Thank you for the opportunity to comment on the mitigated determination of nonsignifica.ncc for a grading
project to provide access to an existing office includes clearing, grading,drainage and paving, excavation of 225
cubic yards and importing;3,750 for phase 11, on 1.52 acres (Case No, SEP99-01.50) located on the Fast Side of
SR-3 in Belf'air, .3 mile south of the intersection with SR-300 at the intersection with Canal Heights Drive as
proposed by Lester Krueger. We reviewed the environmental checklist and have the following comments:
The Highway 3 ditch is considered "Waters of the State". Any discharge of pollutants would be in violation of
Chapter 90,48,Water Pollution Control,and WAC 173-201A,Water Quality Standards for Surface Waters of
the State of Washington, and is subject to enforcement action.
Erosion and sediment control is it key to preserving habitat and preventing denudation of a developing;arc t. The
following;practices are recommended:
a. Soil in stockpiles should be stabilized or protected with sediment trapping measures to prevent soil
loss. All exposed areas at final grade, or areas that are not scheduled for work for more than 30 days
should be stabilized within 10 days during the period from April 1 to October 31 or immediately during
the period running from November 1 to March 31.
b. Clearing; limits and/or any casements or required baffers shotild be staked and!lagged in the field_
c. Provision should be made to minimize the tracking of sediment by construction vehicles onto paved
public roads. lfsedimcnt is deposited, it should be cleaned every day by shoveling or sweeping, Water
cleaning;should only be done after the area has been shoveled out or swept.
d. Paint and wall finishing equipment wash water should be disposed of in a way, which will not
zdvorsely impact the water quality of the state.
e. Source control best management practices such as plastic covering, mulch,temporary seeding, and
phased clearing should be used to control erosion during;construction-
Oil/water separators should, at a minimum,be designed,operated, and maintained in accordance with Ecology's
"Stormwater Management:Manual for the Puget Sound Basin" February 1992. This includes routine inspection
and maintenance of the separator,nd establishing a written log of such activity. Discharge from all oil/water
separator should not exceed the state guidelines established for discharges containing;oil and grease of mineral
origin.

Routine inspection and maintenance of all sediment vid erosion control devices is recommended both during
and after development of the site.
Dumpsters and rcfusQ collection containers must be leak free with close fitting covers. The drainage for refiise
containers and dumpster areas adjacent to or over the water trust be connected to the sanitary sewer or otherwise
designed to prevent leachate from being discharged to surface waters.
The owner must ensure that any prospective commercial or industrial tenant of a facility served by an on-site
septic tank and drainficld system has obtained till necessary approvals acid permits from the Dcpartment of
Ecology or the local health departinent before assurances of occupancy or permission to modify the terms of
occupancy can be given.
The on-site sewage system and reserve system must be installed at least 100 feet from surface waters.

The Lead Agency for this proposal has determined that it does not have a
probable significant adverse impact on the environment . An Environmental
Impact Statement (EIS) is not required under RCW 43 .21C. 030 (2) (c) . This
decision was made after review of a completed Environmental Checklist and
other information on file with the Lead Agency. This information is

Conditions of this Case are listed below:

1 ) MITIGATED CONDITION #1 : The buffers that are shown on the plot
plan for this grading are on the south property line 10 foot,
which has been reduced by 1/2 with double the plantings. On the
east side of this lot the buffer is 10 foot with a wood stockade
fence 260 feet long and 8 foot high. The west property line
buffer is 20 foot buffer and the north line buffer is 10 foot with
a wood stockade fence 296 feet long and 8 foot high. The proposed
use for the parcel to the south of this site has been identified
as commercial TypelV per Ordinance # 82-96. If there is any
changes of uses on this site or to the parcel to the South of the
road then the buffers on this site will need to be adjusted to
meet the Mason County Development Regulations (Ord.# 82-96).
2) MITIGATED CONDITION #2: All future development of the proposed
site will be subject to the conditions that are listed. However,
this does not exempt future proposals from further review through
the SEPA process.
3) MITIGATED CONDITION #3: A Stormwater Site Plan (SSP) will be
created and implemented for this site. The Stormwater Site Plan
must meet the requirements of both Mason County Public Works and
the Washington State Department of Transportation.

4) MITIGATED CONDITION #4: The applicant must record an instrument
to protect the infiltration pond for Hood Canal Heights. The
recorded instrument must be submitted to either Pam
Bennett-Cumming or Randy Neff prior to the issuance of Grading
Permit (#99-0020). The grading permit will not be issued until
the protective easement has been recorded.
5) MITIGATED CONDITION #5: Emergency vehicle apparatus access roads
shall conform with the requirements of the Uniform Fire Code and
Mason County Title 16. If the access road cannot conform, special
conditions will be placed on any building permit issued on
property that is served by a non-conforming access road. Contact
the Mason County Fire Marshal for details.
6) INFORMATIONAL ONLY: Residential developers and individuals shall
be required to control erosion during construction. Removal of
vegetation should be minimized and any areas disturbed should be
restored to prevent erosion and other environmental impacts.

7) INFORMATIONAL ONLY: Water quality is not to be degraded to the
detriment of the aquatic environment as a result of this project.

COMMENTS:
The attached 8.5" X 11" snapshots of drawing B-1 show the changes in
the plan and the buffer yard table, for the attached drawings.
The most significant change is that the east buffer yard has been changed
to "vacant" requiring a buffer yard "D".
The south parcel (Parcel-A / Phase-1) will remain as Category IV for
buffer yard calculations. Even though the south parcel is perceived to be
retail, it will be less than 10,000 square feet.
