assessed for after-the-fact permit application and review, as follows : Mason Environmental Permit $330 . 00 SEPA Environmental Checklist $330 . 00 Permit application forms are enclosed with this letter. Fees are due upon submittal . Your proposal for restoration of impact to the stream and its buffer will be addressed through this same permit process. In addition we are enclosing Enforcement Chapter 17. 01.200 of the Interim Resource Ordinance for your information. The chapter provides for enforcement procedures and fines as described within. You are hereby required to respond within 20 days of this letter per Chapter 17.01.200 C1. Please also refer to the conditions of your permit which require certain time-frames for correction of erosion control problems.
