BOX 578 1864 SHELTON,WA 98584 • (360) 427-9670 FINDINGS FOR MASON ENVIRONMENTAL PERMIT DATE: July 30, 1999 PERMIT NO. : RLC99-0085 PROPOSED ACTION: Restore section of Type V stream per attached narrative and plans, including relocation, reconstruction and revegetation of stream and buffer, placement of washed gravel within stream bed, installation of instream structures to facilitate stream stability and promote pool and riffle habitats, locate 40 foot length stream crossing culvert to access property to south of stream. APPLICANT: Lester Krueger, Rick Krueger is agent. PROPERTY: Parcel no. : 12332-50-t06r2 pool DEPARTMENT OF COMMUNITY DEVELOPMENT: NOTE: This Mason Environmental Permit specifically addresses restoration .of damage to a Type V stream and buffer, and does not provide review for any form or process of development on this site, except that existing development is referenced in relation to setback requirements. In addition, the permit process does not constitute review or approval of proposed stream crossing access widths required for development proposals, but rather addresses the necessity for the proposed crossing culvert to provide the necessary conveyance capacity for the stream. a) The project site contains a Type V stream which flows westerly through the site to the vicinity of Highway 3 , then in a northerly direction parallel to the highway. Upstream of the project area the stream flows through a steep-sided forested canyon which provides a higher quality buffer to the aquatic habitat. The buffer requirements for a Type V stream are 25 feet per Mason County Resource Ordinance Aquatic Management Area Chapter 17. 01 . 110 . Prior to stream and buffer disturbance, the buffer on the north side of the stream was somewhat degraded in the proposed restoration area. Recvded } b) The access road to a subdivision has recently been developed on the property (Canal Heights Drive) . As part of the road construction process, both the stream and its buffer were modified without permit authority from Mason County. The stream was diverted into a roadside ditch, and culverted under the road to the ditch on the other side. Per Enforcement Chapter 17. 01.200 of Mason County Resource Ordinance, restoration is required. Environmental review and permitting for the restoration occur through the Mason Environmental Permit process and SEPA review. In addition, Hydraulic Project approval from the Department of Fish and Wildlife is also necessary. The applicant has been provided with a DARPA form to submit to WDFW. c) Mason County Resource Ordinance Chapter 17 . 01 .200 . I provides for the restoration of critical areas disturbed by work undertaken without the applicable permits . The applicant has submitted a Mason Environmental Permit and SEPA checklist for review of this restoration project. A restoration proposal, including timeline, has been prepared for the applicant by Applied Environmental Services Inc. (attached) . The restoration proposal also includes a 40-foot long culvert crossing to provide continued access across the creek. A discussion of the restoration proposed by the applicant follows, and a copy is attached. It is important to note here that any proposed restoration and stream buffer must occur outside the required road right-of-way minimum width for this plat road (right- of-way/easement width is 60 feet) , and outside any additional width required by Public Works. This information is noted in the conditions, and has been marked on the attached plans. The restoration plan provides for planted stream buffers, and re- creation and relocation of the stream. The stream position will be shifted south away from the new Canal Heights Drive to provide for a 10-foot wide vegetation area north of the stream. In compensation for this narrower buffer, an increased buffer area of 50 feet will be provided in the area to the east, where the canyon is steeper and forested (see sheet 6 of 6 attached) . On the south side of the stream restoration area, a 25-foot buffer is proposed. The stream bed will be washed gravel, slope will be restored to a more natural condition, and woody structures will be installed instream to facilitate stream stability and promote pools and riffles . A pool will be constructed near Highway 3 to provide for dissipation of hydraulic energy, prior to the stream changing direction. Revegetation is addressed in the planting plan (sheet 2 of 6 attached) , and the timeline for planting is addressed in AES letter dated June 11, 1999 (attached) . To date no monitoring plan has been submitted. Provisions for submission of a monitoring plan are addressed within the conditions of this permit. SEPA COMMENTS: Steve Kalinowski of Washington State Department of Fish and Wildlife has notified planning staff that Hydraulic Project approval no. : 00-E2335-01 addresses WDFW review of the restoration project. DEPARTMENT OF PUBLIC WORKS: The right-of-way for Canal Heights Drive is 60 feet. It is anticipated that development of the entire right-of-way and the addition of a deceleration lane will be needed in this area, due to this road' s use. Prior to commencing restoration activities, the applicant is to contact Public Works Engineering Services Manager Rich Geiger for details as to any additional right of way width requirements . In addition, Public Works provided the following information: 1 . The culverts to be installed both in the ditch line and the relocated stream shall be designed to pass the flows expected per the drainage report submitted by Mike Wnek, P.E. , and per the HPA. 2 . The responsibility to complete this project shall be borne by the applicant alone. This road right-of-way shall not be adopted into the Mason County Road System until the applicant has completed this project per permit requirements or has posted bond to assure project completion. DEPARTMENT OF HEALTH (ENVIRONMENTAL HEALTH) : Restoration of a stream and its buffer does not require review by the Environmental Health Department. FIRE MARSHALL: The Fire Marshall comments on stream restoration projects when access issues are involved, however this restoration project permit does not address any development proposal . That would need to undergo the standard Fire Marshall review process . COUNTY BUILDING OFFICIAL: Size of culvert to be approved by Mason County Public Works Department. No building permit is necessary for installation. CONCLUSIONS: The submitted Mason Environmental Permit, SEPA checklist and restoration proposal have been reviewed. Additional information has been added to the proposal plans to clarify that the proposed buffers and stream shall be outside of the 60-foot road easement/right-of-way and any additional right-of-way required by Public Works . Comments relating to the proposal are provided within this document, and attached. It appears that the restoration proposal, as modified to ensure buffers are outside the 60-foot easement/right-of-way, will generally meet the provisions of Enforcement Chapter 17. 01.200 of the Mason County Resource Ordinance, with the conditions attached. In addition to county requirements for this project, applicant shall apply to Washington State Department of Fish and Wildlife and receive Hydraulic Project Approval for project prior to start of work. x 2) Stream and buffer restoration shall be carried out according to modified plan, design and proposed timeline by Applied Environmental Services, Inc in letter dated Tuesday May 4, 1999 and letter dated Friday June 11 , 1999. Modifications on plans address requirement to provide for stream and buffer location outside minimum 60 ft easements/rights-of-ways. Winter site stabilization recommendations set forth in June 11 , 1999 letter are required as a condition of the Mason Environmental Permit being currently reviewed for this project. x 3) Temporary erosion control measures such as silt fences, straw bales, straw mulch, shal be installed and in place in all areas prior to the start of all site disturbance activities related to this project. x 4) All upland areas disturbed or created by site disturbance and restoration activities shall be seeded, vegetated, or given some other equivalent type of protection against erosion. Restoration plan developed by Applied Environmental Services shall guide in choice of vegetation, and site stabilization with coconut fiber matting. x 5) Any discharge of sediment-laden runoff or other pollutants to waters of the State of Washington is in violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201 A, WAter Quality Standards for surface waters of the State of Washington, and is subject to enforcement action by Department of Ecology. x 6) Proposed 40-foot stream culvert shall pass flows expected per drainage report submitted b Mike Wn k P.E. and per HPA. 9 p Y e x 7) Prior to start of project, applicant shall submit site monitoring plan to Mason County Department of Community Development for review and approval.
